ORDINANCE NO. 1178
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING
MAP OF THE CITY OF REXBURG, IDAHO, AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
WHEREAS, the lands hereinafter described are contiguous and adjacent to the City of Rexburg, Idaho, and have been laid off, subdivided or platted, and/or the City has been requested
to annex the same to the City of Rexburg, Idaho, and
WHEREAS, it appears to the Mayor and City Council of the City of Rexburg, Idaho, that the hereinafter described property is subject to annexation to the City of Rexburg under and pursuant
to the provisions of Section 50-222 - Category A, Idaho Code, and that said lands should be annexed to and become a part of the City of Rexburg, Idaho, and
WHEREAS, the City Council referred the zoning of the affected territory for report and recommendations to the Planning and Zoning Commission, and the Planning and Zoning Commission made
its report and recommendations for zoning classification of the hereinafter described properties proposed to be annexed, and
WHEREAS, the Council has determined that the proper classification under the Zoning Ordinance of the City of Rexburg, Idaho, for the property to be annexed is as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, AS FOLLOWS:
The property (#17 00623), located at approximately 2247 S. 2000 W. adjacent to the west side of Hwy 20, in Madison County, Idaho, will retain the existing zoning (Commercial Business
Center (CBC) Zone in the Impact Area for the City of Rexburg. This property is hereby annexed to the City of Rexburg and is hereby declared to be a part of the City of Rexburg, Idaho.
The property is described as follows on the updated Annexation Map:
Legal Description:
Commencing for reference at an iron rod found with no cap marking the Northwest corner of said Section 1; thence North 89°55’13”East, a distance of 261.44 feet with the North line of
said Section 1 to a point; thence South 00°02’39” West, a distance of 614.96 feet over and across a tract conveyed to Richard F. Smith of record in Instrument Number 350682 to a ½”
iron rod found with a plastic cap marking the Point of Beginning; thence North 89°54’58” East, a distance of 1485.49 feet to an ½” iron rod with a plastic cap marked with “PLS 2104”
in the West right-of-way line of Frontage Road; thence with an arc of a curve to the right having a delta angle 07°56’23”, having a radius of 676.20 feet, an arc length 93.70 feet,
the chord of which bears South 19°30’41” West, a distance of 93.63 feet to a concrete highway right-of-way monument found; thence with an arc of a curve to the right having a delta
angle 01°08’08”, having a radius of 20,022.03 feet, an arc length 396.78 feet, the chord of which bears South 23°58’31” West, a distance of 396.78 feet to an iron red set; thence South
89°46’37” West, a distance of 1039.22 feet to a 5/8” iron rod set with an aluminum cap; thence South 89°53’22’ West, a distance of 254.13 feet to a 5/8” iron rod set with an aluminum
cap in the west line of said Peterson Tract; thence North 00°02’39” East, a distance of 453.17 feet with the West line of said Peterson Tract to the Point of Beginning.
SECTION I: That the above described property hereby annexed to the City of Rexburg be, and the same is hereby classified under the Zoning Ordinance of the City of Rexburg as above set
forth; that the Zoning shall be amended to show this annexation and classification of the above described property so annexed and that said amendment shall be certified to and declared
to be the official Zoning Map of the City of Rexburg by a certificate of the Mayor and Council of the City of Rexburg endorsed thereon.
SECTION II: This ordinance shall be in full force and effect from and after its passage, approval and due publication.

PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR this 3rd day of January, 2018.
