This letter is in response to the request of Robert Lamoreaux for clarification
regarding development requirements, and allowances of the City of Rexburg
concerning the property located at 990 W. 7"' S. Rexburg, Idaho 83440, also referred
to as "The Meadows".
The zoning on the subject property is currently MDR1 which allows for the
construction of up to 16 units per gross acre. The property is subject to the
development requirements of City Ordinance #926, the City of Rexburg Development
Code and the City of Rexburg Subdivision Ordinance. There are no other known
zoning restrictions on the subject property.
The property has two accesses onto 7th South Street and it is my understanding that
these accesses meet the requirements of the fire district for proper access to the
property.
In order to accommodate the desires of the city planning office to create connectivity
to the adjoining neighborhoods, the developer of 990 W. 7th S. is willing to connect to
the Steiner property, which borders the north end of 990 W. 7`h S., upon the
development of the Steiner property, and is also willing to record the attached
agreement.
This action adequately addresses the desires of the City pertaining to connectivity and
access. Development is required to be in compliance with whatever code and
ordinances are in force at the time of actual development.

Neither property owner/agent accepts any liability from any party other than themselves.
This agreement is for the sole intent of creating connectivity in the neighborhood as per
the request of Rexburg City.
The decision concerning the exact location of this road may be determined by the party
which develops the property at 417 S. 120'W. and will be established when said property
is platted for development.

In consideration of the request by Rexburg City planning and zoning that the Meadows
Townhome development create a northern access to and from the property we have done
and/or propose the following.
1. For the purpose of connectivity with future developments to the north we have met
with the owner of the property to the north about signing an agreement allowing a
connection to be made to those roads when any development proceeds on that property.
We understand that this would likely be a requirement of the city in that situation any
way but simply want to approach the issue by way of agreement rather than coercion.
2. We have spoken with the emergency services about the safety of our current setup and
plans and have been told that it meets their criteria for safety, however, if safety is
considered to be an issue; We have spoken with the developer of the land bordering the
west side of our property. He is open to the idea of selling us one lot to be used as a
temporary emergency access as long as the primary traffic is routed through the two main
entrances at the south end of the property. This temporary access would be closed once
we connected to the road in the northern property. We propose, if necessary, to do such a
temporary access by means of a crash gate with proper signage. As the current setup
seems to meet the criteria for safety this is probably of a much lower concern. I added
this anyway so that you could know of our good faith efforts.
3. The roads in the meadows are privately owned and maintained and have been built for
the intended purpose of servicing the homes in the Meadows development. Some of the
details of our roads are different than those required for city roads. However, because we
understand the need for connectivity between neighborhoods we are willing to dedicate
Countryside Avenue to the city upon its completion. It would obviously require a
variance. If the non -conforming nature of the road prevents that from happening we are
willing to look at some sort of agreement or egress that allows use of the road by the
public. I assume there is some way to accomplish this that will protect the interest and
defer the liability of the homeowners and their association.
What I need is some sort of signed note that says which of these measures will meet the
desires of the city for our northern access so that we may proceed with our development.
