April 17, 2018, Staff discussed a clean-up Ordinance with items they have been discussing at Strategic Planning meetings. 2. May 9, 2018, notice was sent to the newspaper to be published on May 22"a and June 5`''. 3. June 7, 2018, staff presented the changes to the Planning & Zoning Commission. 4. 6:50PM - (18-00221) Development Code Amendments Craig Rindlisbacher — City Staff — These are actual changes to the actual Development Code. The first section is combining the components of General Business District (GBD) going in to the Community Business Center (CBC) zone. The chapter 3 items on the notice are the changes that occur as the two zones are combined. The chapter 4 item is the removal of the scoring in the Infill/Redevelopment section. There was a time when the City Council was worried about the impact on neighborhoods and they used this scoring to determine the impact. This scoring section of the code has not been used in some time. The rest of the changes are related to the engineering standards. Steve Oakey thanks the staff for the removal of the scoring section of the Infill/Redevelopment section. He feels this section was a failure from the beginning. He doesn't like the lists in the permitted and conditional uses. The lists continue to change. Let's figure out some verbiage to describe the uses we expect to see in each zone. This action is evidence of the management of these lists. Scott Johnson says staff is working on this request. Keith Davidson — The Public Works items are also changing. Most of the changes come out of the subdivision section. Street cross sections, water & sewer line placements, electrical lines going underground, etc. The change moves things from the Development Code to the Engineering standards and cleans up the language in the Code. Changes in technology going forward will be easier to change through a resolution vs. going through an Ordinance change. Steve Oakey asked, does this make it easier to develop a project? For example, the DEQ request to approve the plat for the sewer and water main lines. Keith responded, this is just a clarification. In the past, people came in with projects and didn't know they need DEQ approval. The approval has always been required by the state code. This change is to inform the developers of current practices. Tawnya clarified these changes clean up the requirements and allow the City to be more clear about where to look for any updates. Rebuttal: The public hearing has closed at 7:37PM. Steve Oakey asked if the request is all or nothing. Can the motion be itemized? He requested striking the first 2 sections where it itemizes acceptable uses. He would like the lists taken out. Steve recommends to consider striking the first 2 sections where it itemizes permitted and conditional uses. 3.18.020. & 3.18.025. Heidi Christensen and Scott Johnson clarified the changes he is referring to are the changes brought in from General Business District to Commercial Business Center. Some of the uses have been changed from conditional uses to permitted uses. Steve Oakey can support the action if simpler clarifica don is forth coming. Scott Johnson responded this is an interim action. Darrik Farmer moved to recommend to City Council to make the changes to the Development Code to simplify the Code and clarify for developers. Ordinance 1188 Development Code Ordinance Amendments (Ordinance No. 1115): (Planning and Zoning Commission recommended changes to the Development Code as itemized in the Working Copy of the Development Code.) City Planner Rindlisbacher summarized the changes to the City's Development Code. He said the changes are as follows. PROPOSED AMENDMENTS TO THE DEVELOPMENT CODE OVERALL CHANGES IN WORDING Changing Rexburg Engineering Standards to Ci y Engineering Standards CHAPTER 2.• DEFINITION Addition of City Engineering Standards CHAPTER 3. ZONING DISTRICTS Section 3.18.020 — Community Business Center (CBC) Permitted Principle Uses - Addition of Antiques; Auto Glass Repair; Automobile Sales (New & Used); Automobile Motor Clinics; Commercial Printing (only retail sales of printed products); Dwelling and building services (not dwelling units); Liquor Store; Motorcycles, Motor Scooters, Parts; Professional Services; Social ,Fraternal, and Youth Organizations and Services; Thrift Store and General Second -Hand Merchandise (Indoor display & storage only); Wedding Chapels and Reception Centers. Conditional Uses — Ambulance Service; Animal Grooming Animal Hospital Services; Bottled Gas; Manufacture and Installation ofAutomobile Seat Covers and Auto Tops; Residential Facilely forElderly Persons; Service Stations. Remove Single family dwelling. Section 3.18.080 Yard RL9wrements — Frontyards established before this zone maybe equal to the average of existing frontyards along the block face on which a building or structure is to be located Accessory buildings on the sideyard must provide far the discharge of all roof drainage onto the lot orparcel on which it is erected When a rear yard is adjacent to a residential zone or use, the rearyard setback shall match the setback requirement of the adjacent residential zone. Page 2 of 3 Section 3.18.150 6. ler Requirements — If remodeling in existing Ci kones and building is enlarged, landscaping requirements shall not fully apply if thy conflict with parking requirements, are incompatible with design of existing building, or impair ingress or egress to existing building or parking areas. CHAPTER 3 & 4.• SETBAC%SAND RIGHT -OR WAYEWCEPTIONS Additional Exceptions: Sidewalk placement at location indicated in the current Ciy Engineering Standards CHAPTER 4.• SUPPLEMENTARYREGULATIONS Section 4.151hrW1Redemkpmeot Standard —Remove portions titled Weighting and Project Scoring in their entirety. CHAPTER I2.• SUBDIVISION CODE Section 2.3 Preliminary Plat - Clarification of Existing Conditions Data to include easements, and Water Rights and Shares. A traffic study may be required by the Ciy Engineer for any development that has a potential to significantly impact traffic flow. Section 3.2 3.3 3.6. 4.2. - Regarding Design Standards for Street right -of ways, lanes, curb, gutter and sidewalks, access conditions, and paving, Ufiliy Location, Storm Sewer, and Required Improvements; the inclusion or change of such standards and requirements to meet Current Engineering Standards or requirements of the City Engineer and in cases regarding water and waste water ystems D.E.Q. standards also be met. Section 3.2 - i a. New streets to conform to transportation gstem masterpdanning whenever applicable. 4 a. Dead-end streets serving more than the equivalent of four residential lots shall provide by easement a temporary turning circle with a fory-five foot radius or other acceptable design to aaomplish adequate access. 5 a. Loop streets lengths are measured along the centerline from centerline intersection to centerline intersection or upon the approval of the Ciy Engineer. Standards for Major Arterial Street intersections shall not be less than specified by the IDAPA 39.03.42. Section 3.3 - 5. Location requirements of installed wastewater, water, and gas mains pertaining to do streets have been replaced with asper Ciy Engineering Standards. Electric lines are to beplaced underground in the easement. Onsite storm retention for the panel may not use the right of way for storage or conveyance to another portion of the parcel. Section 3.4 & 3.5— Water and wastewater ystem design and installation must be done in accordance to the Idaho Department of EnvinonmemalQualio (DEPJ and adopted current engineering standards. The Sub -divider is responsible far submitting the designs to the DE,Q for approval. A copy of the DEQ final design approval shall be submitted to the Ciy Engineer by the Sub -divider. Water system design standards 3.4.4 to the end of section 3.4 have been removed 3.5.3 to the end of section 3.5 have been removed. Section 3.6— All storm water system design is to be done by an Idaho registered engineer. Requirement from run off coefficients and storm event values to the end of section 3.6 have been removed Street light installation requirements are removed and nplaced by per City Engineering Standards.
