Roll Call of Planning and Zoning Commissioners: Attending: Heidi Christensen, Mark Rudd, Bruce Sutherland, Steve Oakey, John Bowen, Greg Blacker, Darrik Farmer, Kristi Anderson, and Melanie Davenport. Darrik Farmer and John Bowen abstained from not having been present. Rory Kunz came late. Gil Shirley was excused. Minutes: From Planning and Zoning meeting – October 5, 2017 Bruce Sutherland motioned to approve the Planning & Zoning minutes of October 5, 2017, as recorded. Kristi Anderson seconded the motion. Darrik Farmer and John Bowen abstained for not having been present. Melanie arrived after the vote. 35 North 1st East Rexburg, ID 83440 Phone: 208.359.3020 Fax: 208.359.3022 www.rexburg.org Planning & Zoning Minutes October 19, 2017 2 Public Hearings: 1. 6:35p.m. City Hall Sponsored Comprehensive Plan Map Change - Val Christensen – (#17 00576) to change the Comprehensive Plan Map from Neighborhood Commercial Mixed Use to Moderate –High Density Residential for East half of Block 50 of the original Rexburg town site and Block 1 Lot 1 of the Parker addition or approximately 150 S. 2nd E. in the City of Rexburg, Madison County, Idaho. Val Christensen. About eight years ago, the city sponsored a comprehensive map change and rezone of three city blocks between 1st West and 2nd East. The area was changed to mixed use for the comprehensive plan at this time except the ½ block the City is requesting today. This ½ block remained medium density residential. It wasn’t the time and the place, yet, to change the whole area. The zone in this area of mixed use has leap-frogged across S 2nd East, which has a high-density residential component. The City wants to change this ½ block that faces S 2nd E to a moderate to high comprehensive plan designation. Right now, this change does not affect anyone’s property rights. This will allow a high density residential zone to be requested, much like the development across S 2nd E, without the requirement of a commercial component. Instead of continuing residential projects that are not true mixed use, the comprehensive map change is requested. No requests for commercial have come forward on this street in this area. There are some single-family residential areas to the south and southeast of the request. The street is a good buffer. The City continues to see 2nd East transition from single-family. The public works comments will apply more appropriately at development, but allow developers to know, up front, the requirements of the property. Melanie stated, increasing density in that area will increase foot traffic. Val replied, since this is also in the PED zone, a medium density project could be built to allow unlimited density in this area. These are the areas the City wants the high densities. Chairman Heidi Christensen asked for any other clarifying questions. None. 3 Chairman Heidi Christensen asked if the public has any questions for staff. None. Chairman Heidi Christensen opened the public input portion of the hearing at 6:43 p.m. Favor: Jonathon McMullin – 260 W. 1st N. – He is a representative of the owner of the land. He is supportive of the comprehensive plan change. Val has covered many of the pros of this change. He has nothing more to add. Neutral: None Opposed: Michael Garry - 1014 S. 2620 N. Provo, Utah - He is currently from Utah, but his family owns two of the houses on 2nd East. Michael’s family owns 152 S 2nd E. and 1014 E 2620 N, which are currently rentals for single-families. He is concerned this change will push out the family rental homes. Written Input: None Rebuttal: Val says the struggle is having these families backing out onto 2nd East which is becoming a large arterial street due to direct access to the campus. If an application came forth to change these homes to duplexes, the concern would be adding more people backing out onto this major arterial. As this area redevelops, the City is not allowing access on 2nd East. These redevelopments will have to come in off of side streets. The density could be achieved with the current zoning. The PED was created for the purpose of building high density residential. Steve Oakey says, addressing Michael Garry, this has no bearing on how your family is using their property. The city is not forcing the single-families out of this area. Craig clarifies the change tonight is not changing the density. The change is just taking away the commercial component. Chairman Heidi Christensen closed the public input portion of the hearing at 6:52 p.m. She invited staff to report. Val Christensen on behalf of staff. No further comments. Commission deliberation. Melanie was concerned that the applicant would be well advised to have an ice management plan on the corner of 2nd East and 2nd South due to the danger for the major pedestrian traffic. This intersection is hard for drivers to navigate in the winter time. Val says public works is aware of this issue. Darrik does not think commercial should be in this area at this point. Chairman Heidi identified these comments are consistent with the Commissions’ previous decisions for this area. MOTION: Steve Oakey motions to recommend the application to City Council as printed, on the applicant’s form, items 8b and 8c. 8b. The amendment advances the goals and policies of the comprehensive plan by achieving infill, generating activity in an area adjacent to downtown, and accommodating population growth of the BYU-Idaho campus. 4 8c. The development replaces sprawl on the edge of the community. It promotes economic growth in the center of the community. And, it takes advantage of existing infrastructure. Melanie Davenport seconded the motion. Rory Kunz arrived. Commission Discusses the Motion: The motion is a recommendation to City Council and no further discussion is needed. Chairman Heidi Christensen closed the public hearing at 6:55 p.m. Kristi recalled Craig was working on a housing study. Craig was glad she reminded him. He needs to update the previous map he presented. She requested to hear from BYU-Idaho’s housing department to present to the Commission where they are at with their housing. Brad Wolfe stated Brett Sampson, the BYU-Idaho liaison, gave a similar report to City Council. Craig will follow up with the request for the meeting on November 16th, 2017, due to the two hearings scheduled on November 2nd, 2017. (#17 00537) Silver brook – Jonathon McMullin - to rezone the property at approximately 104 S. 2nd E. from Medium Density One (MDR1) to High Density Residential (HDR1). The applicant is also seeking Conditional Use Permits (CUPs) for dormitory housing and reduced parking to 65% in the Pedestrian Emphasis District (PED). 2. Short-term rental task force – Rory Kunz Steve Oakey motioned to adjourn the meeting. Mark Rudd seconded the motion. None opposed. Motion carried. The meeting was adjourned at 6:56 p.m. until November 2nd, 2017.
