MUIR Fee: 0.00 F CITY ,, FX -Officio Recorder Deputy_ x REXBURG 0 Arurri.az F�rudp Conunuvuq ORDINANCE NO. 1184 AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described property situated in the City of Rexburg, Madison County, State of Idaho, regarding (#18 00051) to rezone the property at approximately 261 South Thud West from Medium Density Residential One (MDR1) and Medium Density Residential Two (HDR2) to High Density Residential One (HDR1) in the City of Rexburg, Madison County, Idaho. The said property is located at 261 South Third West in Rexburg, Madison County, Idaho, and more particularly described as follows: Legal Description: Parcel One: Beginning 12 rods East of the Southwest Corner of Lot 3, Block 7, of the Southend Addition to the City of Rexburg, Madison County, Idaho as per the recorded plat thereof, and running thence North 132 feet; thence West 85 feet ; thence South 132 feet; thence East 85 feet to the point of beginning. Also: Beginning at the Southwest Corner of Lot 3, Block 7, of the Southend Addition to the city of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running thence East 113 feet; thence North 132 feet; thence West 113 feet; thence South 132 feet to the place of beginning. Parcel Two: Commencing at a point 8 rods North of the Southwest Corner of Lot 3, Block 7 of the Southend Addition to the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof; and running thence North 4 rods; thence East 6 rods; thence South 4 rods; thence West 6 rods to the point of beginning. Tract 1: Commencing at a point 12 rods North of the Southwest corner of Lot 3, Block 7, of the Southend Addition to the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running thence East 230 feet; thence North 8 rods; thence West 230 feet; thence South 8 rods to the point of beginning. Tract 2: Commencing at a point 8 rods North and 6 rods East of the Southwest comer of Lot 3, Block 7, of the Southend Addition to the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running thence North 4 rods; thence East 6 rods; thence South 4 rods; thence West 6 rods to the point of beginning. Tract 3: Commencing at the Southeast corner of Lot 3, Block 7, of the Southend Addition to the City of Rexburg, Madison County, Idaho, and running thence West 66 feet; thence North 115 feet; thence West 66 feet; thence North 83 feet; thence East 132 feet; thence South 198 feet to the point of beginning Tract 4: Commencing at a point 132 feet West of the Southeast comer of Lot 3, Block 7, of the Southend Addition to the City of Rexburg, Madison County, Idaho, as per the recorded plat thereof, and running thence North 115 feet; thence East 66 feet; thence South 115 feet; thence West 66 feet to the point of beginning. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
