This letter verifies that the Lee Workman home located at 450 S. 4'h E. was originally permitted
to be constructed as a duplex.
The R-1 Zone in force at the time of construction allowed Duplexes to be legally constructed.
This home was not a conversion, but was originally constructed as such. Mr. Workman has
certified to the City that the Apartment has not been vacant for a period of more than one year
since the ordinance was changed therefore his grandfather right is preserved.
In the event that the current use is vacated for more than one year the apartments grandfathered
right will expire. This letter does not authorize expansion, change of use, or non-compliance
with health and safety issues that need to be addressed. Health and safety code
concems/violations are not included in grandfather rights. Violations of such must be
immediately addressed with the City Building Department.
Attached is documentation from the City Code that existed at the time as well as the original plat
maps of the subdivision. The City will keep this letter on file and attach it to the parcel data
pertaining to the parcel. Also attached is the City Policy on Grandfather Rights. Duplexes are
not currently allowed in the LDR Zone in which this home is located and any recent conversions
of homes for apartments would be illegal. This home is a true example of a grandfather right.
