1. April 12, 2018, application was received for a Conditional Use Permit for a Dog Grooming business in a
Mixed Use zone.
2. April 19, 2018, application fees were processed.
3. April 26, 2018, notice was sent to the local newspaper to be published on May 1 and May 15, 2018.
4. April 30, 2018, notice was mailed to adjacent landowners.
5. May 1, 2018, a site plan was received at the Planning & Zoning office.
6. May 7, 2018, a Staff Review Summary and a Staff Report were sent to the applicant.
7. May 17, 2018, the application was presented to the Planning & Zoning Commission.

Roll Call of Planning and Zoning Commissioners:
Steve Oakey, Kristi Anderson, Heidi Christensen, Melanie Davenport, Bruce Sutherland, Greg Blacker, Gil Shirley
Natalie Powell, City of Rexburg, presented the application on
behalf of the applicant. She oriented the Planning & Zoning
Commission to the property. Jo Ann's current business has grown out
of the location shared with a dry-cleaner. We would like to keep her in
Rexburg in the downtown area. 107 N Center is across the street from
the library. Staff has worked with the applicant on the traffic and
parking. The shed would be removed, creating extra parking. They
would like to put in a one-way drive, which will be signed. They will
do a curb -side pick-up. The other concern is the noise level. The
basement has been sound -proofed, a holding area, where the dogs will
be kept to wait for grooming. A Conditional Use Permit is required by
the zoning.
Steve Oakey asked if dogs would be kept overnight. There will be no overnighters, only during the day. Will the
nuisance be more than residential? Natalie answered, the dogs will probably be less of a nuisance, because the dogs
will not be kept outside. This way, she will have them inside the building. Melanie Davenport asked about the
handicap access and parking space?
Kristi Anderson asked if additional screening will be needed. The house to the North is close. Landscaping is
required to buffer a residential business from residential homes. The conformity happens when the use changes
from residential to a business.
Chairman Heidi Christensen asked if any members of the audience had clarification questions about this
proposal.
Chairman Heidi Christensen opened the public hearing at 6:55PM.
In Favor: Bron Leatham — 1272 N Yellowstone Hwy. He currently owns the property. He is selling it for this
purpose. This is the intent behind Mixed -Use zoning. Older homes on smaller parcels economically doesn't work.
If you could do single -student housing, this would work, but this is in the wrong location. These are ideal homes
for a business to maintain the properties. $60,000 has already been put in the home to update it.

Greg Blacker is in favor of this proposal. Melanie supports the application, because it is grooming, not boarding.
Gil Shirley says there are not many businesses in this area, but it seems like a good fit for this area.

The folloaring are the criteria for granting a conditional use permit. Some of the criteria are followed by
staff s analysis. A conditional use will:

Comprehensive plan
The Comnpiehensive Plan Map identifies the area as Neighborhood Commercial Mixed Use. The
use is in accordance with the Coa preheasive Plan.
Development Code (adinance 1115)
Dog Grooming is allowed with a Conditional Use Permit in the Iv1L zone as per the City of
Rexburg DesTlopmemt Code Section 3.14.025. Conditional Uses.
c. Be designed and constructed in a manner to be harmonious with the esisting character ofthe
neighborhood and the zone in which the propert$- is located
At Public hearing for the CUP, the applicant should come prepared to discus the possible or
perceived musaaces associated with a dog grooming facility at the requested location- They
would include but not be limited to the following:
1. Noise generated by barking dogs. Possible need for noise dangsening at windows.
2. Possible buffering with trees and bushes benseen properties.
3. Parking bufferimg fi'om street.

Staff reconmren& that the Planning and Zoning Comunssion make reconunendation to the City
Council to approve this request with the following conditions:
1. Windows facing adjacent properties are sound -dampened. This can be achietvd with low cost
materials such as Styrofoan
2. The Planning and Zoning Conrn s on take testiuwuy and detemsine if landscape buffers are needed
between properties.
3. Patking is adequately buffered from street_
Chairman Heidi Christensen asked for the staff evaluation and recommendations. Staff has nothing more to say.
MOTION Greg Blacker motioned to recommend City Council approve this Conditional Use Permit,
because it is consistent with what we like to see to repurpose older houses and promote economic
development. Melanie seconded the motion.
VOTE. None opposed.
9. City Council June 6, 2018 —Conditional Use Permit (1800191) for Dog Grooming business in a
Mixed Use zone — 107 North Center Street — JoAnn Hope
Planner Rindlisbacher showed the location of the proposed CUP on the overhead screen. Planning &
Zoning is very supportive of this permit. There were no conditions discussed.
Council Member Busby asked if there will be dog boarding there. Planner Rindlisbacher said the business will
not have any boarding of dogs there. This will be just a come and go grooming business.
Council President Smith moved to approve Conditional Use Permit (1800191) for Dog Grooming
business in a Mixed Use zone — 107 North Center Street with them meeting all staff requirements; Council
Member Wolfe seconded the motion; Mayor Merrill asked for a vote:
