How many here tonight, want more government control of their lives?
According to the media, the reason the Republicans won big last November,
was because the voters wanted less government, lower taxes, and less regulations.
The voters wanted a real change, not the incumberances we have had, and continue to
have.
If this is true, then most of us here tonight should be adamantly opposed to
the proposed impact zone, and any other government zoning. Zoning of any kind, is
absolute government control of your personal property rights. Zoning is also bigger
government, more regulations, and eventually higher taxes due to the added costs of
administering zoning rules and ordinances.
James Madison in the 54th Federalist Paper, compared personal rights and
property rights as one and the same.
Zoning takes away your property rights as a free citizen. Once those rights are
taken away, they can't be taken back.
On September 14t1►, at 3:00 in the morning a good man woke my family
because the roof of our house was on fire. Thanks to him my wife and I are alive
tonight. Thanks to the outstanding services of our local fire department, our personal
losses were minimal. However, about three or four hours after the fire was pretty
much put out, a man walked into the remnants of my house, identifying himself as the
city -county building inspector, requesting to examine my house so he could issue us a
building permit. Since this man had no respect for our feelings, and because a
building permit was unnecessary at the time, I promptly told the man what to do
with his permits and asked him to leave.
Since my life and my privacy was violated that day, I have become even more
adamantly opposed to planning and zoning and mandatory building inspections,
although my contractor bought a building permit, to the requirements of my
insurance company, if Mr. Manwaring walks on my property without permission
again, I will personally escort him off. And I will fight any zoning ordinances limiting
my property rights. My property rights, are not up for negotiation.
Now since that day Ire and his employers, have said 1►e only wanted to inspect
my house for my safety, I feel that he only has a vendetta to force the citizens of
Madison County to buy building permits. All in the blessed name of safety.
Ren Franklin at the writing of the Declaration of Independence, stated: "If
you give up your liberty for safety, you no longer deserve liberty or safety."
No matter how hard government or anyone else tries, life will never be safe. It
was never meant to be safe, and never will be safe. With all the permits and
inspectors, there is no guarantee that my house will not have a fire again. I hope not
but it can happen at anytime. Your life can be taken at anytime, for many different
reasons. It will happen, and there is nothing anyone can do to protect you from this
and other dangers of life. God gave us life, what we do with what God gave us is up
to us, and no one else.
Planning and zoning, is the supposed vehicle for "safety" in the community.
It supposedly protects your property rights, and protects you from your evil neighbor
who is waiting to impose on you at any minute. Actually zoning takes away your
rights. You must all realize that if your neighbor cannot build that tool shed, or sell
his property to the highest bidder, then neither can you. Put yourselves in your
neighbor's shoes.
America's problem is that we have become Lemmings. Not thinking or acting
for ourselves. Letting government protect us and think for us.
President Ronald Reagan at his inauguration in 1981 said:
"Government is not the solution to our problems. Government is the problem."
I know that most of those working to make the impact zone, and those who
want to zone the whole county, do so with good intentions. However as the saying
goes:
"The road to hell is paved with good intentions!"
People at the 1st hearing on November 18th, 1992, were told that the zoning
ordinances for the city of Rexburg, would not apply in the Impact zone, until the
property is annexed into the city.
At the hearing held January 5th, 1995, Richard Smith is on record, stating
that: "Once you are in the area of the impact, the city zoning will apply."
Not only has the power of government increased since November 1992, if you
look and study the present map of the proposed impact zone, you'll see that the
impact zone has increased since then to.
I have been doing some research on zoning, and have found that it is the
biggest lie ever created by the mind of man. It is not true protection, but the taking
over of people's property and the rights given to us by ourselves and our founding
fathers.
Houston Texas, the fourth largest city in the United States, does not have
zoning. In fact the citizens of Houston voted overwhelmingly against any zoning. Yet
little Rexburg Idaho, about the size of a pimple when compared to Houston Texas,
cannot live without zoning. In fact the city wants to spread their misery and suck in
the county residents.
Zoning interestingly enough, is originally front Munich Germany. It's original
intent was to control business and industries from imposing on the rest of the
community. However, it has since completely controlled all property owners.
The Supreme Court has ruled many times in favor of property owners due to
the ill effects of city building and zoning ordinances.
Such as in the case of Dolan vs. Tigard Oregon, where city ordinances had
gone to far. And in the case of East Cleveland vs. Moore, where it was ruled that
government must pay compensation when zoning does not allow the owner to get the
highest market value available. Lucas vs. South Carolina Coastal Commission, where
the commission paid 2.7 million dollars in compensation due to loss of property value.
Also a man in Dade County Florida sued and won a judgment because he was unable
to get the full value of his property due to the way his property was zoned.
Can the taxpayers of Madison county, afford to pay large sums of money to
property owners who did not receive Hull property value due to zoning inadequacies?
And if zoning is to protect property value, why have many government entities paid
out compensations due to the effects of zoning? Should taxpayers help pay for
disputes between two parties, that the county citizens themselves, had nothing to do
with?
We should all consider, the fact, that Orange county California, recently filed
bankruptcy, owing two to three billion dollars in bilis. Madison county may not be in
that financial problem today, but that does'nt mean it can't happen here.
Here in Madison County, one of the many problems right now is that we have
some conflict of interest.
For example: John Millar Chairman of the Rexburg planning and zoning
commission, works for Forsgren Associates - a local engineering firm, who designed
the county's present address system and the map of the proposed impact zone. In
zoning the county and creating an impact zone, Forsgren Associates monetarily have
much to gain. Think of what they can profit from the mapping and designing of the
zones and plats required for zoning.
Another problem is that zoners say they see houses popping up everywhere
without direction, and that we are losing agricultural properties to fast. But they do
not realize that no one put a gun to the farmer's head that sold their property.
Also zoners fail to see all the farm property lost due to planning and zoning.
On 17th street, in Idaho Falls, the whole south side was originally zoned agriculture.
Yet today, how much farming land is still on the southside of 17th street? None!
Zoning does not protect farmers and ranchers, it helps put them out of business!
Even worse is that the people deciding what's best for our protection, and
deciding what we can do with our property, are not elected officials of the citizens of
Madison County. They are appointed, by commissioners and councilmen. It's not
what you know that gets you appointed, but who you know. And if you really look at
the members of these planning and zoning commissions, you notice many people
financially well off, and highly influential in the community.
The whole of what Zoners want, is to control our property use, but I fail to
hear them say that they will help pay our property taxes, and our mortgages. They
want the right to run your property, because you and your neighbors cannot do it
yourselves, but do not want to pay for that right. As each citizen must.
I also fail to hear them explain how they will pay for the added costs of
helping property owners plan for themselves. Planning and zoning is not free and is
only an added cost to the coffers of the county treasury.
Above all, zoning is more laws, which creates more cost to the taxpayers of
Rexburg and Madison County through higher taxes, and higher costs of building the
American dream, your own house. With higher and higher costs, younger married
couples will no longer be able to afford to ever fulfill that dream. The dream will be
out of their reach. Many of those couples will be your children and your children's
children.
Recently, the county hired a consultant to guide the county through the
processes of planning and zoning. Even though it was done by a grant, grants come
from the federal government paid for by us, the taxpayers. Grant money does not
come out of thin air. In fact if the counselor is retained, grants may not always be
available, and the county taxpayers will eventually be responsible for that new added
cost.
Also, the county recently paid $320.00 for live county officials and planning
panel members to attend a seminar on planning. Maybe that's not a lot of money, but
it's money that taxpayers paid for, that frankly could have been saved or used
elsewhere for something more pressing than planning and zoning.
Zoners say they want to help us. Not long ago I heard a man running for
President say "I only want to help youl" Then after he was elected and Inaugurated,
he put more controls on our right to bear arms, raised our taxes and brought more
government in our lives. I personally am tired of government telling me what I can
and cannot do, because I am not smart enough to know better.
Yes I make mistakes in my life, but that is how I learn to improve myself. A
constitutional government does not control peoples lives but let's them live their lives
without interference from bureaucrats and government regulations. Although our so-
called local newspaper called myself and others so-called constitutionalists, I'd like to
quote one of my favorite heroes, a man by the name of Ezra Taft Benson who stated:
"I want to be known as a constitutionalist in the tradition of James Madison -- father
of the Constitution." I too, Rod Anderson, want to be known as a constitutionalist as
Ezra Taft Benson, and James Madison, and I believe all Americans are
constitutionalists, because the rights given by the constitution let us choose every day,
where to work, and live and choose for ourselves without government interference.
When we fail to choose for ourselves and allow others to decide for us, for our
supposed own good, then we have failed ourselves and our constitution.

I David Anderson write to the county commissioners of Madison County and to the
Mayor of Rexburg, city Counsel and to those on the planing and Zoning Boards. Concerned
with the Proposal of an impactzone around Rexburg and the eventual zoning of the county that
I make this letter.
After Hearing people at both meetings voice both sides of the issue I noticed that for the
must part that those that were for the proposal wanted to have special things added to it that
would allow them to have the assurance that their properlies would not be impacted by this
proposal. That to me is two sided on their behalf that they would be exempt but that their
neighbors would be forced into compliance. I want my properly rights protected but not at the
expense of others losing their property rights. This is why we must look to the Constitution of
the United States Of America where all people have these rights already protected.
(This you must first understand) Zoning is the taking of private property and turning it in
to public properly! When someone can tell you what to do with property you thought was
yours then it is not your property. It doesn't take a Nev York Lawyer to figure this out only
common sense. Public Property is for 1 u c input an use. Pritr to land ( IS ) for the
I vidua to exercise their inalienable rights to LIFE, LIBERTY AND PROPERTY as longas
ey do not infringe on someone else's inalienable rights as afforded them in the ( 5th and 14th
amendments to the Constitution ). Please Take Time here to read The 5th Amendment and the
14thamendmentSection 1. Of the Constitution
Since it is the SWORN DUTY of our public officials to uphold the Constitution of The
United States, I for one would wonderwhatotherrights we currently have and enjoy would be
thrown aside if zoning where to be passed.
Take Off the sugar coating that Zoning has and Wake up and realize that there is a real
problem with it. Look at it from our founding Fathers point of view and remember some 201
years ago they were concerned enough to give you and me a "Bill Of Rights"! Might I make a
closing point that the BILL OF RIGHTS where given for the individual.
Make zoning Constitutional then I'll buy it !! ! 11! !
And if zoning can% be made Constitutional then give up the idea.
Remember It's " We the People "
not you the governing elect

To Whom It May Concern;
At this time I am in negotiations with Intermountain Farmers,
represented by Gary Taylor to purchase a parcel of land
adjacant to their existing facality to allow expansion of
their business. Upon review of your map it indicates that it
would be wise to zone this entire acreage as light industrial
and border it with both the Salem Road and the Moody Road.
This would help avoid a residential. -light industrial zone conflict
at some future time.
This would also allow for a light industrial area available
for future business development as an incentive for economic
development of the City of Rexburg as well as Madison County.
