Chairman Heidi Christensen opened the meeting at 6:33 pm.

Planning and Zoning meeting - May 3, 2018
Steve Oakey motioned to pass the minutes as recorded. Greg Blacker seconded.
None opposed. Bruce Sutherland abstains.
Public Hearings:
Chairman Heidi Christensen welcomed all those present who have come.
1. 6:35PM – (#18-00193) Conditional Use Permit for Dormitory Housing in a Mixed Use zone.
– 220 South 2nd West (Arbor Cove) – Johnny Watson
Johnny Watson -1152 Bond Avenue – We
rezoned the parcel to Mixed Use recently. Staff
reminded Johnny he needed to do a Conditional
Use Permit as part of the ordinance. The buildings
have been torn down. We aren’t ahead of
ourselves, yet. A Conditional Use Permit is needed
for a Dormitory style housing. This particular
project is not in the PED as others he has done.
Cedars is to the East. Porter Park is to the north.
This is the old Arbor Cove apartment complex.
The parcel is just over 4 acres. The parcel has been
rezoned Mixed Use. The intent is to take advantage
of the language. He showed a development with
two 4-story structures – men and women. The two
can be interchanged based on demand. 30 units/acre is allowed. Parking can only be allowed to
reduce to 75%. Right now there is 84 units instead of the maximum 120 units. They are under
the density allowed. The parking stalls are all provided. There is a public space in the front.
6bedroom-8 bedrooms. Leasing office, public spaces, exercise rooms were identified. Bldg. 2
doesn’t have any public spaces. 560 kids are just over a block from campus.

Steve Oakey requested the PED Zone boundaries to be shown on the map. He wanted to see how
this project compares to others. It doesn’t make sense to not have this development outside of the
PED zone, if we assume the students will be walking to the college.
2nd West was identified on the map. Scott Johnson talked about a PED 1 and PED 2 zone; they are
treated the same. The University did not want the PED to cross 2nd West. It was a safety issue
where three people were killed crossing the street. There is a lot of debate internally with staff.
Johnny talked about staff requirements. Staff required a sewer study. A traffic study. Right now,
they are working through the infrastructure items. Johnny currently has to meet the requirements
for outside of the PED.
Chairman Heidi Christensen asked if anyone in the audience had any clarification questions about
this proposal.
There were no questions.
The Chairman asked if there was any added clarification of the proposal from staff.

Craig Rindlisbacher addressed the staff comments. The infrastructure requirements are being
addressed in the development agreement. The only item separate from this is a Planning & Zoning
requirement for bicycle parking. The owner is also the owner of Mountain Lofts. Johnny Watson
talked about the owner providing outside bicycle parking, as well as moped parking. This needs to
be outside to prevent wear and tear on the building. Chairman Heidi Christensen asked is 1
space/10 beds, is this normal?
Steve Oakey asked is this is a requirement the City is starting to require? The bicycle parking is
already a requirement. Staff is asking for Johnny Watson to show this parking on the site plan.
Steve talked about the traffic study. He didn’t like the open-ended requirements that potentially pile
on the developer and their budget. The requirement language has been discussed with staff to be
more detailed for clarity.

Outside of the PED, Scott pushed the parking to go down to 75%. The University will only allow
developers to go down to 65%.
Johnny responded about the traffic study. Why was there not a more definitive answer? The traffic
study showed the facility itself doesn’t change the level of those intersections. Keith was looking
into taking into account Providence Square compounded with Arbor Cove would change the
intersection. A lengthy discussion was had with Keith to clarify the traffic study comments.
Kristi Anderson is wondering about the safety to cross the street at Arbor Cove. Do the flashing
lights provide adequate safety? Updates would have to happen to the traffic signal. Scott
responded, the hawk light is currently in place, which is the flashing light that make people aware.
This has been proven to make people pretty safe; making drivers aware of the crossing. Bruce was
in another community that used a hawk light. It worked really well there, as well.
MOTION Steve motioned to recommend the request to City Council based on the
Comprehensive Plan Map Change and Rezone passage to expedite a process already in
place, due to the fact this Conditional Use Permit was an oversite. Bruce Sutherland
seconded the motion.
VOTE. None opposed.
Gil Shirley arrived.
2. 6:40PM - (#18-00191) Conditional Use Permit for Dog Grooming business in a Mixed Use
zone – 107 N Center – Jo Ann Hope
Natalie Powell, City of Rexburg, presented the
application on behalf of the applicant. She oriented
the Planning & Zoning Commission to the property.
Jo Ann’s current business has grown out of the
location shared with a dry-cleaner. We would like to
keep her in Rexburg in the downtown area. 107 N
Center is across the street from the library. Staff has
worked with the applicant on the traffic and parking.
The shed would be removed, creating extra parking.
They would like to put in a one-way drive, which will
be signed. They will do a curb-side pick-up. The other
concern is the noise level. The basement has been
sound-proofed, a holding area, where the dogs will be kept to wait for grooming. A Conditional
Use Permit is required by the zoning.
Steve Oakey asked if dogs would be kept overnight. There will be no overnighters, only during the
day. Will the nuisance be more than residential? Natalie answered, the dogs will probably be less of
a nuisance, because the dogs will not be kept outside. This way, she will have them inside the
building. Melanie Davenport asked about the handicap access and parking space?

Kristi Anderson asked if additional screening will be needed. The house to the North is close.
Landscaping is required to buffer a residential business from residential homes. The conformity
happens when the use changes from residential to a business.
Chairman Heidi Christensen asked if any members of the audience had clarification questions
about this proposal.

In Favor: Bron Leatham – 1272 N Yellowstone Hwy. He currently owns the property. He is
selling it for this purpose. This is the intent behind Mixed-Use zoning. Older homes on smaller
parcels economically doesn’t work. If you could do single-student housing, this would work, but
this is in the wrong location. These are ideal homes for a business to maintain the properties.
$60,000 has already been put in the home to update it.

Greg Blacker is in favor of this proposal. Melanie supports the application, because it is
grooming, not boarding. Gil Shirley says there are not many businesses in this area, but it seems
like a good fit for this area.

Chairman Heidi Christensen asked for the staff evaluation and recommendations. Staff has
nothing more to say.
MOTION Greg Blacker motioned to recommend City Council approve this Conditional
Use Permit, because it is consistent with what we like to see to repurpose older houses and
promote economic development. Melanie seconded the motion.
