Cornell Block Rezone
Medium Density Residential One (MDR1), Medium Density Two (MDR2) and High -Density
Residential 1 (HDR; see 18-00223) to High Density Residential one (HDR1)
The City recently sponsored a Comprehensive Plan Map Change for the Cornell block
(Resolution 2018-11). This area was also included in the (PED) Pedestrian Emphasis
District Overlay with recent changes to the Development Code for the (HDR2) High -
Density Residential 2 zone (Ord. 1196).
Residents in the Cornell neighborhood brought this application forward initially,
requesting a rezone to HDR1 for this area. The mayor directed the City to sponsor this
rezone. From a planning perspective, it was determined that a rezone of HDR2 would allow
larger development and higher -densities due to the adjacent location of these properties to
the BYU-Idaho campus. — Rezone from MDR1 and LDR2 to HDR2.
2. September e, an application was submitted by Sharon Oakey
with affidavits from neighbors for HDR1.
3. September 13", City staff submitted an application for the
Cornell block and a southeastern portion of an adjacent block
to the north to HDR2.
4. September 13`h, notice was sent to the local newspaper to be
published on September 18' and October 2aa
5. September 18a', notice was mailed to surrounding property
owners.
6. September 26a', Notice was posted at four locations on the adjoining blocks.
7. The Staff Review Sutmnary and Staff Report were reviewed by the Zoning Administrator.
8. October I", Devin Durrant submitted a written response.
October 4', the hearing was held before the Planning & Zoning Commission.
6:40PM — (18-00493) Cornell Block; — Rezone from MDR1 and LDR2 to HDR2.
Natalie Powell identified the area for rezone on the map. HDR2 is warranted at this location
due to the proximity of the University. Steve Oakey said in the comprehensive plan map
change, Steve disclosed his involvement in the proposal, and he was able to vote. Steve Oakey
disclosed he and his wife were active in moving this request forward. Rory Kunz asked, if
someone would like to develop at a lower density than the maximum allowed in the HDR2,

could they do so? Natalie Powell answered this is an option, but the projects would need to
meet the parking requirements and a larger lot is needed for such a project.
Commissioner Rory Kunz asked for any other clarifying questions. None.
Commissioner Rory Kunz opened the public input portion of the hearing at 6:48 p.m.
Favor: Nyle Fullmer - 236 S 2"d E; West side of 2"d E between 200 and 300 S — They are the
only owner -occupied house on their side of the street. The rest of the houses on the street are
all rental properties and have been for a number of years. He and his wife see this as a natural
progression of this area. The city has seen 2nd E as being the demarcation line for high-density
residential for a number of years. He fully supports this rezone.

Commissioner Rory Kunz closed the public input portion of the hearing at 6:51 p.m. He
invited staff to report.
Natalie Powell said public works did not have any concerns. Planning and Zoning
recommended this zone change and wants to encourage build -out in this location for maximum
density.
Bruce Sutherland says this looks like a natural progression of this area. This neighborhood has
been transitioning for several years. It is the city's desire to keep the high-density residential as
close to the university as possible to limit the outgrowth and spread which creates difficulties
with streets and infrastructure.

Motion: Motion to City Council to approve the request as described because the City
Staff and the residents in this area are in support and it seems like a logical progression
for this property around the university., Action: Adjourn, Moved by Bruce Sutherland,
Seconded by Mark Rudd.

AN ORDINANCE AMENDING AND CHANGING THE
ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND
PROVIDING THAT THE ZONED DESIGNATION OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED,
SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE
CHANGED AS HEREINAFTER DESIGNATED; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
City Planner Rindlisbacher reviewed the rezone request for Block 4 of Parker Addition (Cornell
Ave) and Lot 2 and 3 of Princeton Court Subdivision to High Density Residential 2 (HDR2) —
change zoning from Medium Density Residential 1 (MDR1) and Low Density Residential 2 (LDR2)
to High Density Residential 2 (HDR2). He said there was a Comprehensive Plan change on the
Cornell Block not too long ago. This request is a follow up rezone of that area plus the area to the
north. The property is set between Windsor Manor Apartments and 2"d East. This is the area that
they have had requests recently for dormitory style housing. The property is in transition so that
entire area plus the Cornell Block is recommended for approval to HDR2.
Council President Smith mentioned during the public hearing at the Planning and Zoning meeting
there wasn't much input.
Council Member Mann expressed his concern with a tunnel effect that might come on 2nd East in
the next few years; if they develop five story apartments. He asked how City Council can make sure
this doesn't happen. They also have to look at traffic flow from Walgreens to the temple if they can't
widen the road. He is concerned about having design standards and building height standards for
development up against the road.
Council Member Wolfe explained the City's direction seems to be moving that way to have
buildings closer to the street because of the walkability factor. He mentioned this part of 2nd East is a
narrower street. Public Works Director Davidson indicated the city has 90 feet of right of way in
case the road needs to be widened in the future.
Mayor Merrill said even with the apartments that are already there in the development agreement
with them; if the road needs to be widened they would need to move their sidewalk closer to their
building. Council Member Mann said there is a several story apartment building being developed
across from Porter Park; however, it's not a tunnel because there is green space on one side of the
street.

City Planner Rindlisbacher indicated the Comprehensive Plan currei., y identifies the preferred
land use on the east side of 2"d East up the hill from the existing complex as low to moderate. If the
City continues with the Comprehensive Plan as it is currently laid out there will be a step effect to
avoid the tunnel effect.
