This office represent Greenbrier Associates, Lmt. As you are well aware, our clients
own the sidewalk and fence just to the north of your apartments. We have noticed that
you have recently been excavating holes on your property. Unfortunately, these holes
encroach upon our property and extend all the way to the sidewalk. You have left
debris on the sidewalk and we also notice that you have removed two survey pins on the
west end of the property line. I observed these pins laying in one of the holes which you
have caused to be excavated. This is a violation of Idaho Code, Section 54-1234 and 18-
7016.
We make formal demand that you fill in the holes such that it no longer encroaches on
Greenbrier property. You are also required to clean up any dirt and debris that you
have caused to be placed on Greenbrier property. We also further demand that you re-
survey the property line and cause the pins to be restored to their original location. We
will require a letter in writing from a certified surveyor indicating that this has been
accomplished. Please be advised that any damage to the fence and sidewalk resulting
from these holes which have encroached on Greenbrier property will be your
responsibility.

Unless we are able to resolve the problem through the City, �e

Mr. Clark is in the process of building an addition on to oIe
of the Cottage Apartments. My client notes that the existing
structure is in violation of City Zoning Ordinances and
therefore is a nonconforming use. He notes that Mr. Clark's
building is in violation of zoning requirements which provide
for a minimum side yard depth of five feet. Mr. Clark's
building is in violation of zoning ordinances in that
substantially less than five yards exist from the eave line to
the property'line in question. This causes significant concern
to my client in that in the past years water running off these
eaves have collected along my client's sidewalk where it
freezes creating hazardous conditions to students going to and
from school. Additional construction along this building will
only exacerbate the problem. Furthermore, if your building
inspector would examine the construction of the building, he
will certainly note that the building does not meet existing
code requirements.
Therefore the existing building, being a nonconforming
structure, Mr. Clark should not be allowed to increased in area
or volume so as to make additional utilization of this
nonconforming use.
Mr. Farmer informs me that he has been in contact with you
regarding the building practices and we feel that the City has
an affirmative duty to assure that the building practices used

conform to standard. I doubt very seriously if constructing
footings above ground and upon fill dirt meets those
requirements. A careful inspection of the existing building
will show the problems that accompany substandard construction
practices and the extent to which the premises is dangerous and
unsafe.
We request your immediate attention to this problem. We also
request that the City, upon review, immediately revoke ,Mr.
Clark's building permit and declare his building to be a
nonconforming use. If no action is taken on the part of the
City, my client will be compelled to bring an immediate action
to restrain Mr. Clark's construction and compel the City to
take action necessary for the safety of its residents
consistent with ordinances, codes and regulations. Please fee'

RE: APPROVAL OF MINUTES
A motion was made by Dan Hess and seconded by Mary Ann Nounts to
approve the minutes of the provious meeting. All Aye.
RE: MOTION PASSED FOR A VARIANCE FOR THE KNIGHTON'S SHED.
Sandra and Richard Knighton was at the meeting to request a variance
for a shed to be four feet from the property line instead of five
feet. Their property is at 975 Westwood. They did not understand the
regulations when they got their building permit and started to build
before the inspector checked it. They presented a letter from the
neighbor next to the shed, who was not opposed. The shed was 8 X 16
feet. They had built the shed on railroad ties and have it bolted
down. John Millar said he did not think that the board was against a
variance, but they would have to go through the process. A motion was
made by Scott Mortensen and seconded by Mary Ann Mounts to recommend to
the City Council that a variance be given to the Knightons. All Aye.
Mayor Boyle was at the meeting and said he would do a telephone pole of
the council members and then if it was okayed, they would advertise and
hold a public hearing on July 18.
RE: REQUEST FOR A ZONE CHANGE ON THE SOUTH SIDE OF BLOCK 37
Joe Romney was at the meeting to request a zone change on the South
side of block 37 that the zone be changed from C-2 to R-3. He
presented a petition that he had taken around. There is a problem
trying to finance the home as it is zoned commercial. Re Nee Mc Gee
stated that as she surveyed the area, she felt that it was
residential. Mary Ann Mounts said we have too much commercial
property. Re Nee said we need to zone for demand and land use. This
area is such and could be changed to residential. It is poor planning
to consider changing the zone and schedule an informational hearing on
July 25 at 8:00 P.M. All Aye.
RE: COTTAGE APARTMENTS
Next item on the agenda is the Cottage Apartments.
Steve Clark stated that he had gotten an application to build a
retaining wall but was told by the Judge that Mr Farmer wanted to stop
the retaining wall, so he had stopped until he found out different.
Mike Kam, Attorney for Greenbrier and David S Messenger, Engineer for
Greenbrier was at the meeting. Greenbrier had filed a restraining
order before the wall was put in because they wanted to do something to
correct it.
Mr Messinger and also Mr Kam presented facts. They presented facts
from the building code and zoning ordinance against the construction.
Kam said it is disturbing. to see the construction going on and then
having to go back and correct it.
Kam stated that construction had been going on since 189 with no
permits or plans until recently, no record of inspection now the
structure is up and the footings are poured and we look for a way to
accomodate him rather than to find out what does the code say. So now
we are going to create some magic and put a wall around it, fill it
full of dirt and say the first floor is gone we have a two story
structure. The City has gotten in a fix because they have let it go
and now we are trying to figure out how to put it together to fix it.
John Millar stated that the City feels that they have been on top of
it.
Glen Pond stated as he sees it if Clark builds a retaining wall he can
bring the grade up so it can classify as a basement. So what we have
to decide is whether that retaining wall is going to allow him to meet
that requirement to make that a two story building instead of a three
story building.
Kam stated the way he sees it is: Can he build a retaining wall within
the five foot side yard? They way he interprets it is it says no.
Does our zoning laws allow the building of an encroachment in the side
yard? It is his understanding that the side yard is designed for
safety. Discussion on what the UBC addresses as the grade and the
interpretation. Is this wall within the five foot side yard? Kam
expressed the frustration the Farmers have felt and perhaps some of the
adjoining property owners. If you look on the north side most of the
sidewalk is below the footings. Mr Clark denied it. Kam told the
group to get qualified people out there and do your inspections and do
the things that need to be done. Do it right.
Steve Clark- In that area because of lava, many of the homes there have
a steep front yard and side yards because of the need to have a
basement. He said he could either bring the dirt up with the retaining
wall in the back or in the front yard to qualify for a two story
building. He discussed the stories of the buildings and the UBC. We
have had the building inspector each time we have done anything. The
alligations that there are no inspections are wrong.
Mary Ann Mounts stated that for the record she was against this
construction. If it is three story it is three story and does not
comply. She did not want to go on record as part of a recommendation
that you could raise the grade. She had gone up there today and it
does not look good.
Chris Mix agreed with what Mary Ann said, she did not want to go on the
record as saying he could throw dirt on it to make it a two story
building.
Mary Ann said she was not in on it when it was started. She felt like
it was a mess.
Chris told Mr Clark he was talking about his grade and his piece of
property and your specific problem, but as a board we need to look at
the City. If you throw dirt on it to change the grade, we are not
doing anything for the neighborhood and the City. She did not agree
with his throwing dirt to meet the zoning.
Mayor Boyle said the question is going to be does she meet the zoning
laws?
Clark argued that he could put dirt in his front yard and qualify.
Glen Pond said he was not sure that by throwing the dirt up you could
raise the grade. If you go ahead and construct it and get it finished
and we either fight it our in court or we make the determination from
the inspector that it does not qualify by bringing dirt to bring up the
grade then you won't get a certificate of occupancy. You won't be able
to rent those units out and nobody will be able to live in those top
units. I would think it would be prudent that you do something to
protect yourself or not build them. He said he was not sure that by
throwing the dirt up that you can raise the grade.
Steve Clark again argued that he was correct with the UBC.
Chris Mix told him there is a difference between man-made grade and
natural grade.
Mr Messinger- He had two points concerning the construction. (1) Mr
Clark states that everything he is doing is under Glen Bean's nose,
however in the report of Mr Meyer's inspection there were 17 violations
in the framing. It has been stated that all of those violations have
been corrected. He did not think they had been corrected. (2) Most
of the work done there and that was done in 185 and 186 were non-
complying with the building code. There were no plan inspections, plan
fees payed, no documentation, document reports or plans with approval
on them.
John Millar told him we do not have a plan approval process.
Messinger stated the plans that were drawn by a non -architect don't
even comply with the UBC . They don't represent the work that is being
done. There is a lot of scabbing and band -aiding over to cover up the
fact that it is a three story structure. Mr Messinger said he had no
fear of how a court of law would deem this attempt to through dirt up
around this structure to make a two story building out of it. From
what he has seen it doesn't meet the fire regulations for UHC. Steve
Clark argued against this.
John Millar- to sum this up he did not think we could do anything
tonight. He asked J. D. Hancock if the board needed to act on it.
J. D. Hancock said the question on the retaining wall is if it meets
city code.
Chuck Frost told Steve Clark that the thing that everyone is concerned
about is the construction that you are doing is so close to the letter
of the law that everyone is concerned whether it will be finished well
within the letter of the law. He told him he would be well advised to
be sure everything he does is more than the letter of the law because
the Planning & Zoning and building inspector can't be there on Clark's
job all day, every day. He advised him in the strongest way he could
that to be sure that whatever he builds he goes more than the minimum
requirements of the law. There has been enough things happen on the
project that have been so close to the letter of the law that your
neighbors are concerned and the city is concerned and we don't want to
have you in litigation with the city and with your neighbors. He
advised him to be well over on the safe side.
Mayor Boyle asked for an opinion from the group, who in this area is
qualified to make a decision of a two or three story building, we need
to have someone qualified. A discussion followed.
Messinger stated that we need a complete set of plans showing the grade
that is intended.
John Millar stated that in past meetings we had made the interpretation
that if 50% was buried it would be a two story building. We did not
make a determination if it had to be artificial or natural.
Kam stated that the process and what we are going through tonight only
emphasizes the kind of problem we are talking about. construction went
on and someone had to come back and fix it. He suggested make a two
story building a two story building and make it comply. Do what we
know is right in the UBC & Planning Code, and compliance.
John Millar stated that retaining walls had been built all over town.
They had built one at their firm as well. As far as the UBC the
retaining wall is in compliance and would be allowed.
Mr Farmer stated that they had discussed the drainage problem. In the
winter it drains on the sidewalk and freezes. He had talked to Mr
Clark and asked him to hire an engineer to work out the drainage behind
the building and he refused to do it. He did make an attempt to do it
himself but was never completed. He asked him to put up rain gutters.
He attempted to do it and they fell off. There is one thing after
another that concerns them about their safety and property value.
John Millar told Mr Clark that the drainage problem will have to be
addressed. You cannot put drainage onto someone else's property.
Positive measures will have to be taken to take care of it.
After a loud disrespectful discussion by Kam and Messinger, Scott
Mortensen told them that they needed to have more respect and asked for
it.
Mayor Boyle stated that we would have J.D. Hancock get an opinion on
the UBC. If there is any difference the council will move on it.
RE: RICKS PALMER ADDITION
A final plat on the Ricks Palmer Addition was presented by John
Millar. Because of the conflict of interest, he asked Chuck Frost to
take over the chair. The board reviewed and discussed the plat. A
motion was made by Chris Mix and seconded by Scott Mortensen to approve
the final plat as drawn and that Gary and Nina be paved with curb,
gutter and sidewalk and that any future development follow the
preliminary plat. All Aye.
RE: ALBERTSON'S ADDITION
Plans for Alberson's addition was presented. John Millar stated that
it is within the zoning requirements. There is an utility easement
through there that will have to be abandoned and the water and sewer
lines will have to be relocated at their expense.
More discussion on the Clark Apartments.
The board Recommended that from now on any unit from a duplex on would
have to have an architect draw the plans.
Chuck Frost asked that we have the Idaho Falls inspector do inspections
and that we get expert people in to check it.
RE: PROGRESS OF THE ZONING ORDINANCE
Ra Nee Mc Gee reported on the progress of the zoning ordinance. she
presented a map that she had color coated with recommendations. She
had been trying to locate and indicate the actual land uses. It was
discussed when to hold the neighborhood meetings. A probable month
would be September.

RE: HIGH COUNTRY POTATO IS MOVING
High Country Potatoes are moving their plant out by Spuds. It will not
be in the city limits, but it is in the impact area. They need to
present the plans to the Planning & Zoning. Glen Pond suggested that
we need to look into annexing it into the city if we extend the water
and sewer lines out to them.
RE: IDAHO FALL'S ORDINANCE
John Millar said we talked about the Zoning Ordinance and we have a
proposal from Re Nee Mc Gee. we also have a copy of the Zoning
Ordinance from Idaho Falls. The Mayor's feeling is to retain Re Nee Mc
Gee on an hourly basis and take Idaho Fall's Ordinance and cut it down
to fit Rexburg. A motion was made by Mary Ann Mounts to retain Re Nee
Mc Gee on this basis and have her meet the Planning & Zoning on a
regular basis. Seconded by Mike Larson all aye.
RE: ABSENCES BY THE MEMBERS OF THE BOARD
John Millar told the Planning & Zoning Board that the mayor had made a
recommendation that this board be compensated for their time. He is
hoping that this would spur a little better attendance. The board
suggested that rather they are compensated or not, if there was three
unexcused absences in a six months time by members of the board they
should be released. A motion was made by Chris Mix that the attendance
be monitored and those who do not attend and are not excused will be
released from the board for three unexcused absences during a six month
time. Seconded by Mary Ann Mounts. All Aye.
RE: STEVE CLARK APARTMENTS
The committee discussed the Steve Clark apartments. Glen Bean said
there had been no progress since last fall. Glen had talked to him,
but he doesn't seem to do anything. The city had received a letter
from a attorney representing Greenbrier Apartments, saying they were
going to take action if this is not taken care of. Mike Larson said
rye last fall we were going to withhold his permit and not let students
0 live in those apartments. Glen Pond said that was the parking and
(h banisters and he met those requirements. Glen Bean said he doesn't even
have enough parking for the existing students. John Millar said he
could not occupy the new buildings until he finishes the upper parking
lot. Greenbrier said he does not have enough room. Glen Pond said the
understanding was the first story was suppose to be underground and it
isn't. Glen Bean said according the building code that 80% of his
first floor has to be underground and it isn't. The members stated
that a Stop Order should be put on the buildings until the requirements
are met of the uniform building code and require him to get competent
contractors in to work on it.
^^Q Chuck Frost made a recommendation that he will be writing a letter
Y' telling him we would hire a constructional engineer to come in and look
a the footings and at the Uniform building Code. It would cost $200
or $300 to get a constructional engineer. They also told Mr Bean that
all problems and instructions to him from now on be made in writing.
Chuck Frost made a motion to hire a constructional engineer to evaluate
the construction of the building and put a stop order on the building
until we get that recommendation. Seconded by Chris Mix. All Aye
RE: HOUSE ON 128 WEBSTER
Glen Bean told the members that there is a house on 128 Webster Avenue
owned by James Change, which was partly destroyed by fire about a year
ago and nothing has been done to repair it or tear it down. We have
received a complaint that it is a nuisance. John Millar state that if
it is 50% destroyed it has to be torn down or the city can declare it a
nuisance and tear it down and bill him. The members recommended that
he be sent a legal notice by the City Attorney and just give him a
period of time to do this.
RE: BOWEN & HALL IMPROVEMENTS
We received a letter from Bowen & Hall sending a letter of Insurance,
they are moving ahead with their improvements.
RE: NEW FLOOD PLANE MAP
John Millar handed out the new Flood Plane Map. This was discussed.
They felt there was no rhyme or reason to the map. John Millar would
write them a letter outlining the areas that should not be in the flood
zone.
RE: MEETING ADJOURNED
A motion was made by Chuck Frost and seconded By Chris Mix to adjourn.

RE: STEVE CLARK CONSTRUCTION
The Planning. Commission discussed the Steve Clark construction. They
are concerned that the construction is not up to standard. Mike Larson
said if it is build to code it should be safe and if not we need to
a advise him it will have to be brought up to standard. Chuck Frost said
if it is obvious that it is a hazard we can condemn it. Chuck said the
city attorney needs to write a letter to Mr Clark and go on record that
the construction is substandard and if it is not brought up to standard
we will put a stop order on it. Glen Bean said he would bring a list
into Rose of the things that are substandard.
RE: HOUSE FOR FIRE TRUCK
The Planning and Zoning discussed the building that has been built on
the Tabernacle property to house the fire truck. They are oppose to
the building being built at that location. Jim Long recommended that
it be brought up for discussion as to how the building was approved
without going before the Planning & Zoning seconded by Chuck Frost.

RE: DISCUSSED TO MOVE THE FIRE TRUCK HOUSING
The Planning & Zoning was unanimous that is is an eye sore and
discussed if it could be moved. They are also concerned about Planning
& Zoning procedures and why somethings are not brought before the
commission. They stated that they felt we need to set priorities.
Does the the Tabernacle have priority over the housing of the Fire
Truck or does the Fire Truck housing have priority over the Tabernacle.

The factor in this decision is that he does have the property to
provide the parking and if it does not work he will then tear out the
landscaping for parking places.
Glen Bean gave a report on the Trailer Court.

Glen gave a report on the Steve Clark apartments. He said he would
like to wash his hands of those apartments, because Mr.
Clark does not
keep his word on what he is going to do. The city attorney
wrote a
letter telling him he had to be in compliance by August
15. He talked
to Glen and said he had students in there until August
19 and then he
would make the changes on the steps and parking and the
fire lane.
Glen went over there on the 19th, again on the 21st and
22nd and still
nothing had been done. Mr. Clark was not there but his
son was. His
son told Glen they did not intend to do anything until
they did more
building. The Planning & Zoning ask John Millar to talk
to the
college, to the Mayor and the City Attorney to see what
can be done and
instructed Glen Bean not to issue an occupancy permit.
Behind the
apartment house it is a fire trap there is rubbish and
garbage stacked
up. Something should be done about that.

the condition of the trailers and the type of people that would be
renting the trailers. Mrs. Hancock asked the neighbors to give them a
chance to work with the trailer court, she pointed out they are in
construction at this time.
Chuck Frost told them we would have to bring this issue to a
conclusion. As Planning S Zoning all we can do is require that the
conditions of the ordinance be met. He advised the Gneitings to do
everything they could to do exactly and beyond the requirements of the
ordinance, so the neighbors know that you are more than in good faith
trying to go beyond the requirements of the law. The neighbors need to
give the Gneitings a chance to complete the project according to the
approved plan. Before a license to operate would be issued by the
city, the city would require that ordinance and codes be followed
completely.
Chuck Porter asked if there was a procedure that rental property meet
all the codes before they can be rented? The city clerk told him it
would fall under the inspection ordinance.
Chuck Porter stated that we need some strict inspection procedures for
trailer courts.
RE: PARKING HARMONY HOUSE
Parking on Harmony House. Chuck Frost read a letter which the city
clerk had written to Mr. Flukinger about the parking and also the
letter he had written back with a copy of the new parking proposal.
(copy attached and on file) He needs a total of 86 parking places. He
proposes to remove the green area. Glen Bean said he does not have a
dimension of the parking. The planning board asked the clerk to have
John Millar check the plan out to make sure he has enough parking. He
will have to meet the parking regulations before he can occupy it with
students.
RE: LANDSCAPE 6 TREE ORDINANCE
Jim Long asked the clerk to get some copies of Landscape and Tree
ordinances, so an ordinance for Rexburg can be drawn up.
RE: CLARK OCCUPANCY CERTIFICATE

After Mr Brown and Mr Miller had left, Glen Pond stated that a zone
change would not do any good without a variance.
The board discussed the parking at Harmony House. Wondering how it was
approved without the parking. Glen said the council was told there was
enough parking. Dan said it has enough parking but no fire lane. Nile
Larson understood that they was going to buy the Montayo property for
parking. John Millar stated that they can still use the landscaping
for parking.
The board discussed the Steve Clark apartments. A motion was made by
Chuck Porter and seconded by Mike Larson that the City Council demand
that Steve Clark finish his parking lot and change the entire parking
layout to be in compliance and make the necessary changes on the
apartments that he agreed to make. All Aye

A motion was made by Barry Genta and seconded by Mike Larson to approve

Terry Bagley was at the meeting. Mr Bagley is in the process of
designing a new house on Yale Ave. He has a deep lot, 150 feet deep,
it is my understanding that a minimum set back is 30 feet. Apparently
there is no maximum set back. We would like to move the house back
further so we can do some landscaping. John Millar told him there was
no restriction on a maximum set back so there would be no problem.
They told him he would only have to watch his back yard and not get
back too far and watch the side yards.
Glen Bean, Building Inspector, discussed the Clark apartments. He said
he had submitted a plan from a Landscape Architect, but John Millar
told him he would have to make some modifications. They need to tear
out the existing steps and replace them with fireproof steps. On the
new apartments they will have to have fireproof steps. Rex Larson said
he would not approve it until the parking was done so a fire truck
could get in and out. The set backs are okay. Rex Larson said he
would like the city to make sure a fire truck could get in and out
before we let him proceed with the apartments. Mike Larson ask what
happened, with the question of the four plex. John Millar said he had
already built a 8 plex before and he did not know how he was allowed to
do that. He is planning on joining on to them with 5 buildings and
make it continuous building. Glen said Mary Smith was suppose to give
us an opiniuon that that but we still don't have it. John Millar said
he would get with Steve Clark and get the corrections made.
Lane Ward was at the meeting. He has a cinder block fence around the
back of his house, it starts at the south west corner of the house and
it goes back from there 36 feet and then it takes a 5 foot jog to the
east and then it continues on back another 100 feet. In that corner
where the jog is, I would like to put a shed to store wood, and lawn
furniture. My plan is to use the cinder block fence as a wall and then
have the rest of it built out of cinder block and have a metal roof but
have it all contained with my side of the cinder block fence so nothing

code. Chuck Frost said according to Tom Matthews they have checked with
the State Electrical Board and they have allowed those units to be
considered as a group of triplexes joined together vertically with fire
walls in between so they could be built according to the easier code.
The last two or three there was a ruling they had obtained from Boise
that would allow that. So if a fire starts in any of those student
housing complex, the fire walls are vertical through all three floors,
and would only burn out three units and would allow them to build them
according to the other code. You would never be able to build a motel
that way. Jim Long ask where that would put the city as far far as
liability is concerned. Chuck Frost said he did not know if it was a
written ruling or how they got it. According to the information that
Tom had it does meet the Electrical Code for Triplexes. The Planning
Board said they would like to have that is writing to protect the
city.
A Glen Bean presented a set of Plot Plans for the Steve Clark
Apartments. The committee discussed them. Chuck Porter said it still
goes back to his original question, it is not right for the zoning, it
L1' might be right for the code. The zoning is R2 and it won't allow
D anymore than a triplex, it won't allow these multiple units. The
zoning works that you have to have so much room between the buildings.
It might be alright for the code but it is not right for the zoning.
It would be nice to have the ruling that Tom Matthews has in writing so
we could refer to it. Chuck Frost said we still do not have the sight
plan or the grading plan. John Millar said we might have to get an
opinion from the city attorney because it isn't clear enough on the R2
Zoning. Chuck Porter made a motion that we table this until we have the
documents that we ask for the siW plan and the grading plan. Chuck
Frost said if he desires to build this type of construction he needs to
come back with a zone change. John Millar said when he went out of
here after the last meeting thinking that he did not have to build 4
plexes. Chuck Porter said we pointed that out to him last time. John
Millar said we really need clarification from the city attorney on
multi -family dwellings. J D Hancock was at the meeting was ask if he
could clarify it for the group. J D Hancock said as he understood it
you could not build more than a 4 plex in a R2 Zone. Chuck Frost told
A \ them that on page 3 it defines Apartment Units "Apartment units are
dwelling units when more than four (4) are combined under one (1) roof,
and apartment units are not allowed in R2. The interpretation over the
years has been any more than four are not allowed in R2. Chuck Frost
said he thought he just needed to go back and submit a plan that meets
the requirements of the R2 zone. The committee suggested that the city
attorney write him a letter. He needs to have a plot plan anyway
showing the parking and circulation. Chuck Porter said he would enter
his original motion to table it because of lack of documents. Seconded
by Chuck Frost. All Aye The city clerk was ask to have the city
attorney to send him a letter.
Linda Eames and Tom Price were at the meeting to request a variance for
a beauty shop and a craft shop at 150 North 5th West. Jeanine Johnson,
who is a 58 year old widow wants to buy the house from Prices and put a
beauty shop and a craft shop in it. It would be a one station shop.
Chuck Porter said the concern about a craft shop would be if she would
want to put signs up. They had circulated a petition to everyone
within 300 feet. The city clerk told them it would have to be done
again by city employees. John Millar told him a variance cannot
transferred. Linda Eames said she would get something in writing so
the variance could be given in her name. She would have to state what
she would use the variance for, so it could not be changed. The city
clerk told them there would be charges to get a variance for the
publishing and time spent by the office employees, and ask who would
that amount. John Millar said one thing we need to keep in mind is the
precedence we might be setting to establish a business for the
convenience of a sale. Glen Pond said a variance should only be
granted because of a hardship. Mr Price said the home has been on the
market four years. Because of the apartments on one side and across
the street it has made it hard to sell. Chuck Porter said he did not
see any harm in giving a variance for that type of a business in that
area, hardship would be the tradability of that property. Chuck Porter
made a motion that a variance be granted provided state licensing laws
be met, and there be no lighted signs and a sign 4 foot square be
allowed to be put on the building, and it be a one station beauty shop,
and the craft shop not exceed 10' x 101, with sole proprietor and this
be granted to Jeanie Johnson. Seconded by Jim Long, All Aye
Wes Lawrence was at the meeting to request a zone change to Commercial
from R3 at the old Kingdom Hall. He had sold the property thinking it
was commercial. In viewing the area, it is hard to see why it has not
been zoned commercial. It is surrounded by businesses. Since selling
the property to some people to operate a business, I find it is
residential. The overall master plan calls for that to be changed
commercial. Glen Pond told the members that last week when we tried
make the change for the Gneitings all the the neighbors from across the
street were opposed. Wes Lawrence told them that this is 300 down the
street away from them. Mr Lawrence said he was proposing to re -zone
He planned to connect the tri-plexs and will be separated with double
walls of sheet rock. This will make it essentially one building. He showed
a plan he had drawn himself. The parking was discussed. John Millar stated that
looking at the parking area at the existing apartments there seems to be a great
deal of grade �o it. The new drawing showed a lot of grade. He ask if all
the parking indicated could be used. Mr Clark said they would move the soil
around to excavate it. Jim Long told him it looks great on paper when you
start plotting places out but when you look at the circulation and how people
are actually going to utilize it sometimes it is different. How successful
have you been in your parking lot that you have. He was told that a 20 foot
alley was not big enough and that S' stalls was not big enough, 9' stalls is
minimum. Chuck Porter ask what the zoning was in that area and if he could
leagally build the tri-plexs and connect them. Chuck Frost told him he
should get a Landscape Archetect or an engineer to draw up the plans for
the complex and parking, using the current standards for driveways and parking
lot widths. Jim Long said he would recommend that Mr Clark not be issued
a building permit until he gets a layout signed by a Landscape Archetect or
and engineer. The committee discussed the motion. Gordon Tychsen for the
Fire Department was at the meeting and dicussed the room that a fire truck
would need to get through. Jim Long said he would like to amend his motion
to include a grading plan. Chuck Frost said he was concerned about the run
off from the property. In checking the zoning which is R2 a 5 plex is as
big as can be built. He was told that if he joined the apartments they would
have to be built according to the commercial code. He stated that Gary Ricks
had not been made to build his new unit according to the commercial code.
The Planning Board thought it should be checked on and ask the city clerk to
check on it.
`Jim Long restated his motion, that we do not consider for approval this
plan of Steve Clark's without a Licensed Engineer or a Licensed Landscaped
Archetect's master plan, which will include grading and drainage and layout
for the traffic circulation. Seconded by Chuck Frost All Aye.
Chuck Porter stated that he was concerned that Mr. Clark wanted to join the
units together. It doesn't meet the zoning.
The city clerk was ask to check on the history of Cameo and why they were
allowed to be built in that zone.
Mr. Clark was told that the Planning S Zoning would hold a special meeting
on July 20 before the City Council meets to review the plans.
Jim Long stated that he thinks a lot of mistakes have been made in Rexburg,
and as long as I have been asked to serve on the Planning Board and the fact
that I am a Landscape Archetect and a Planner, it is my objective to see it
is done right. We need to to stop doing things wrong and start doing things
right.

John Millar introduced Glen Bean, New Building Inspector, to the
Planning & Zoing.
John Millar reviewd the minutes from April 28 and May 12.
A motion was made by Chuck Frost and Seconded by Chuck Porter to approve
the minutes of April 28. All Aye. A Motion was made by Mike Larsen and
and seconded by Jim Long to approve the minutes of May 12, All Aye.
Larry Beesley was at the meeing to get prmission to add onto an existing
garage on his mothers property at 80 North 5th West. The existing garage
is 2 feet from the property line. He showed them a sketch. He wanted to
add on another 16 feet to the existing garage for a storage shed.
This would be the back of the lot. Chuck Frost said you can go right to
the back of the prperty line if the building is detatched. If the building
is to the property line it will have to be fireproof, 5" sheet rock, cinder
block, or metal. If it is built fireproof to the line it would meet with
the code and no action would be required.
Gaylen Gneiting was at the meeting to request a zoning change at 309 South
5th West from R3 to Commercial. The property is situated south of the Barrick
Candy Company. The proposed zoning map shows that the intent is to change
it to Commercial. (copy of request for zone change is attached) The committee
discussed teh South half of Third South Street between Fourth and Fifth West
located immediately to the North of Lot 2. Mr. Gneiting stated that street
had been abandoned. The city clerk was ask to check to see if that street
had been abandoned. Chuck Porter ask him what he proposed to put in there.
He said he would like to build some apartments at a later date.
The commettee stated that it would fit with the master plan. Jim Long
proposed that they recommend to the city council to change the zone in the
area of 309 South 5th West from R3 to Commercial. Seconded by Chuck Frost.

Steve Clark was at the meeting with a request, "It is our proposal to construct
4 tri-pleexs to the placed beginning at the west end of the existing noth building of
our complex and moving on west to the newly constructed fence. Thus number of
parking spaces needed will be 70. This total was arrived at by figuring 12
spaces for the first 24 girls and an additional 58 parking spaces for the next
174 girls.
We met June 29, 1988 at 10:00 A. M. with the city fire marshall, the city building
inspector, a reqpresentative from the off -Campus Housing Dept. of Ricks College,
and the V.P. of the Rexburg Off -Campus Student Housing Association. All examined
our plans and accepted our proposal."
The committee discussed having our inspector go out with the college inspector
to inspect off campus housing. Jeff Teeples had met with Don Packer concering
this inspection. The city thought they could charge a fee of $25 for the unit
and $1 per apartment for the inspection. Mike Larson stated that we would have
to be careful on inspecting only college housing. It should be a standard
inspection for everyone. Mike ask what the purpose for the inspection.
Glen said Ricks College ask for the inspection. Jim Long said the inspection
needs to be standard for everyone, you can't just segregate it. If Ricks
makes a request for the inspection and pays the fee, the other apartment owners
could make the same request and pay the fee. Jim Long ask what the purpose of
the inspection is if the only time you inspect it is when the guy requests it.
Jim Long ask how this could be an optional thing if it is a building and safety
ordinance. Chuck Porter said for Ricks College it is not optional but for
the city it is optional. Jim ask about the city liabiality if our inspector
certifys that the building is safe. Jeff Teeples said he would be looking for
(1) smoke alarms, (2) required exits, (3) make sure they are conforming to
the square foot of occupancy.
Jim Long ask if they wasn't talking about a bunch of stuff that has nothing to
do with planning and zoning? We support him, but this is not why we are here
at this meeting.
Mike Larson said we can only make a recommendation that we enforce existing laws
of the Uniform Building Code. Seconded by Chuck Porter. All Aye
Chuck Porter ask him if he was a health and safety inspector or a building
inspector. Do you have a right to go around existing buildings and inspect
without a building permit issued. Chuck Porter said he would like a legal
opinion on it. I would like the city attorney to look into it. I am not
in favor of the building inspector doing random inspection from time to time
for fire and code violations.
John Millar ask if the city wanted the liability they would have for just
collecting $50 for an inspection and then someone would get hurt the next
day, or a fire the next day or month.
Chuck Porter ask about the Clark & Hawks apartment development• They were in
L, to the meeting in the fall of 1986 and were suppose to have their front yard
n cleaned off before the snow fell. They ask if the Planning & Zoning would
fV recommend to the city council that they be given until spring they would take
care of it. They still have not taken care of it. I would make a motion to
the city council that it should be looked into and someone write them a letter
stating that they have to comply. Seconded by Chris Mix. All Aye.

A quorum was not present so the minutes of the past two meetings could not be read
and approved.
Steve Clark was at the meeting to discuss the problems at his apartments at South 1st
East.
Chuck Frost listed some of the issues that were a problem.
Parking was an issue.
i Concerns from Fire Department on being able to get back into the property.
Students parking on the streets.
General clean up of the property.
Garbage clean up.
Completion of the job.
uck Porter ask him about the school bus that is parked up there. Steve Clark
said they had some building materials that they had left over from this project
that we planned to use on final project, and we brought the bus to load all
of those things in the bus and then it will go out to his house.
Chuck Porter questioned him if he had done everyting he should,to meet the code.
He said he had done what the inspectors had advised, and had been approved by the
inspectors.
There is a question on parking. Requirements are in the current zoning ordinance.
Student housing requires 1 parking place for each two students up to and including
24, and then 1 parking space for each additional 3 students beyond 24. Steve said
they have 112 students in the apartments. Subtract 24 from 112, leaving 88 divided
by 3, . they would need approximately 42 parking spaces. Steve said they have
had excess building materials back in the back of the whole project, while we were
trying to get the front finished and that was not yet available for parking which_
we had projected for parking. They have been parking in the front section and
\{ had just got gravel and dirt in the other side so they could park in there, it is
not completley functionable. He explained the parking and showed a plan.
/They counted the number of cars the girls have and we have enough parking for them,
but what is happening is boys pull in at night to visit girls and and park in the
girls spots and the girls coming in late would park on the street. We had a sign

on the street. On the 1st of November, our manager is assigning each of the girls
a parking place. He will assign the 20 feet parking places to girls with small cars.
Each spot will be numbered and each girl will have a number. It will leave 20 feet
for the fire truck. Today the men hauled away the garbage and the wood from behind the
house, tomorrow they will get the windows on and then we will finish leveling and haul
in gravel, and open up the back area for parking, making 8 spaces available in the back.
So counting the spaces we have in use and the other eight spaces, we will have 43 spaces.
The driveway is 20 feet wide, it slants over from the house, but we filled in the
whole length of the driveway with dirt and gravel, and have slant parking. We could
currently hold ten or twelve more cars.
He stated that they would like to add another unit in front, but don't have the
financing. Gerald Taylor ask if they were still under construction?, He said
they were almost done.
He explained the parking for 8 additional spaces if they build another unit, and
n still maintain the 20 foot driveway.
ry Glen Pond said the problem he has with what had been said so far is how they are going
to control the parking for only compact cars? The zoning does not call for
compact or standard size cars, it calls for a parking spot which would include
a standard size car. Your are going to have students in ther irregardless of
whether they are assigned place or not, and will you have the 20 foot. Steve
said it would drop to 18 foot with a big car. How are you going to control what
is parked in that spot. Glen said he has a problem with the cars sticking out
two feet and not giving us the 20 feet, for a fire lane. Chuck Porter said
he felt the same way, cars should be parked so the fire truck could get through
at all times. If someone parks the car in the wrong place and the place burns
down. You have got to have something -that fits a little more universal.
Chuck Porter ask if there was some parking lot standards, and if so he should
keep to the standard regulations. Chuck said he had driven in the parking lot
twice and it striked him as being an extremely crowded situation, and both times
I had to back out because there was no place to turn around. Chuck Frost recommended
that he get the standard requirement for parking lots and then try to design to
iI it. If people do not have room to park, they will park on the street. You will
then have some mad tenants and it will also have an impact on the neighborhood.
They suggested that he drop a couple of the parking places and give more room to
pull through the parking lot.
Maurice & Argus Clinger who live next door were at the meeting. Maurice Clinger
said she was the one who complained about the parking to begin with. She ask
if they are suppose to provide parking for the boyfriends. The code does read
that it should accommodate some visitors, Chuck Frost told her. Mr. Clark
said that when they get the back finished there will be extra parking. Argus Clinger
explained that his wife is the president of the DUP and has a lot of the older
women call and say they need to bring things to you or talk to you but there is no
parking in front of the house. Most of the ladies are quite old and don't feel
like walking a block or two.
Gerald Taylor ask about the code for paving the parking lots. Chuck Frost said
it is required that the parking lots be paved. Steve Clark said they would get it
paved, if they don't have time before cold weather they will do it first thing in
the spring.
Chuck Frost said before they go ahead with the other unit, he will have to bring
in a plot plan showing the proposed final parking, and your arrangement. We need
the dimensions on it to scale. Chuck Porter said he would feel much more comfortable
is the plan was drawn to the engineering standard, rather than just fitting and
juggling and doing the best we can. Requirements for space for parking lots for
the cars and backing area was discussed.
Chuck Frost told him he would need to buy a garbage dumpster and provide a garbage
area where trucks can get in and dump the garbage and keep the garbage cleaned up.
Maurice Clinger said they had not been able to use the space in front of their home
for 6 months. We couldn't mow or water or use our front yard.
He was told that they need to get the construction cleaned up.
Need to do some neighborhood relations, and be courtesy. :Teed to clean up the loose ends
and have a finished look.

Success of the project will depend on good parking. Before the next unit is built
you will have to have a plot plan. Mr Clark said they planned on purchasing the
Garner home and that will give them a lot of parking.
Gerald Taylor said he would encourage them to black top the parking as soon as possible.
Chuck Frost told the council that Diane Wilcox at 145 West 1st North had requested
to have the zoing changed from commercial to Residential. She can't sell her property.
The group felt that unless the entire side of the street is changed, we could not
just change that house. The trend in that area is for commercial. We will put it on
the list to be considered when the zoning ordinance is adopted.

Bob Purrington reviewed the minutes of February 28, 1985, a motion was made by
Dan Hess and seconded by Gerald Taylor to approve the minutes. All Aye
Tim and Verna Taylor was at the meeting to request a Zone Change on the property on
the west side of Park Street to put in a trailer court. The commettee told them they
would have to have two paved roads and they could not use the road going through the
Church property. Jim Keller checked the Comperhensive Plan and found that it was designated
to be R1 property even though it had been zoned R2. There would have to be a hearing to
change the Comperhensive Plan before there could be a hearing to change the zone. They
said they had not purchased the property yet. Jim Keller told them that the water and
sewer line would have to be extended and put in correctly, they would have to put in
curb, gutter, sidewalks, and paved streets. They would have to maintain the street as a
private street unless they were dedicated to the city. They would have to have a laundry,
a park, and open space according to the ordinance. If they did not put a laundry in and put
everything in that the trailer ordinance calls for they would have to get a variance and
that would be another hearing. Gerald Taylor told them it would save time if they checked
with the adjoining property owners and especially the church. Tim Taylor said they did
have another sight they were looking at by Porter Printing and ask if they would be able to
hook onto the sewer. Glen Pond told him there wouldn't be a problem if they wanted to
pay the cost. Bob Purrington thanked them for coming and told them they would make a
recommendation to the city council.
Steve Clark was at the meeting to discuss putting 4 four plex apartments on the property
at 143 South 1st East. They were going to put in five four plex but found they didn't
have enough property. The comm$ttee discussed if there was enough property to put in
4 four plex apartments on the property without getting a variance. There was a question
after reading the zoning ordinance. Jim Keller advised Mr. Clark to talk to the City
rAttorney and get an interpetation of the amount of property needed. The commettee
told him that if the attorney said there was enough property and he had the right
set backs and parking he could go ahead and put them on the property. If there was not
enough property he would need to go to the city council and request a variance. The
committee felt there was no problem in letting him put the four plex apartments on the
prop rty if it did not have a congested look from the street and that he had the
proper access roads, proper rear, side, and back yard.
Linda Eames was at the meeting to discuss putting condominiums at 250 North 3rd East.
She showed a model of the arrangement of the condominiums. She had talked to Nile
Brown about the set backs. They would be duplex apartments, with a fire wall and
each unit would have 1056 sq. ft. Jim Keller told her she would have to build the
condominiums according to the sub -division ordinance, which has a section in it pertaining to
condominiums. He told her she would have to maintain the street, have a place for the
garbage receptical, and a place for mail boxes. The street would not bebig enough for
a fire truck to turn around, and the fire department would have to okay it if they had
to back up out of the street and could not turn around.

Dr. Peterson put his office in. The City clerk told the committee that the Mayor had said
that when Dr. Peterson put his office in he was not supposed to have parking in the front
but that Mayor Shirley had let him put the parking in front. Chuck told him that to re -zone
would be an advantage if he wanted to sell the property later on, with a variance there
would be some restrictions. Chuck Porter said that we need to consider if we re -zone to
also re -zone the property that Keith Grover owns that joins the property. Glen Pond said
that they should consider that six months ago we talked about spot zoning. Chuck Frost
stated that area was used for professional offices, and this would just extend it. Dr. Heiner
said that the lot is twice as big as the one Dr. Peterson is on, and a little bit smaller than
Dr. Workmans. If the zone was changed it would be a C1 Zone in the new ordinance and could be
R3 in the old ordinance. The committee felt that it would be an improvement in the use of
the land. Dr. Heiner said he did not have a preferance in a variance or to re -zone, he did
not expect to be selling the building. Chuck Frost told him that he needed to get his
architect to draw up a plot plan showing the limits of the property, how the entrances would
come into the parking lot, how he intended to sight the building on the land, and the parking
places. Design it according to R3 and bring it back for a variance.
Steve Clark was at the meeting. He and J.D. Hawkes would like to buy the property at 143
South 1st East where the old John Bingham home was. They had bought five homes that were at
Challis which had not been occupied after they were built. They had an option on the ground
pending an approval from the Planning and Zoning. The property is 346 Feet deep, the front
is only about 72 feet wide, but at 181 feet back it widens out another 50 feet, so there is
'24 feet in the back by 165 feet. They are nice three bedroom homes. They would use the
xisting home for a managers home. They would like to put two homes together on each side
,end put one home on the one end. They would be duplex on a full foundation and a full
basement, with three bedroom apartments. When it is finished they would hold 120 students.
The garage would be altered. There would be 20 units. Chuck Frost told him he would have
to figure out his parking, he would need 44 parking places. He was told he would have to
modify the homes to code for duplex, and there would have to be 10 feet between buildings.
Chuck Porter told him he would need a variance to cluster that many duplex on the property,
and if they altered the garages it would make them 4 plex. He would need 10,500 sq. ft. Der
four plex. He was advised to get a plot plan with the parking on it and come back and
request a variance for the 5 units because the property is only, big enough for 3 units,.
Tim and Verna Taylor came to the meeting to request putting a mobile home court just. West of
the Park Street Church. Chuck Frost told them that we would need to find out if it i5 in
the city limits or not. If it is not in the city limits, since it is within one mile of the
city limits, it would have to be annexed to the city. They would have to come back and
petition for an annexation. It would have to be platted And have dedicated roads, indicated
on the plat.
