Ex-OfUcio Re rder Deputy J EY.B1M am�iud Pomll>' co,mnnntry ORDINANCE NO. 1180 AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been requested to annex the same to the City of Rexburg, Idaho, and WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described property is subject to annexation to the City of Rexburg under and pursuant to the provisions of Section 50-222 - Category A, Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho, and WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and "Zoning Commission, and the Planning and Zoning Commission made its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed, and WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the property to be annexed is as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS: The property (#17 00740), located at approximately 4 West Moody Road in Madison County, Idaho, will retain the existing zoning Transitional Agricultural Zone (TAGl) in the Impact Area for the City of Rexburg. This property is hereby annexed to the City of Rexburg and is hereby declared to be a part of the City of Rexburg, Idaho. The property is described as follows on the updated Annexation Map: Legal Description: Beginning at a point that Is N890 38'41 "E 300.00 feet along the Section line and N0001 0'25"W 255.43 feet from the South 1/4 Cotner of Section 7, Township 6 North, Range 40 East of the Boise Meridian; running thence N00010'25"W 1947.58 feet to the Southerly Right -of -Way line of U.S. Highway 20; thence N53055'55"E along said Southerly Right -of -Way 555,72 feet to a tangent curve to the right with a radius of 3154.18 feet, along said curve 92,23 feet through a central angle of 1040'31" and a chord beating of N54044'18"E 92,23 feet; thence S00n14'10"E 2580.16 feet to the South Line of Section 7; rhP.,,-o .,1..,,,. �..:A «tee.,.« 1:«e cflnOxoni�•�m nn nn e__.. .t ____ wmnOn nnnmv, moi. in � -7 certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
