The objective of the comprehensive plan is to have well thought growth "in such a way that public good and private rights are equally balanced". The city staff has determined that the General Business District (GBD) Zone is not significantly different than the Community Business Center (CBC) Zone. BACKGROUND When the Rexburg. Development Code was rewritten about thirteen years ago, the planner at that time took codes from three other cities and merged them together. He also tried to include some parts and titles from the previous Rexburg Code. The old code had only Central Business District (Downtown) Neighborhood Commercial District (was really never used) and Highway Business Zone (the main commercial along 2nd East, 2nd West, 4`h South and the Yellowstone Highway). After combining the codes, he ended up with -Neighborhood Business District, General Business District, Central Business District, Local Business Center, Community Business Center and Regional Business Center. For the last ten years, staff has been trying to simplify the Development Code. We have removed Local Business Center and Neighborhood Business District. By absorbing General Business District into Community Business Center it will get us back to three comFne'rcial zoning districts. Before we go to public Case No. 17 00219 Page 1 hearing to remove the zones from the Development Code, we needed to get rid of the zone on our Zoning Map. The Rexburg Development Code allows for the Commission to make recommendations to the City Council regarding whether or not the property should or should not be rezoned based on the criteria found in section §6.13. II. " SITE DESCRIPTION The parcel being changed is located on University Blvd. It includes the lot that McDonalds is on and the five lots to the east of McDonalds. The total area involved in this re -zoning request is approximately 10 acres, which if approved will result in changing the zone from General Business District (GBD) to Community Business Center (CBC). III. ANALYSIS If approved the request will result in changing the zone from General Business District (GBD) to Community Business Center (CBC). The request would require the Commission and City Council to review the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria listed by Ordinance No. 1115 (Development Code) that are required to be addressed, followed by staffs analysis of each criterion. Criteria Rezone Requests 06.13)_ a. Be in conformance with the City's Comprehensive Plan and the City Development Code. The Comprehensive Plan identifies the land use designation for the property as Commercial. The new zoning fits the Comprehensive Map. b. The capacity of existing public streets, water and sewer facilities, storm drainage facilities, solid waste collection and disposal, and other utilities. No significant change in use. c. The capacity of existing public services, including but not limited to, public safety services, public emergency services, schools, and parks and recreational services. No significant change in use. d. The potential for nuisances or health and safety hazards that may adversely affect adjoining properties. No significant change in use. e. Recent changes inland use on adjoining properties or in the neighborhood of the map revision. There is a new hotel project directly to the South and new apartments to the east.. f. STAFF RECOMMENDATION Staff requests that Planning and Zoning recommend to City Council to change the above described property from General Business District (GBD) to Community Business Center (CBC).
