HomeMy WebLinkAboutEASEMENT UNSIGNED - 17-00187 - Approx 801 W 7th S - Juniper Sands Subdivision Phase 1Recording Information Above TEMPORARY RIGHT-OF-WAY EASEMENT THIS EASEMENT IS granted by HIGH COUNTY SECURITIES, LLC, as GRANTORS, to CITY OF REXBURG, IDAHO a municipal corporation of Idaho, GRANTEE, WITNESS TO: WHEREAS, GRANTORS are the owners of certain lands which are being developed as a residential subdivision; and WHEREAS, the public right-of-way traversing the subdivision will dead-end at the westerly boundary until construction; and WHEREAS, the public right-of-way to be named Cornelison Avenue traversing Juniper Sands Subdivision so terminates, leaving insufficient space at the dead-end for emergency vehicles to turn around; and WHEREAS, GRANTEE requires, and GRANTORS are willing to provide, an easement to the adjoining as-yet-unplatted land sufficient for emergency and other vehicles to turn around until the public right-of-way is extended; NOW, THEREFORE, in consideration of the approval of the plat of Juniper Sands Subdivision the GRANTORS hereby grants and conveys to the GRANTEE a temporary easement upon a portion of land as depicted in Legal Description below and incorporated herein, for use as a temporary "temporary turnaround easement" or "cul-de-sac" extension of the public right-of-way of Cornelison Avenue. An Easement for a Temporary Turnaround Part of the NEI/4NE1/4 of Section 36. T6N, R39E, Madison County, Idaho described as: Commencing at the Northeast corner of said Section 36; Thence S 89°46'28" W 1875.20 feet along the section line; Thence S 00°00'00" E 510.36 feet to a point on the Easterly right of way of Cornelison Avenue and the Point of Beginning; Thence along 303.79 feet along a curve to the right, Curve Data (R = 62.00 feet D = 280044'40") chord Bears N 71'35'32" E 79.09 feet to the End of the Traverse. Juniper Sands page I of 2 h1e#16-682 All rights, title and privilege herein granted shall be extinguished upon the recording of a plat of the adjoining lands which provides for the extension and dedication of the public right-of-way adjoining the current northeasterly terminus of the said public right-of-way.
