Public Comment on non-controversial issues: not scheduled on the agenda (limit 3 minutes):
Roger Muir expressed his safety concerns with the intersection of North 2nd East and
Moody Road, where the new Walmart is being built. He believes the road needs to be striped
to keep vehicles in the correct traffic lane. He said his son almost got in a head on accident
because the north bound lane goes directly into East bound turn lane. He also stated the
lanes are shifted to the west. There is a south bound turn lane to turn left; however to turn
to the right a semi- trailer or vehicle with a trailer attached to it will have a difficult time
making the turn. There are four residents in the area that own and drive semi-trailers. They
haul thousands of tons of grain and hay making the intersection heavily trafficked. He
recently was at the intersection in his semi-trailer trying to make the right turn, when two
cars sped past him on the right side. He indicated this is a big safety issue that needs to be
addressed.
Council Member Busby said he knows the area is under construction he asked Public
Works Director Millar about the time frame of getting the intersection striped. Public Works
Director Millar said it was scheduled to be striped twice; however, the truck used to do the

striping broke down. He will have the City Street Crew work on making the intersection safe
until it gets striped.
Presentations:
A. Swearing in of Three Police Officers for the City of Rexburg – Chief Shane Turman
I do solemnly swear (or affirm) that I will support the Constitution of the United States, the Constitution and
Laws of the State of Idaho, and the Laws and Ordinances of the City of Rexburg, Idaho, and that I will to the
best of my ability, faithfully perform the duties of a Police Officer in the City of Rexburg, Idaho, during my
continuance therein, so help me God.
Chief Shane Turman introduced the new Police Officers starting with Officer Jason Jenkins,
Officer Jamie Parkinson, Officer Daniel Allen and Reserve Officer Colter Angell. Reserve Officer
John Bone was not able to attend tonight’s City Council Meeting.
Chief Turman said there were 45 applicants tested who were all qualified; the review panel
narrowed it down to these five officers. He is grateful for them and looks forward to working with
them. He indicated Police Officer Jamie Parkinson and Daniel Allen will leave for ten weeks of post
training in January. Police Officer Jason Jenkins is already a certified police officer through the State
of Idaho.
Council Member Busby asked if Police Officer Angell was the officer that demonstrated the taser
gun to City Council. Chief Turman said Officer Angell didn’t just demonstrate how to shoot the
taser gun; he was also shot with the gun.
City Attorney Zollinger administered the oath of office to the new Police Officers.
Committee Liaison Assignments for 2015:
A. Council Member Christopher Mann: Golf Board · Emergency Services Board · MYAB
Council Member Mann reported Emergency Services Board has not met. The Golf Board
canceled their meeting today and will not meet until March. MYAB met at the Rexburg
Carousel to set up decorations for the Santa at the Carousel event. There will be free
carousel rides, candy canes and the children will have the opportunity to sit on Santa’s lap.
Council Member Mann shared the idea of having new City employees introduced at the
City Council meetings. He appreciated the new police officers being introduced to them.
B. Council Member Jordan Busby: GIS Oversight · Airport Board · Traffic & Safety
Council Member Busby reported the GIS Oversight committee did not meet. He said
there will be a City Council training meeting with Craig Rindlisbacher regarding GIS
mapping at the next City Council meeting. The Airport Board’s meeting was canceled
because they did not have a quorum.
Council Member Busby stated Traffic & Safety met earlier today. They discussed seeking
permission from Mayor Woodland to include information regarding sidewalk snow removal
and on street parking during the winter months, in the City’s utility newsletter. He said this
would remind the homeowners it is their responsibility to remove the snow from their
sidewalks. They would also like to remind City residents about City Ordinance 1030
restricting on street parking starting December 15th to March 1st from 2:00 a.m. to 7:00 a.m.
Council Member Busby indicated he learned new information regarding traffic flow in a
roundabout. He said generally the right of way defaults to the person on your right; however,
in the roundabout you yield to the person on your left who would have the right of way.
They will also be conducting multiple traffic studies starting on Center Street and 7th South
heading towards East 2nd South by Windsor Manor Apartments. He hopes the traffic studies
will show how to alleviate the traffic flows in these locations.
C. Council Member Donna Benfield: Police · Trails of Madison County · IBC · Teton Flood
Museum Committee
Council Member Benfield was excused.

D. Council Member Smith: Legacy Flight Museum · Rexburg Arts Council (Romance Theatre &
Tabernacle Civic Center, Orchestra) · M.E.P.I.
Council President Smith reported the Legacy Flight Museum will meet on Friday morning
to begin planning for the airshow. The Arts Council met last month. She said there are a lot
of events taking place at the Romance Theatre & Tabernacle. She encouraged all to attend
these great events. M.E.P.I. will be meeting next Monday. The executive board has been
meeting and they will have a report at the next M.E.P.I. meeting.
E. Council Member Jerry Merrill: School Board · Parks & Recreation · Urban Renewal Agency
Council Member Merrill was excused.
F. Council Member Brad Wolfe: Planning & Zoning · Beautification Committee
Council Member Wolfe reported Planning and Zoning met last week. There was discussion
regarding the Sweetwater PUD (Planned Unit Development) Final Master Plan/Final Plat it was
recommended for approval by the Planning and Zoning Commission.
Council Member Wolfe said discussion regarding box type homes or storage container homes was
brought up at the last meeting. Planning and Zoning currently doesn’t have any guidelines for these
types of homes. He indicated City Staff has been working on the guidelines and will present them at
the next Planning and Zoning meeting. Council President Smith asked if Community Development
Director Christensen has been approached by developers regarding these types of homes.
Community Development Director Christensen indicated there was a developer who approached
him with questions about building codes for these types of homes.
Council Member Wolfe shared his experience in attending the Madison County Rural Planning
Organization Meeting at BYU-Idaho University. He said he was pleased to see Madison County, the
City of Rexburg, the City of Sugar City, the Idaho Transportation Department and Brigham Young
University Idaho all working together to plan for the future of these cities and to plan for the impact
that growth will bring. Council President Smith said seeing these leaders and people come together
is a result of Envision Madison. She stated it is great to see these leaders united in planning for these
future impacts.

Items for Consideration:
A. Sweetwater Housing Planned Unit Development (PUD) – Final Master Plan/Final Plat –
Approximately 902 Everett Place – Kurt Roland with Eagle Rock Engineering presented the
Sweetwater Planned Unit Development Final Master Plan/Final Plat on the overhead screen. He
is also representing the owner of this development.
Mr. Kurt Roland stated they are proposing a twelve four-plex building development. The
architecture of the buildings is exceptional. The reason the developer asked for a Planned Unit
Development was because he would like to sell the four-plex buildings individually.
Council President Smith asked about the revisions that need to be made. Mr. Roland indicated the
revisions had to do with the landscaping plan. They hired a landscaping architect to design the
landscape and to design a low flow irrigation sprinkler system.
City Attorney Zollinger clarified City Council is approving the Sweetwater Housing Planned Unit
Development Final Master Plan/Final Plat.
Council Member Mann moved to approve the Sweetwater Housing Planned Unit
Development (PUD) Final Master Plan/Final Plat at approximately 902 Everett Place as
presented; Council Member Wolfe seconded the motion; Mayor Woodland asked for a vote:

A. Public Works: - John Millar
Public Works Director Millar reported on the wastewater treatment plant plans. He said
modifications were made to the plans; however, they did not make any significant operational
changes, therefore the bi-product remains the same. There was painting specification changes to the
new wastewater treatment plant structures. There were other specific items that created high costs in
the bid process because of a lack of competition between contractors. He indicated the City
Engineers have been contacting other suppliers and sub-contractors to see if they can lower some of
the costs. The project will rebid on December 18th and he hopes to get lower bids.
Council Member Busby asked if the only change is the painting to the structures. Public Works
Director Millar stated there are a number of changes, one being to bid the storage building
separately. This will help with budgeting. If they are over budget they will delay the building of the
storage building until funds are available.
Council Member Busby asked if the wastewater treatment plant project is within budget. Public
Works Director Millar said they are over the engineers estimate significantly; however, the funds are
available to fund the project. They don’t want to remove items that will change the functionality or
life of the wastewater plant. He indicated that one issue with the bidding process was that the plant
will have a conveyor system that attaches to the sludge thickeners and then run over to the storage
building. They only had one supplier submit a bid for the conveyor system and that bid was over
$150,000.00. The City Engineers have contacted two other conveyor system suppliers which both
bid half of what the first bid was. He said getting competition between suppliers will help with
lowering costs.
Council President Smith asked if all of the City’s public works projects are on schedule. Public
Works Director Millar indicated most of the projects are on schedule. He said the widening of
North 2nd East by the new Walmart has been delayed until early spring. They will be working with
the contactor to find ways to improve the road. Council President Smith asked about the date
Walmart is anticipating opening. He said they anticipate opening January 27th.
Council Member Mann asked about the widening of North 2nd East. He would like to go to the
site to better understand where the widening is being done. He also wants to make sure Mr. Roger
Muir’s safety concerns are addressed. Public Works Director said Moody Road needs to be widened
on both sides of the road. On the Walmart side they required Walmart to obtain right of way and to
widen the road to the north; however on the south side of the road the City doesn’t have adequate
right of way to widen it. The City will either need to purchase right of way or wait until it develops
and put the burden on the developer. The west side of the road has a bridge that goes over a ditch;
the bridge will need to be widened. The City has very limited right of way on the west side. Public
Works Director Millar said when and if the bridge is widened they will need to install sewer lines
before the widening takes place.
City Attorney Zollinger clarified the safety concerns at the intersection of North 2nd East and
Moody Road. The north south traffic is not affected except when a semi-trailer is trying to make a
right turn off of 2nd East. He said the main concern at this time is to get the road striped so the
vehicles are in the correct lane when they interface each other. The striping of the intersection will
address the majority of the traffic problems. He stated the right turn traffic movement coming off of
2nd East on to Moody Road will need to be evaluated. When the signal light is installed it will also
help with how the traffic flows at this intersection.

Council Member Wolfe asked if using temporary traffic cones will help to clarify which lanes need
to be used. Public Works Director Millar said the current issue with the southbound traffic is
Walmart had striping done for a left turn. The City’s portion of the left turn hasn’t been striped
which causes the thru traffic to be head on into the existing left turn lane. He indicated the traffic
cones should help in directing the traffic to the east until the City’s portion gets striped.
B. Finance Department: – Finance Officer Matthew Nielson
Finance Officer Nielson reported he didn’t include the regular month end reports because
he is finishing up year-end adjustments. He did include a summarized budget report for the
year to compare what each department spent compared to their budgets.
Finance Officer Nielson reviewed the General Fund Balance Carryover Report on the
overhead screen.
Finance Officer Nielson said they added $224,400.00 in the General Fund after the
$185,000.00 transfer was added and set aside in case the Rexburg/Madison Airport is moved
to a different location. He indicated the City is at about 31.3% in budget. The City’s budget
should be maintained between 33% and 35%.
Finance Officer Nielson referred to the General Fund Transfers-Subsidies Report. He
included this report to show that other subsidies are funded by the general fund.

Council Member Wolfe asked about Planning and Zoning being subsidized by the General
Fund. He asked if the reason for the subsidy was because they don’t have sufficient funds
from the building permits. Finance Officer Nielson indicated the funds generated by the
building permits is kept in the Community Development Fund. The Community
Development fund is used to fund the Building Department expenses not the Planning and
Zoning expenses.
Finance Officer Nielson also reviewed the Street Fund for Fiscal Year 2015 year-end. He
listed the funds associated with public works. The carryover is about $916,000.00; however
there is $616,000.00 in receivable; most of these funds will be used for the curve on 2nd West
and 1st North. Urban Renewal will pay back the City as funds become available or when the
property sells. The Operating Fund has about 5.7 million dollars and about 1.3 million
dollars in the Capital Reserve. He said most of the Operating Funds will be used to fund the
wastewater treatment plant. He said it is important for Public Works Director Millar to rebid
the project to get lower costs.
C. Community Development Director: Val Christensen
Community Development Director Christensen reviewed the Monthly Valuation Report.
He said the Homestead Assisted Living is the main item in the report. The report indicates

there is an estimated valuation of $6,828,054.21 and $55,196.00 in building permit fees.
There was about $72,000.00 brought in by impact fees.
Council Member Mann asked if there are any new developments at the new Walmart
location. Community Development Director Christensen said he is not aware of any new
developments.
