HomeMy WebLinkAboutOrd 1203 Vacate Teton Lakes Fairway Plat ORDINANCE NO. 1203 Vacating “The Fairways at Teton Lakes” Plat AN ORDINANCE VACATING THE PLAT KNOWN AS “THE FAIRWAYS AT TETON LAKES” IN THE CITY OF REXBURG, IDAHO, AND DIRECTING THAT THE VACATED PLAT BE VOID AND THE LANDS REMAIN IN THEIR CURRENT USE AS GREENS IN THE TETON LAKES GOLF COURSE OWNED AND OPERATED BY THE CITY OF REXBURG AND MADISON COUNTY, IDAHO BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO: SECTION I: That the following described plat known as “The Fairways at Teton Lakes” located at approximately 722 North 12th West in the City of Rexburg, Idaho, the property being described as follows: Legal Description: Commencing at the West Quarter corner of Section 13, Township 6 North, Range 39 East, Boise Meridian, thence South 0°10'48" East, 2325.00 feet to the point of beginning; thence South 89°02'18" East, 102.31 feet to a point of a curve of a radius 215.63 feet; thence along the arc of said curve to the left, 191.94 feet; thence North 39°57'42" East, 131.49 feet; thence North 27°26’07" West, 191.03 feet; thence North 2°38'15" East, 590.39 feet; thence North 4°59'15" West, 365.86 feet; to a point on a curve of radius 217.73 feet; thence along the are of said curve to the right 323.54 feet; thence North 80°09'11" East, 528.13 feet to a point on a curve of radius 740.62 feet; thence along the arc of said curve to the left 296.00 feet; thence North 57°15'15" East, 320.22 feet to a point of a curve of radius 1024.08 feet; thence along the arc of said curve to the right 674.65 feet to a point on a curve of radius 147.71 feet; thence along the arc of said curve to the right 319.73 feet; thence South 39°01’30" West, 585.48 feet to a point on a curve of radius 149.37 feet; thence along the arc of said curve to the left 137.12 feet; thence South 13°34'23" East, 155.48 feet to a point on a curve of radius 201.79 feet; thence along the arc of said curve to the right 199.24 feet; thence South 43°00'00" West, 158.85 feet to a point on a curve of radius 349.18 feet; thence along the arc of said curve to the right 194.79 feet; thence South 74°57’42" West, 591.21 feet to a point on a curve of radius 321.33 feet; thence along the arc of said curve to the left 193.89 feet; thence South 40°23’20" West, 587.48 feet; thence North 27°26'07" West, 125.81 feet; thence South 36°09'48" West 77.89 feet to a point on a curve of radius 304.11 feet; thence along the arc of said curve to the right 290.85 feet; thence North 89°02'18" West, to the West line of Section 13, 100.52 feet; thence North 0°10'48" West, along said section line, 90.02 feet to the point of beginning. Contains 50.23 acres more or less. is hereby vacated and discontinued for the exclusive use of the joint owners of the real estate being the City of Rexburg and Madison County, Idaho as provided by Statute 50-1306A of the State of Idaho as part of the Greens at Teton Lakes Golf Course. Any and all existing easements for public utilities located in the portion of the vacated rightofway of said property shall remain as public easements and are not vacated. SECTION II: This ordinance shall take effect and be in full force and effect from and after its passage, approval and due publication as provided by law.
