Due to the violations of the UBC, UPC, NFC, NEC, and
state and federal regulations governing natural gas usage noted
in the inspections made on or about October 15, 1990, you are
hereby notified that you are not entitled to an occupancy
permit for "The Cottages Apartments" located at 151 South First
East, Rexburg, Idaho.
Pursuant to the UBC, Sections 205 and 202(e), you are
notified that the City of Rexburg has never granted you an
occupancy permit for the fifteen apartments and hereby orders
occupancy of the premises discontinued until all applicable
provisions of the UBC, UPC, NFC, NEC and federal and state
regulations governing natural gas usage are fully and
completely satisfied.
Anyone desiring or continuing to live in these
apartments shall do so at their own risk.

Building Inspector, and Gordon Tychsen, Fire Inspector
have recently inspected your parking area at your
apartments on South 1st East. Their recommendations
were: (1) You must have a 20 foot Driveway which is
kept clear at all times for a Fire Lane; (2) You
must warn your students that they can't park on the street
or in your driveway. They also should not block any of
the neighbor's driveways. On November 1 their cars
will be towed away if they park on the street overnight.
(3) You will not be allowed to build anymore apartments
until you come to the Planning & Zoning with a Plot
Plan and show adequate parking for your apartments.
If you would like to discuss this further please attend
the Planning & Zoning meeting on October 22, 1986, at
7:30 P. M.

It is our understanding that most of the young women who contracted
with you for the newly constructed units at The Cottages have moved into
unfinished apartments, and that although you are continuing to make
finishing touches and final installations of appliances and fixtures, there
is still no certificate of occupancy nor has the complex passed a final
inspection to apply for that certificate.
I need to inform you that the new portion of The Cottages is not approved
to house Ricks College students until the building inspections have been
made and, approved by the appropriate building inspectors and the
certificate of occupancy from the City of Rexburg has been received. We
are concerned about safety of the young women there who must contend
with open breaker boxes, bare wires, power tools, and construction mess
that could be a hazard.
In addition to our safety concerns, we are concerned about the comfort
and convenience of the students who must make due with some
appliances, plumbing and electrical fixtures which are unusable; doors
which are missing; telephones which won't be installed until October or
November, somewhat limited parking space, etc. None of these students
were informed by you of the unfinished conditions as we repuested of you
two weeks ago. Several students and their parents were excited to come
to "the most expensive unit in town" expecting to have things spit and
polished. Instead, many have spent countless hours working to get their
apartments cleaned up and prepared for occupancy. Some have
articulated their frustration at the apparent discrepancy between the
rental price and the product which is delivered by saying that with The
Cottages you "expect the ritz and get the pits." Others have simply bailed
out of the situation and have gone somewhere else to live. As a result, we
are now getting requests for abatement of rent or rent refunds to help
compensate them for their inconvenience. I would like to schedule a
meeting with you at your convenience to discuss this matter and would
offer my services to mediate an adequate solution between you and a
small group of student representatives.

Steve, I know that this situation is a very difficult one for you, but the
students and parents also have some legitimate concerns and
frustrations which must be addressed. I would like to help them look at
the situation realistically, and in light of the financial constraints you are
under right now, but they must be addressed honestly and fairly.
We have communicated with the City and we have determined that the
certificate of occupancy should be within reach by the end of November.
If the certificate is not received by then, we will not leave The Cottages on
the approved list to be printed in December, 1990 for the 1991-92 school
year. The leniency here is in deference to the young women involved and
the lack of other suitable alternatives for housing at the present time.
However, without being approved, we will not allow the Cottages to house
Ricks College students next summer or thereafter.
Please communicate with me regarding these concerns and let's get
together as soon as possible to review alternatives to solving these
problems. After you and I meet we will inform the tenants of our
concerns and possible solutions.

A Certificate of Occupancy is required from the Building
Department of the City of Rexburg to the owner of apartments before any
student can be placed in any apartments. In order to receive the
Certificate of Occupancy, all parking areas must be completed. This
includes drainage of lots, stairways, blacktopping and marking. All
exterior of buildings must also be completed including stairways and
decking.
Then each apartment, as the interior is completed, can receive the
Certificate of Occupancy.
The general landscaping can be completed after students are living
in the complex, but before bad weather arrives.
The Building Department also must have the engineer's design and
written approval of the change of decking and cantlevered section of
front of building.

Dear Mr Clark:
I have visited the job site of "The Cottage" Apartments, and with
almost every visit I have had to correct or instruct the workman
on work that was being done incorrectly or in a condition that
indicated poor working practices. For example: walls that weren't
plumb, headers that weren't according to code, and foundation
walls not plumb straight, or conforming to the existing foundation
walls, just to mention a few.
The supervision on the job is not up to standard and in view of the
work being performed with this supervision, I recommend that they
get one man capable and experienced enough to handle this situation
or we will have to close the project down. If this man can be found
and placed in the position to carry on this work similar to other
contractors in Rexburg, we should set a future date for this event
and if it doesn't take place in this time the project will be shut
down.
There has been several changes from the original plan, and the owner
is required to notify the building officials of this change for
permission to change and present a detailed plan of this change with
specifications.

SUBJECT: OVERVIEW OF INSPECTION OF "THE COTTAGES"
REQUESTED BY THE CITY OF REXBURG
On Tuesday, October 17, 1990, Mayor Nile Wiley of the City of
Rexburg and Director of Public Works Farrel Davidson requested the
assistance of the Electrical Division in assessing the electrical
"condition" of a complex of apartments known as "The Cottages"
located at 151 South First East. The units in question are
indicated to be five (5) triplex apartments in a three story
vertical arrangement. Because of the unavailability of Mr.
Davidson on Wednesday, the inspection was scheduled for Thursday,
October 19, 1990. On said date an inspection team consisting of
Inspectors Dan Fadness, Roy Frisk and myself met with Mr. Davidson
and conducted an electrical inspection of those items that were
accessible and not requiring removal of building finish or that
were not rendered inaccessible because of the occupants (comprised
of approximately ninety (90) students and their associated
furnishings, baggage, waterbeds, etc.). Some items (such as
service panels and ground fault interrupter testing) were inspected
in each and every apartment and other items were looked at on a
random basis once a common deficiency was noted. Some items were
not identified on the written list against each specific apartment
once it became apparent that all apartments suffered a similar
deficiency (e.g., over-lamping of fixtures in direct violation of
warning on fixtures).
It should be noted that in endeavoring to make this inspection, the
team attempted to be a thorough as possible within the constraints
imposed by occupation of the apartments without causing excessive
inconvenience or time delays for the occupants or others. It has
been noted previously that as redundancy of violations became
apparent many were not itemized by the individual inspection team
member against an individual apartment.

The appropriate corrective actions would require not only
addressing the specific itemized violation as stated in the report,
but competent licensed electrical personnel would by necessity have
to inspect each and every location where similar discrepancies
could be found. For example:
1. Spot checks show bath fans are not properly grounded due
to misapplication or non-use of "ground clips". Ground clips
are normally considered only slightly more complex than a
screw, but it is obvious that because of the spot checks made
all bath fans should be checked.
2. It is apparent, for example,.that a mechanical connector
has not been used at numerous splice locations. Some splices
were made with the proper connectors. Only investigation of
each and every outlet, receptacle switch, light outlet, etc.
would determine the actual numbers of this specific violation.
3. None of the circuit breaker panel directories were filled
out.
4. Some individual panels exhibited evidence of
"professional" involvement; i.e., separation of grounds and
neutrals, proper bonding, neat workmanlike terminations, etc.
Most panels showed'a distinct lack of expertise or knowledge
of electrical installations. Violations in panels create
hazards ranging from electrical shock potential to, as in
apartment 9C, the inability of a branch circuit breaker to
trip because of unterminated feeder ground.
5. Integrity of the "firewall" system is much in doubt as
observable penetrations have not been sealed with appropriate
firestop.

Inspection was made on repairs and corrections by inspector Roy
Frisk and myself on November 21, 1990. The following is a summary and
not a detailed report, submitted for your deliberations concerning the
property.
Electrical contractor Ivan Jolly (number C-2956) is the con-
tractor of record on the job. Repair work is being done under Idaho
State Permit C180195. Corrections were being done off the repair punch
list.
Two areas were of concern to me. Mr. Clark and the contractor
were replacing some bathroom fixtures that were not wet location rated,
All bath/shower room fixtures shall be replaced, but all were not
written up. Since the bath/shower rooms were all the same, the fixtures
shall all be the same. Secondly, the service entrances were not cor-
rected at all as of the time I was there. The service entrance is the
heart of the system as the breaker panels are the brains and it is of
major importance that all is correct at that location.
Basically the inside is nearly done to the point that it could be
rated acceptable and the outside has not been repaired and/or corrected
yet. The final approval is still in progress but it is progressing.

individually secure the SER type feeder cables to the service
equipment combination meter -disconnect enclosures with the
proper connector and bushing, but rather were fed through a
single knock -out with a chase nipple and therefore, the cables
are not secured to the enclosure, but are capable of movement
and the transmission of stress to the terminations at the
circuit breakers, etc., at the Cottages Apartments located at
151 South First East, Rexburg, Idaho, in violation of the
National Electrical Code, Section 373-5(c), as adopted by
Rexburg City Ordinance No. 702, a misdemeanor.
COUNT 144.
That Steven Clark of 625 South 5000 West, Rexburg,
Idaho, on or about the 19th day of October, 1990, in the City
of Rexburg, County of Madison, State of Idaho, did expose romex
on exterior of structure (behind gas pipe) to join mismatched
walls at the Cottages Apartments located at 151 South First
East, Rexburg, Idaho, in violation of the National Electrical
Code, Section 336-10(b), as adopted by Rexburg City Ordinance
No. 702, a misdemeanor.

Rexburg and Director of Public Works Farrel Davidson requested the
assistance of the Electrical Division in assessing the electrical
"condition" of a complex of apartments known as "The Cottages"
located at 151 South First East. The units in question are
indicated to be five (5) triplex apartments in a three story
vertical arrangement. Because of the unavailability of Mr.
Davidson on Wednesday, the inspection was scheduled for Thursday,
October 19, 1990. On said date an inspection team consisting of
Inspectors Dan Fadness, Roy Frisk and myself met with Mr. Davidson
and conducted an electrical inspection of those items that were
accessible and not requiring removal of building finish or that
were not rendered inaccessible because of the occupants (comprised
of approximately ninety (90) students and their associated
furnishings, baggage, waterbeds, etc.). Some items (such as
service panels and ground fault interrupter testing) were inspected
in each and every apartment and other items were looked at on a
random basis once a common deficiency was noted. Some items were
not identified on the written list against each specific apartment
once it became apparent that all apartments suffered a similar
deficiency (e.g., over-lamping of fixtures in direct violation of
warning on fixtures).
It should be noted that in endeavoring to make this inspection, the
team attempted to be a thorough as possible within the constraints
imposed by occupation of the apartments without causing excessive
inconvenience or time delays for the occupants or others. It has
been noted previously that as redundancy of violations became
apparent many were not itemized by the individual inspection team
member against an individual apartment.

Cottages" Inspection
The appropriate corrective actions would require not only
addressing the specific itemized violation as stated in the report,
but competent licensed electrical personnel would by necessity have
to inspect each and every location where similar discrepancies
could be found. For example:
1. Spot checks show bath fans are not properly grounded due
to misapplication or non-use of "ground clips". Ground clips
are normally considered only slightly more complex than a
screw, but it is obvious that because of the spot checks made
all bath fans should be checked.
2. It is apparent, for example, that a mechanical connector
has not been used at numerous splice locations. Some splices
were made with the proper connectors. only investigation of
each and every outlet, receptacle switch, light outlet, etc.
would determine the actual numbers of this specific violation.
3. None of the circuit breaker panel directories were filled
out.
4. Some individual panels exhibited evidence of
"professional" involvement; i.e., separation of grounds and
neutrals, proper bonding, neat workmanlike terminations, etc.
Most panels showed a distinct lack of expertise or knowledge
of electrical installations. Violations in panels create
hazards ranging from electrical shock potential to, as in
apartment 9C, the inability of a branch circuit breaker to
trip because of unterminated feeder ground.
5. Integrity of the "firewall" system is much in doubt as
observable penetrations have not been sealed with appropriate
firestop.

I helped inspect the apartments in Rexburg called The Cottages.
In my findings, this place is a disaster. There are a lot of
problems in all of the apartments. The National Electrical Code
is a minimum guide for the installation of electrical and this
complex does not even come close to that. As far as I'm concerned,
there is a gray area for the safety of all people who live there.
I feel that it would be advantageous for a good, qualified
electrical contractor to clean up all of these problems. If I can
be of more help, please call me.

I get a real bad gut feeling about this apartment complex. We
found many violations from fairly minor to fairly major. I don't
have any idea what lies in the covered walls, and I have absolutely
no confidence in the electrical contractors and/or "journeymen".
I would feel justified and comfortable calling for a license
hearing on any or all of them. There appears to be nearly total
lack of concern for personal safety and quality of work.

SUBJECT: INSPECTION OF "THE COTTAGES"
In the inspection of electrical safety as pertains to enforcement
of the minimum standards of the National Electrical Code, the
inspector is given by the NEC the power of judgement (NEC 90-4) and
is expected to apply the standards in a fair impartial and
consistent manner along with the judgement of experience of the
individual inspector. In the exercise of this judgement, the
concept of "workmanship" plays as important part. Not only does
it reflect the standards of the past, it reflects the future
direction of installations whether they be electrical or otherwise.
Therefore, "workmanship" is an important factor in determining the
overall quality of the installation. It should also be noted that
quality of workmanship is cited less often than other code sections
because of its subjective aspects.
That being said, the overview of this apartment complex is one of
dismay. The workmanship and physical installation appear to have
been done by a person or persons unknown who either do not
understand and/or care about the niceties or basic requirements of
electrical installations.
This installation does show some evidence of a competent electrical
installer, but such evidence is few and far between. It would
appear that the majority of work has been done by unqualified and
unsupervised persons. I can only assume these lack of
qualifications would include violations of Idaho Electrical
Licensing Laws.

As a final comment, it should be pointed out that electrical
installation is just one component of the whole and observation of
the whole gives very little cause for optimism of the installations
hidden by the structure finish. For example: romex in contact with
loose (unsecured) water pipes can be detrimentally affected by that
movement over a period of time; gaps around boxes allow the
transference of heat and sparks into wall cavities and potential
carbonization of wood products; battery powered smoke detectors
instead of powered ones in violation of the Uniform Building Code;
gas meters in close proximity to electrical service equipment, etc.
All in all and overall in my opinion, this is one of the poorest
installations I have seen in quite a while.
