AND INDUSTRIAL SERVICES October 19, 1990 TO: Whom It May Concern FROM: Roy Frisk Electrical Inspector, 3-E SUBJECT: INSPECTION OF THE COTTAGES I helped inspect the apartments in Rexburg called The Cottages. In my findings, this place is a disaster. There are a lot of problems in all of the 'apartments. The National Electrical Code is a minimum guide for the installation of electrical and this complex does not even come close to that. As far as I'm concerned, there is a gray area for the safety of all people who live there. I feel that it would be advantageous for a good, qualified electrical contractor to clean up all of these problems. We discussed the various things that were required to be completed to bring the project to compliance with the code and ordinance before construction can again be started. The items to be completed are: 1. Get a signed statement from John Myers, City Building Inspector from Idaho Falls, that the items be listed to as in violation to the Uniform Building code are now in compliance. 2. Present to the City of Rexburg specifications and drawings of the supporting members of the 1st floor cantilevered section. This will include footings, foundations, columns and beam. 3. Two copies of plans for; site, footings, wall sections, wall seperation sections, and all other plans required for the completion of the project. We also discussed lowering the building to meet the requirements of the ground floor being classed as a basement. There is a problem of not having proper supervision of construction. Steve is contacting his brother, who is a builder, to come supervise the project. We suggested he get someone with qualifications in construction to direct his workers on a continual bases, in as much as Steve can not be there on the job site all of the time. Steve agreed to this. FAX (208) 356-0768 On behalf of my client, I want to thank you for the opportunity of speaking to the City Council with regard to my client's concerns regarding the construction of "The Cottages". We again appreciate the City's concern and the efforts being taken to insure compliance with zoning and building regulations. However, it is abundantly clear from that meeting that the City is being less than assertive with regard to enforcement. It is apparent that all building permits from Mr. Clark have been revoked and that he has a pending application. Nevertheless, it is also my understanding from conversations occurring during that meeting that he is being allowed to continue construction and proceed with new construction. Surely this does not indicate the City's willingness or diligence in enforcing these regulations. As I pointed out to the council, plans submitted recently were drafted in 1988 by non -licensed architect in violation of Section 54-301 Et seq. of the Idaho Code. It also appears apparent that the existing construction does not conform to those plans. Furthermore, it is also clear that Mr. Clark cannot meet the Code requirements restricting construction to two stories. It is our opinion that he can not build retaining walls within the five foot set back sufficient to turn the first floor into a "basement". Such a bootstrap approach to compliance with building and zoning regulations, if condoned by the City Council, is absolutely deplorable and jeopardizes the safety of the community. Honorable Nile Boyle June 18, 1990 Page - 2 - We again remind the City that if construction is allowed to continue without proper supervision and proper inspection and compliance with all codes and regulations, the Greenbrier Associates will bring action to compel compliance. We will, of course, make all data that we have generated available to the City and cooperate in any reasonable fashion. There seems to be some confusion as to why he is running into so many obstacles with the City Council. It seems that Mr. Clark obtained a valid building permit, which was granted to him in approximately November, 1988. Since then, he began construction making sure that every step was inspected and approved by your building inspector, Glen Bean. In addition, when designing his building he specifically designed them so as to exceed Rexburg City codes. This is particularly true related to trusses and headers. In fact, it is my understanding he recently presented information to the Council from Rod Hughes, the Manager of BMC West, who's company has built by far the majority of trusses for construction of other apartments in Rexburg. This testimony showed Mr. Clark's trusses to exceed the strength of those required by the City Building Code. However, in spite of his efforts he is constantly being harassed and prevented from being able to timely complete his construction. Let me give you some examples of what I mean. It seems that in spite of the fact that the building permit was granted, a city stop order was issued in April, 1990. This delay was supposedly for the purpose of confirming the strength of the footings and foundation. An engineer was hired by the city inspector. He found no problem with footings and foundation, but without doing any tests or referring to the uniform building code regarding header widths he raised some questions, which the Council used as Nick Boyle, Mayor May 4, 1990 Page 2 a basis for delaying the project. Mr. Clark presented the previously described testimony from Rod Hughes confirming the strength of his headers and trusses. In spite of this, the City Council has continued to delay his project asking him to hire a licensed architect or engineer. The reason this causes such confusion is because Mr. Clark is personally aware of various other projects within the city that have not been delayed and have not had the requirements of hiring architects and engineers even though their construction was not of the strength or caliber of his project. As a result, he is not certain as to whether he is just being harassed and/or discriminated against or intentionally harmed by the actions of the Council. This is further questioned when after he attempts to solve the trusses and header problems and after his foundations were approved by the city inspector, Glen Bean, and examined by the independent engineer hired by the city, all of which said the foundations were acceptable. Now the City Council is attempting to raise another issue to delay his project using the foundations as a basis for said delay. All of these delays have been very costly to Mr. Clark. He not only lost his original financing due to the delays, but has lost two full years rent. We don't understand what is causing the problem. Mr. Clark asked me regarding his legal rights in this matter. I have informed him that if what he tells me is correct, which I believe it is, it appears to me that he could have a valid claim against the city for the damages that he has incurred. In fact, we would ask that you accept this letter as a formal "Notice of Tort Claim" pursuant to the applicable code sections of the Idaho Code. From this standpoint, if this matter can be resolved immediately he has informed me he does not intend to carry the matter any further, but if the harassment does not immediately end, I have been instructed to pursue a claim against the city for the damages incurred by him. You 'should be put on notice that if we are required to pursue this claim, especially related to lost income for two years, the amount of the claim will undoubtedly exceed $500,000.00. From what he has told me, I just don't understand why he is being delayed. If your own building inspector is competent to inspect buildings for the city, I don't understand why the City Council is attempting to delay Mr. Clark's project. It almost appears that for some reason the City Council is attempting to intentionally delay or stop his project. I assume this may be as a result of pressure from a constituent who is either a friend or has threatened legal action if the City Council doesn't stop Mr. Clark's project. Please let there be no misunderstanding, we don't want to fight Nick Boyle, Mayor May 4, 1990 Page 3 with the City, but if this conduct doesn't stop and if Mr. Clark isn't treated in accordance with other builders in the community, legal action will be immediately instituted on Mr. Clark's behalf. one final item, it seems the city is grasping at straws to delay this project. The most recent evidence of this is the arbitiary comment that even though Mr. Clark had his building permit prior to changes in the parking code requirements, he would be required to comply with the new law. There can be no questions that Mr. Clark falls under what is commonly referred to as a "Grandfather Clause" in that his permit was granted before the new law went into effect. Again, I finally re-emphasize it appears Mr. Clark is being singled out and harmed by the arbitrary actions of the Council. Following is a list of things that require the attention of the builder. 1. The draft stops must be sealed to the bottom of the roof sheathing. 2. The area separation wall must go to the underside of the sheathing. 3. The boiler rooms are required to have one hour rated fire doors. 4. Some welds have broken and are not supporting the treads properly. Some repairs have been made but it appears that more welds may break. The railings on the upper landing are not solid and secure and could give way if someone or more then one leaned hard against the rail. Some of the welds on the rails are broken. Tenants, (Shelly and other occupants) are feeling unsafe when they use the stairway. Coumerilh Inspector Licensing/Compliance SUBJECT: INSPECTION OF "THE COTTAGES" In the inspection of electrical safety as pertains to enforcement of the minimum standards of the National Electrical Code, the inspector is given by the NEC the power of judgement (NEC 90-4) and is expected to apply .the standards in a fair impartial and consistent manner along' -with the judgement of experience of the individual inspector. In the exercise of this judgement, the concept of "workmanship" plays as important part. Not only does it reflect the standards of the past, it reflects the future direction of installations whether they be electrical or otherwise. Therefore, "workmanship" is an important factor in determining the overall quality of the installation. It should also be noted that quality of workmanship is cited less often than other code sections because of its subjective aspects. That being said, the overview of this apartment complex is one of dismay. The workmanship and physical installation appear to have been done by a person or persons unknown who either do not understand and/or care about the niceties or basic requirements of electrical installations. This installation does show some evidence of a competent electrical installer, but such evidence is few and far between. It would appear that the majority of work has been done by unqualified and unsupervised persons. Some repairs have been made but it appears that more welds may break. The railings on the upper landing are not solid and secure and could give way if someone or more then one leaned hard against the rail. Some of the welds on the rails are broken. Tenants, (Shelly and other occupants), are feeling unsafe when they use the stairway. My recommendation would be to have the complete stairway reconstructed in a more workman like manner, to be solid and secure. ***In accordance with ordinance 684 Section 7 (a) "All rental dwellings subject to this section shall be inspected at least once every two years." The snow load used in the analysis was derived from the "Ground and Roof Snow Loads For Idaho" published by the University of Idaho. The trusses were analyzed using the requirements and restrictions of the 1988 Uniform Building Code. As previously discussed, several of the truss connections were found to be inadequate for the 35 psf roof snow load. The connections require additional nailing. Today I inspected the trusses and found them to be adequately structured to safely support the design roof snow load along with the weight of the roof itself. At this same time I evaluated the window headers on the load bearing walls. These headers are adequately sized, provided the 4 foot cantilevered portion of the building is supported by a beam and column system. As agreed to, the beams and columns will be sized in the near future. This letter addresses only the roof trusses and the window headers.
