All applications that are complete will be processed with due diligence and will be scheduled, dependent
upon availability, for an upcoming agenda.
Formal notice will be sent to the applicant after approval of a Conditional Use Permit. Notice will state the
conditions of the permit. If conditions are violated or not met there will be a 90 -day period to cure the
problem. Failure to compjy with the terms may result in revocation of the Conditional Use Permit.

Conditional Use Permit Procedures
1. Complete application is received and fees are paid.
2. Proposal is placed on internal Strategic Development meeting for staff taking place Tuesdays at 4p.m.
3. Documents are transmitted to staff for review.
4. Planning and Zoning Commission meeting is scheduled.
5. Notification is mailed to landowners within 300' 15 days before hearing.
6. Proposal is posted on the property.
7. Staff Review is sent to applicant.
8. P&Z Agenda is published & sent to applicant
9. Hearing is placed before Planning and Zoning Commission.
10. If a material change is requested, another hearing may be scheduled before the Commission.
11. If park, nursery school, day care centers, churches, synagogues, temples, funeral or crematory service, home
occupation, development with 4 or less dwelling units, gov. buildings, household goods warehouse and
storage, or reduce parking space size in parking structures, the permit needs only go through Commission.
12. All other uses go before City Council.
13. If material changes to the permit are made, additional City Council hearing will be needed.
14. Applicant receives a copy of the conditions of the permit to sign.
15. CUP recorded at Madison County. (*If conditions are not met within 90 days. CUP will be revoked.)

NOTICE OF PUBLIC HEARING
TO AMEND THE COMPREHENSIVE PLAN MAP AND THE ZONING MAP
FOR THE CITY OF REXBURG
NOTICE IS HEREBY GIVEN that two Public Hearings will be held the 1" of March, 2012:
Public Hearing #1: at 7:05 p.m. at City Hall, 35 North V East, Rexburg, Idaho, before the
Rexburg Planning and Zoning Commission of the City of Rexburg, Madison County, Idaho, to
consider request (#12 00044) to amend the current Comprehensive Plan Map from Moderate -High
Density Residential (52 North 3' West) and Light Industrial (250 West Main) to Neighborhood
Commercial/Mixed Use. The proposed changes to the Comprehensive Plan Map at 250 West Main
and 52 North 3`d West are for two city lots joined at the rear lot line as noted below with the
associated legal descriptions.
Public Hearing #2: at 7:20 p.m, before the same Rexburg Planning and Zoning Commission for
request (#12 00045) to rezone the same property noted in public hearing #1 for Tru North
Development to change the zoning from Low Density Residential Two (2) at (52 North 3" West),
and change the zoning from Community Business Center and Light Industrial at (250 West Main) to
Mixed Use 2 (MU2).
Legal Description for both Public Hearings:
A parcel of land situated in Madison County, Idaho, Township 6 North, Range 40 East, Section 19,
more particularly described as follows:
Beginning at the Southwest Corner of Lot 3 Block 30 of the Original Townsite of Rexburg:
thence N90°E 150.00 feet to the true point of Beginning; thence N00°E 330.00 feet to the
South line of Lot 2 of said Block 30; thence S90°W 150.00 feet to the Southwest Comer of said
Lot 2; thence N00°E 165.00 feet to the Northwest Corner of the South Half (S1/2) of said Lot
2; thence N90°E 330 feet to the Northeast Comer of the South Half (S1 /2) of said Lot 2;
thence S00' W 12.00 feet; thence N90°E 131.08 feet; thence S00°W 82 feet to the Westerly
Right -of -Way line of the Oregon Short Line Railroad; thence S15°58'40"W along said Right -of -
Way 228.09 feet; thence S30°20'00"W along said Right -of -Way 135.23 feet to the East line of
Lot 3, Block 30; thence S00' W 13.86 feet to the Westerly Right —of -Way line of the Oregon
Short Line Railroad; thence S30°20"00'W along said Right -of -Way 59.26 feet; thence S90°W
150.07 feet to the True Point of Beginning; Containing 3.44 Acres More or Less.
Subject to: Easements and Right -of -Ways for highways, roads, ditches, canals, power poles, and
transmission lines as they exist.
At such Public Hearings the Rexburg Planning and Zoning Commission will hear all persons and all
objections and recommendations relative to the Comprehensive Plan Map revisions and the
proposed zone change request that will be proposed. The Planning and Zoning Commission
encourages all City residents to participate in the process to amend the Comprehensive Plan Map
and the Zoning Map.
Citizen's comments may be submitted in writing or by email during the fact finding period to the
City Clerk at City Hall located at 35 North 1" East, Rexburg, Idaho, prior to 4:00 p.m. on the 29" of
February, 2012. This notice is given pursuant to the provisions of Section 67-6508, 67-6509 and 67-
6511 Idaho Code, and all amendments thereof.
