Public Facilities Coordinator FROM: Joe Laird, P.E. ..�� City Engineer & Building Official SUBJECT: Access2Capital's Request for a Certificate Of Occupancy or a "Certification that there are No code violations on record"for the American Manor Apartments. (Apartments formerly known as Applewood Apts. at 151 So. V East St.) We have never been able to find the City's copy of a Certificate Of Occupancy for this building. At the time the apartment complex was being constructed, it is my understanding that there was some controversy over whether or not the buildings were being constructed in accordance with the Uniform Building Code if effect at the time. I don't know whether a Certificate of Occupancy was never issued or whether it has been lost over the ensuing years. In late January of 1996, we were asked by the apartment owner/manager, Steve Clark, to evaluate the various buildings in the apartment complex to determine if they complied with the Life/Safety requirements of the Uniform Building Code, Uniform Fire Code, State Electrical Code and the City's Zoning Code. Attached is a copy of my letter of February 9, 1996 setting forth our findings for each of the various buildings in the apartment complex. As can be readily seem, there were a number of problems with each of the buildings. I WOULD LIKE TO EMPHASIZE THAT THIS INSPECTION WAS GENERALLY LIMITED TO ITEMS IN PLAIN AND FULL VIEW OF THE INSPECTOR. ATTICS WERE INSPECTED FROM THE ATTIC ACCESS OPENING. GYPSUM WALLBOARD THICKNESSES WERE MEASURED AT ELECTRICAL OUTLET FIXTURES AND LIGHT FIXTURES OR WHERE OPENINGS IN THE EXTERIOR SIDING MADE THE GYPSUM WALLBOARD VISIBLE AND MEASURABLE. NO ATTEMPT WAS MADE TO ASCERTAIN THE STRUCTURAL SOUNDNESS OF THE BUILDINGS OR RELATED FACILITIES. THIS INSPECTION AND REPORT DO NOT PROFESS TO HAVE COVERED ALL OF THE ITEMS INCLUDED IN THE UNIFORM BUILDING CODE, UNIFORM FIRE CODE AND STATE ELECTRICAL CODE. We tried to get a schedule and timetable from Mr. Steve Clark regarding when and what buildings/items on the list were going to be worked on. We were never able to get a schedule and list of work from Mr. Clark. He had various carpenters and college students doing work on various items and at various times and we were infrequently informed about when or what they were working on. Building Inspector Blair Manwaring tried to keep an eye on the various work items that were being completed but he never knew exactly what or when the various carpenters/college students were working on the different items so his inspections were on kind of a "catch as catch can" basis. To the best of my knowledge the violations of the State Electrical Code were corrected (Item #6, Bldg. IA this electrical line may not have been adequately buried yet.) but the violations of the Uniform Building Code and Uniform Fire Code were not all corrected before the apartment complex changed owners from Steve Clark to Dr. Tamala Rencher, etal. After Dr. Tamala Rencher took over ownership of most of the Apartment Complex (now American Manor Apartments) we tried again to get a list of exactly what work was going to be done where and when so that every one would know what the plan was to get the various Code violations corrected. We were never able to get such a list/schedule from Dr. Rencher either; however, she did have a repair crew under the leadership of a Scott Caffaro that did a lot of work on the apartments. Building Inspector Blair Manwaring worked with Scott Caffaro and did various inspections of various work that Caffaro and crew completed, but we have no record of exactly what has been corrected and what has not been corrected To further complicate the situation, some of the apartments in Building I are owned by new owners other than Dr. Rencher. The building and parking spaces south of Buildings #3 & #4 has been sold to a different owner leaving the original apartment complex so it has an even greater deficit of parking spaces than it had originally. In conclusion, I guess I would have to say that we don't have any good records of what items have been corrected and what have not been corrected. There have just been too many carpenters/college students doing work that we were not aware of and which therefore never got inspected. It appears to me that the apartment complex needs to have another complete and thorough inspection to see which of the listed items have been completed and which have not. This would be done under Section 108.8 of the 97 UBC and would be paid for by the owner under Table 1-A Building Permit Fees, Item 2 - Reinspection Fees assessed under provisions of Section 108.8 @ $47.00/hr.(See attached copy of Sec. 108.8 and Table 1-A) This would basically be doing over again what we did four years ago in Feb. 96. I'm sure we will find that there are still a number of items on the previous list that have not yet been corrected. The lack of adequate vehicle parking is a known item that has not been corrected. As indicated above, we did not do a structural evaluation of any of the buildings. I would be particularly concerned about the structural viability of the three story structure (Building 1-A). Perhaps the owner should be required to have a structural engineer evaluate the structure. 1997 UNIFORM BUILDING CODE permit for which a plan review fee has been paid is withdrawn or canceled before any plan reviewing is done. The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. SECTION 108 — INSPECTIONS 108.1 General. All construction or work for which a permit is required shall be subject to inspection by the building official and all such construction or work shall remain accessible and exposed for inspection purposes until approved by the building official. In addition, certain types of construction shall have continuous in- spection, as specified in Section 1701.5. Approval as a result of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give au- thority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid. It shall be the duty of the permit applicant to cause the work to remain accessible and exposed for inspection purposes. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any material required to allow inspection. A survey of the lot may be required by the building official to verify that the structure is located in accordance with the approved plans. 108.2 Inspection Record Card. Work requiring a permit shall not be commenced until the permit holder or an agent of the permit holder shall have posted or otherwise made available an inspec- tion record card such as to allow the building official to conve- niently make the required entries thereon regarding inspection of the work. This card shall be maintained available by the permit holder until final approval has been granted by the building official. 108.3 Inspection Requests. It shall be the duty of the person do- ing the work authorized by a permit to notify the building official that such work is ready for inspection. The building official may require that every request for inspection be filed at least one work- ing day before such inspection is desired. Such request may be in writing or by telephone at the option of the building official. It shall be the duly of the person requesting any inspections re- quired by this code to provide access to and means for inspection of such work. 108.4 Approval Required. Work shall not be done beyond the point indicated in each successive inspection without first obtain- ing the approval of the building official. The building official, upon notification, shall make the requested inspections and shall either indicate that portion of the construction is satisfactory as completed, or shall notify the permit holder or an agent of the per- mit holder wherein the same fails to comply with this code. Any portions that do not comply shall be corrected and such portion shall not be covered or concealed until authorized by the building official. 107.6 108.8 There shall be a final inspection and approval of all buildings and structures when completed and ready for occupancy and use. 108.5 Required Inspections. 108.5.1 General. Reinforcing steel or structural framework of any part of any building or structure shall not be covered or con- cealed without first obtaining the approval of the building official. Protection of joints and penetrations in fire -resistive assemblies shall not be concealed from view until inspected and approved. The building official, upon notification, shall make the inspec- tions set forth in the following sections. 108.5.2 Foundation inspection. To be made after excavations for footings are complete and any required reinforcing steel is in place. For concrete foundations, any required forms shall be in place prior to inspection. All materials for the foundation shall be on the job, except where concrete is ready mixed in accordance with approved nationally recognized standards, the concrete need not be on the job. Where the foundation is to be constructed of ap- proved treated wood, additional inspections may be required by ,o F the building official. r 108.5.3 Concrete slab or tinder -floor inspection. To be made after all in -slab or under -floor building service equipment, con- duit, piping accessories and other ancillary equipment items are in place, but before any concrete is placed or floor sheathing installed, including the subfloor. 108.5.4 Frame inspection. To be made after the roof, all fram- ing, fire blocking and bracing are in place and all pipes, chimneys and vents are complete and the rough electrical, plumbing, and heating wires, pipes and ducts are approved. 108.5.5 Lath or gypsum,board inspection. To be made after all lathing and gypsum board, interior and exterior, is in place, but be- fore any plastering is applied or before gypsum board joints and fasteners are taped and finished. 108.5.6 Final inspection. To be made after finish grading and the building is completed and ready for occupancy. 108.6 Special Inspections. For special inspections, see Chapter 17. 108.7 Other Inspections. In addition to the called inspections specified above, the building official may make or require other inspections of any construction work to ascertain compliance with the provisions of this code and other laws which are enforced by the code enforcement agency. 108.8 Reinspection. A reinspection fee may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not complete or when correction called for are not made. 'Ibis section is not to be interpreted as requiring reinspection fees the fust time a job is rejected for failure to comply with the requirements of this code, but as controlling the practice of calling for inspections before the job is ready for such inspection or re- inspcj:tihn: Reinspection fees may be assessed when the inspection record card is not posted or otherwise available on the work site, the approved plan are not readily available to the inspector, for fail- ure to provide access on the date for which inspection is requested, or for deviating from plans requiring the approval of the building official. To obtain a reinspection, the applicant shall file an application therefor in writing on a form furnished for that purpose and pay the 1-5 108.8 -109.6 TABLE 1-A reinspection fee in accordance with Table 1-A or as set forth in the fee schedule adopted by the jurisdiction. In instances where reinspection fees have been assessed, no additional inspection of the work will be performed until the re- quired fees have been paid. SECTION 109 -CERTIFICATE OF OCCUPANCY 109.1 Use and Occupancy. No building or structure shall be used or occupied, and no change in the existing occupancy classi- fication of a building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy therefor as provided herein. EXCEPTION: Group R, Division 3 and Group U Occupancies. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Certificates presuming to give au- thority to violate or cancel the provisions of this code or other ordi- nances of the jurisdiction shall not be valid. 109.2 Change in Use. Changes in the character or use of a build- ing shall not be made except as specified in Section 3405 of this code. 109.3 Certificate Issued. After the building official inspects the building or structure and funds no violations of the provisions of this code or other laws that are enforced by the code enforcement agency, the building official shall issue a certificate of occupancy that shall contain the following: 1997 UNIFORM BUILDING CODE 1. The building permit number. 2. The address of the building. 3. The name and address of the owner. 4. A description of that portion of the building for which the certificate is issued. 5. A statement that the described portion of the building has. been inspected for compliance with the requirements of this code for the group and division of occupancy and the use for which the proposed occupancy is classified. 6. The name of the building official. 109A Temporary Certificate. If the building official finds that no substantial hazard will result from occupancy of any building or portion thereof before the same is completed, a temporary cer- tificate of occupancy may be issued for the use of a portion or por- tions of a building or structure prior to the completion of the entire building or structure. 109.5 Posting. The certificate of occupancy shall be posted in a conspicuous place on the premises and shall not be removed ex- cept by the building official. 109.6 Revocation. The building official may, in writing, sus- pend or revoke a certificate of occupancy issued under the provi- sions of this -code whenever the certificate is issued in error, or on the basis of incorrect information supplied, or when it is deter- mined that the building or structure or portion thereof is in viola- tion of any ordinance or regulation or any of the provisions of this code. The apartments have one or two minor discrepancies. The heat seemed to be working adequately. Apartments in Bldg. # 4 these were remodeled and repaired after the fire. There is a discrepancy of the allowable sill height from the floor of 44" some go as high as 49" to 50" however there are beds or permanent desks which would allow for adult egress. Some of the windows lack 5.7 SF. of operable area. However being as adults will be occupying these units and this size would still allow egress. These are non -conforming issues. Scott Richter 2/6/96 ELECTRICAL INSPECTOR DATE Es John Millar PENIS City of Rexburg 121 N Center Rexburg, Id 83440 RE: Certificate of Occupancy for American Manor Dear Sir: I am petitioning for the re -issuance of a certification of occupancy for the American Manor apartments Enclosed is the letter from John Millar, the public facilities coordinator, stating his concern about two remaining issues: (l)completion of repairs, and (2) parking. Both of these last two remaining issues have been completed. Item (1) : The completion of the repairs required. Due to the unique nature of these apartments, the city of Rexburg has graciously allowed each apartment and building to be inspected and approved for occupancy individually. With the exception of the first building (the triple-plex which I do not own), each apartment and building has been inspected and approved by the city building, fire, and electrical inspectors. Students have and are presently occupying these apartments. The city inspectors have expressed accommodation for the excellent improvements that have been made to each building, in addition to the list of safety violation corrections required from the city, The construction crew has corrected and improved each building. The city first inspected the "F" building, then the "B" building; then the "D" building; then the "C" building; and lastly the "E" building. The inspections were completed last August. Item (2): parking must include a minimum of 74 spaces (as in the original approval from the city) There are 10 additional parking spaces today from the required 74 spaces as under the grandfather clause. The nature of the complex has not changed and the parking area has actually been enlarged from the original to now include 10 additional spaces. The original size of the complex (see enclosed map) was 335' X 184" plus the adjacent lot of 184" X 62" located to the south. The present size of the complex is still 335" X 184" plus the adjacent lot of 184" X 81" located to the south. (I elected to purchase the larger lot next to the one Steve Clark had purchased due to the larger size and convenient location.) With these two items reconciled, corrected, and clarified, I am requesting the city of Rexburg to grant a re -issuance of a certificate of occupancy for the American Manor apartments. I have appreciated the courteous assistance from the many city officers as this complex has been inspected and approved for occupancy piece by piece. It is now ready for that certification of occupancy to be expanded to the entire complex. Thank you for the prompt attention in the matter. I express concern about their lack of parking. Jeff stated that the city had approved their leasing a lot around the corner of 22 spaces to fulfill their parking requirement. According to city ordinance 5.2 the parking must by WITHIN 200 feet of the primary entrance. The distance from the "primary entrance" of the Investor's Financial apartments to the comer of the proposed leased parking lot is 238 feet. This does not even include the parking lot, but just to the CORNER of the property. This is measured "as the crow flies" --cutting across my property and through my buildings which is not practical. The true distance by walking on the sidewalk is 588 feet. Either way this proposed parking is in violation of ordinance 5.2. I am concerned about Jeff Shaw's confidence in the city approving his apartments for rent without adequate parking. I am aware of the city's concern about adequate parking at American Manor and I have made every effort to comply completely with this code. Obviously others must comply also. Parking is a great problem at Ricks College due to the increased number of students with cars. From previous experience, I know that the occupants of these apparent will not park 588 feet away, but will Illegally park on the street or the close church parking lot. Therefore, I wish to share my concern with you. I'm sure the Jeff Shaw was mistaken in stating so confidently that the city had already given him parking approval. As his parking lease does not conform to the code 5.2 I'm sure that the city is aware of this situation and will encourage alternative plans of parking to be made by Jeff Shaw which can comply with ordinance 5.2 and be within the required 200 feet.
