HomeMy WebLinkAboutOrd 1132 Amending Ordinance 1115 to allow reduced parking (Hotels).pdf1 ORDINANCE NO. 1132 AMENDING THE DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO AN ORDINANCE AMENDING ORDINANCE 1115 BY REDUCING THE PARKING REQUIRED IN MULTI-FAMILY UNITS DEVELOPMENTS FROM TWO (2) SPACES PER UNIT DOWN TO (ONE AND SIX TENTHS (1.6)) SPACES PER UNIT; REMOVE MIXED USE TWO (2) FROM REDUCED CALL CENTER PARKING BY RIGHT; ALLOW MOTELS AND HOTELS IN THE GENERAL BUSINESS DISTRICT (GBD) WITH A CONDITIONAL USE PERMIT; CLARIFY ALLOWANCES FOR PERMITTED PROJECTIONS INTO SETBACKS; PROVIDING FOR EFFECTIVE DATE OF THE ORDINANCE. BE IT ORDAINED BY the Mayor and Council of the City of Rexburg, Idaho: SECTION I: Ordinance Number 1115 of the City of Rexburg, Idaho, is hereby amended. SECTION II: The Development Code of the City of Rexburg, Idaho, is hereby amended by the following SIGNIFICANT CHANGES IN SUMMARY with detailed changes highlighted in Appendix A. SIGNIFICANT CHANGES TO THE DEVELOPMENT CODE Section # Explanation of Change 3.5.090. LDR2 3.6.090. LDR3 b. Permitted Projections with Conditions. Setbacks and Rights-of-Way Exceptions i. Cornices, eaves, belt courses, sills, buttresses, foundation extension under 3’ in height or other similar architectural features. ii. Fireplace structures, bays and other similar structures provided they are not wider than eight (8) feet and are generally parallel to the wall of which they are a part. 3.7.090. MDR1 3.8.090. Box or Bay Windows provided they are not wider than eight (8) feet may be projected up to one (1’) foot in a front yard and up to two (2’) feet in a rear yard. No projection is allowed in a required side yard.” 2 3.16 General Business District (GBD) 3.16.025. Conditional Uses. Add - Motels and motor hotels Add - Call Center Remove - Motels (highway frontage only) Parking 5.8 TABLE 3 – Required Number of Parking Spaces 1.1 TABLE 3 – Required Number of Spaces Call Centers and business with higher density cubicles, 0.9 space per employee or 0.6 per employee allowed in Central Business District (CBD), Technology and Office Zone (TOZ). REMOVE - (and Mixed Use (MU2)). On a case by case basis 0.6 spaces may be allowed in other zones if the Community Development Director determines that the requested location is close in proximity to substantial higher density housing. Use Parking Spaces RESIDENTIAL Single-family dwellings 2 spaces per unit Multi-family dwellings 2.0 spaces per unit (may be reduced by 20% in the Infill/Redevelopment Area as identified in Section 4.16.) High Density Residential (HDR1 & HDR2 Zones, or zones with high-density housing provisions. Does not include dormitory, or non-family housing) 1 bedroom 1.5 spaces per unit 2 bedroom 2.0 spaces per unit (may be reduced by 20% in the Infill/Redevelopment Area as identified in Section 4.16.) 3 bedroom 2.0 spaces per unit (may be reduced by 20% in the Infill/Redevelopment Area as identified in Section 4.16.) SECTION III: Providing for other substantive and non-substantive changes in the Development Code as recommended and approved by the Planning and Zoning Commission of the City of Rexburg, Idaho: SECTION IV: Repeal. All other ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. SECTION V: The City of Rexburg, Idaho City Council shall enact this Ordinance No. 1132 amending Ordinance 1115 otherwise known as THE DEVELOPMENT CODE OF THE CITY OF REXBURG, IDAHO upon its passage, approval and publication.
