WARRANTY DEED
For Value Received B & D CONSTRUCTION, INC.
Hereinafter called the Grantor, hereby grants, bargains, sells & conveys to
MARK A. SMITH and ELAINE SMITH, husband and wife
whose address is: 3776 N. 3000 W„ Provo, UT 84604
Hereinafter called the Grantee, the following described premises situated in Madison County, Idaho, to -wit:
PART OF LOT 1, BLOCK I OF SHERWOOD HILI S SUBDIVISION NO, I TO THE CITY
OF REXBURG, MADISON COUNTY, IDAHO, AS PER THE RECORDED PLAT THEREOF,
DESCRIBED AS:
COMMENCING AT THE NW CORNER OF SAID LOT 1, BLOCK 1 AND RUNNING
THENCE EAST 190.00 FEET ALONG THE NORTH LINE OF SAID LOT 1; THENCE
SOUTH 82,00 FEET; THENCE SOUTH 30009'17" WEST 77.38 FEET; THENCE
SOUTH 55000'54" WEST 100,00 FEET; THENCE SOUTH 74°17'18" WEST 71.89
FEET TO THE WEST LINE OF SAID LOT 1; THENCE NORTH 225.71 FEET ALONG
SAID WEST LINE TO THE POINT OF BEGINNING.
SUBJECT TO all easements, fight of ways, covenants, restrictions, reservations, applicable building and zoning
ordinances and use regulations and restrictions of record, and payment of accruing present year taxes and assessments
as agreed to by parties above.
TO HAVE AND TO HOLD the said premises, with their appurtenancesunto the said Grantee and to the
Grantee's heir; and assigns forever, And the said Grantor does hereby covenant to and with the said Grantee, that
the Grantor is the owner in fee simple of said premises; that said premises are free from all encumbrances except
current years taxes, levies, and assessments, and except U. S. Patent reservations, restrictions, easements of record,
and easements visible upon the premises, and that Gramor will warrant and defend the some from all claims
whatsoever.
