Reference: Local Improvement District (LID 45) Properties -Item 25 and 26
Dear Mr. Romney,
I would like to let you know that we have received your letter pertaining to the two properties on
LID 45 and will submit that letter to our elected officials for their consideration. I would like to address
some of your concerns in this letter and would be happy to discuss these items more fully via a phone
conversation at 208-372-2343.
Concerning your first objection, we checked the County records on the website at
hup://madison.rexbuig.org/Htrnl5Viewer2.4/?viewer=public and found that the primary owner record
for 155 E 2^a North in Rexburg shows Standard Plumbing Supply and that Reese Real Estate
Investments shows as a Secondary Owner. On the second parcel, which is the parking area to the east
of the business, the county records show the primary owner as Reese Real Estate Inv. Co. Inc. and
Standard Plumbing as a secondary owner. The mailing address we used to send public notice for both
parcels of property is P.O. Box 708490 Sandy UT 84070. The responsible party received the notices to
the correctly identified mailing address as indicated on the tax records. In fact, we show record of
individuals testifying in behalf of the owners for both parcels in the first public hearing that was held
regarding LID 45 last February. If you do not believe the mailing information and ownership names are
correct on these parcels, we encourage you to contact Madison County, Idaho, who is responsible for the
maintenance of these records. It is also important to note that if a property changes hands, the LID lien
moves with the property, not the property owner.
Concerning the second objection, the second parcel is actually more than just a piece of property with a
cell phone tower. It is a parking lot with frontage on 2^d North where improvements were made to the
street, curb and gutter, and sidewalk. There was no assessment on item #26 for sanitary sewer. There
was an assessment of $ 841.94 for the sanitary sewer connection on item # 25, which connects the
building itself to our sewer system. The city did upgrade the water line service on 2ad North, but at no
cost to the property owners. I will add a breakdown of the costs below for you to see the details of how
these amounts were assessed.
Concerning the third objection regarding the fact that the assessments are more than the annual
property taxes collected, it is important to note that this assessment is not a tax. It is an assessment for
actual improvements made on the two parcels. In order to alleviate the burden to the property owners,
the City will offer the ability to pay back these assessments over a 10 year period. The interest will likely
be 5.5% and we can even collect payments for the LID assessment monthly on the utility bill if that

makes it easier. The city also provided a credit of almost $1,600 for the sidewalk and Curb and Gutter
replaced on these parcels. The actual tax records for both parcels show taxes of over $7,800, which I
have attached for your records.
I will call your corporate office today and try to email this information so you have it prior to the public
hearing on Wednesday. Our Engineering department and the Contractor on this project made many
efforts to minimize the impact on the businesses affected by this project. On several occasions, the
contractor worked late hours and on weekends to help minimize the impact of this project. We hope
this will help resolve your concerns and we are happy to answer any further questions that you might
have.

In re local improvement district no. 45 property located at 157 E 2nd North
To whom it may concern,
We wish to object to the assessments for the property located at 157 E. 2nd North known
as items #25 & 426. Our first objection is that the notice incorrectly identifies the owner of the
property. The notice identifies Standard Plumbing Supply as the owner of the property. The
owner of the property is Reese Real Estate & Investment Company. The assessment has been
made to the wrong company.
The assessment is to raise funds for the purpose of providing sewer and road
improvements. The property located at 157 E. 2nd North consists of two parcels. We object to
the assessment of item #26 which coincides with the second parcel. The second parcel is a cell
phone tower. The amount of $2,850.50 is extremely high for a property that does not take
advantage of sewer or water service and the annual rental income barely covers this assessment.
Finally we object to this assessment for the purpose of the local improvement district as
the amount is greater than the total property tax paid for the year. The special assessment is over
$1,500 greater than the total property tax paid for 2015 and is over $2,500 more than the total
property tax for the second parcel. When added to the property tax this equates to a tax that is 2.5
x the regular property tax for the first parcel and 11.4 x the normal property tax for the second
parcel. This special assessment creates a burden on the property owner that is three times greater
than is normally required. We find this to be an excessive burden to be placed upon the property
owners shoulders.
For the reasons given above we object to the excessive assessment and state that the
assessment are grossly exaggerated and inaccurate
