HomeMy WebLinkAboutOrd 1137 Rezone South 4th and 5th West to HDR1.pdf 1 ORDINANCE NO. 1137 AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, AND PROVIDING THAT THE ZONED DESIGNATION OF THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED, SITUATED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED AS HEREINAFTER DESIGNATED; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY the City of Rexburg, Idaho: SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed with the city clerk thereof, be, and the same is hereby amended and changed to provide that the hereinafter described properties (#15 00276) located at 228, 230, 232 South 4th West; and 251, 265, 273 South 5th West from Light Industrial (LI) and Medium Density Residential 2 (MDR2) to High Density Residential 1 (HDR1) in Rexburg, Madison County, Idaho, and more particularly described as follows: Legal Description: Part of Lots 1, 3, & 4, Block 5 and the North ½ of a portion of 3rd South Street of the Southend Addition to the City of Rexburg, Madison County, Idaho per the recorded plat thereof, further described as: Commencing at the Southwest corner of said Block 5, and running thence N00º15’04”W 330.04 feet along the West line of said Lot 3, Block 5 to a recovered Iron Rod marking the Northwest corner of said Lot 3; thence N89º45’45”E 296.88 feet along the North line of said Lot 3 to a recovered Iron Rod marking the Southwest corner of said Lot 1; thence N00º14’48”W 170.02 feet along the West line of said Lot 1, Block 5; thence N89º46’01”E 68.00 feet; thence N00º14’48”W 11.50 feet; thence N89º46’01”E 134.00 feet; thence N00º14’48”W 30.50 feet; thence N89º46’01”E 128.00 feet to the East line of said Lot 1, Block 5; thence S00º14’48”E 190.18 feet along the East line of said Lot 1 to the Westerly Right-of-Way of the Union Pacific Railroad: thence S30º08’27”W 465.18 feet along the Railroad Right-of-Way to the center of 3rd South Street: thence S89º45’29”W 391.54 feet along the Center of 3rd South Street to the West line of said Block 5 extended; thence N00º15’04”W 49.50 feet along the extension of said Block 5 to the Point of Beginning. SECTION II: That a new zoning map showing these amendments shall be certified to and declared to be the official zoning map of the City of Rexburg by passage of this Ordinance by the City Council of the City of Rexburg. SECTION III: This ordinance shall become effective upon its passage, approval and publication.
