One of the properties in question, was up for sale and itis an island within City limits, prompting negotiations with the current owners before selling. The City sponsored this annexation on behalf of the landowners. 2. March 13, 2018, Application was received for Annexation into the City of Rexburg, with the zoning to stay Community Business Center (CBC). 3. Notice was sent to newspaper on March 13, 2018 to be published on March 20, 2018 and April 13, 2018. 4. April 4, 2018, Notice was mailed to landowners within 350' from the properties. Results of Development Review Committee were sent to the applicant. 5. April 12, 2018 Notice was posted on the property 6. April 19, 2018 Application was presented at Planning & Zoning by Stephen Zollinger, City Attorney. X 6:35 p.m. (A18 00123) to Annex the property in the Impact Area at 1130 and 1138 University Blvd. in a Community Business Center (CBC) zone into the City of Rexburg. (Berry Oil/Bowen Petroleum & Double H Gas) The zone will remain Community Business Center (CBC). — Stephen Zollinger. Stephen identified the parcels that are being annexed tonight. The red -hash line is the current City of Rexburg boundary line and there is an island of two parcels. The parcels are owned by Berry Oil and the Harris Family Trust. The City has met with 11Page both parties and they have consented to this annexation. The City is beginning the process of looking at areas within the City that are islands within city limits. Conversations are beginning with some of the bigger property owners to clean these islands up. The infrastructure is all currently in place. There is a project in the course of the next few months that will result in a sidewalk that will go along the front of these properties to complete pedestrian access from the City to the High School. The question was asked, the City prompted this request? Stephen Zollinger, answered, the City became aware of a project moving forward on the Berry Oil parcel. In order to build the project, they are looking at, they would have to annex into the City. One of the properties is up for sale and this prompted the action. Motion: Motion to recommend to City Council the passage of the motion as recorded to close up the island in the City., Action: Approve, Moved by Steve Oakey, Seconded by Gil Shirley. Rexburg City Council May 2, 2018 — Held the public hearing to annex 1130 & 1138 University Blvd into the City of Rexburg. Ordinance 1185 — Annexation of 1130 & 1138 University Boulevard in a Community Business Center (CBC) zone into the City of Rexburg — Craig Rindlisbacher Planner Rindlisbacher presented Ordinance 1185 — Annexation of 1130 & 1138 University Blvd. The staff recommends this annexation as they do not like having islands within the city limits. Mayor Merrill opened the public hearing. Testimony of those in favor — None Testimony of those neutral — None Testimony of those opposed — None Mayor Merrill closed the public hearing. 21Page Discussion Council Member Busby asked if the City has visited with the land owner. Mayor Merrill replied that they have visited with the land owner several times and they are okay with the annexation. Council Member Mann asked if this is really a way to get a sidewalk installed going to the High School and make it a safer access. Mayor Merrill indicated that getting a sidewalk is one of the benefits but not the main reason for the annexation. Council Member Busby asked if a Local Improvement District will be created or if the City will install the sidewalk. Attorney Zollinger explained there is a joint project scheduled for this area that will provide for the sidewalks. Mayor Merrill asked for a motion.
