ORDINANCE NO. 112
AMENDING CHAPTER 1, PART 11, OF THE REVISED ORDINANCES
OF THE CITY OF REXBURG, PRESCRIBING RULES AND ORDER OF
BUSINESS FOR THE PROPER GOVERNMENT OF THE CITY
COUNCIL.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
REXBURG, COUNTY OF MADISON, STATE OF IDAHO:
SECTION I: That the following rules and order of business be adopted for the guidance
and control of the Council and Officers of the City of Rexburg.
Rule 1. — The Mayor or any three of the Council may call a special meeting of the Council by
and in manner giving sufficient notice.
Rule 2. — At the hour provided for meetings, the Council shall be called to order by the
Mayor, and the Clerk shall proceed to call the role and note the absentees whereupon the
Mayor shall announce whether or not a quorum is present.
Rule 3. — If it shall appear that a quorum is present the Council shall proceed to business,
which shall be conducted in the following manner:
1. — Reading, correcting and approving the minutes of the preceding meeting.
2. — Reading petitions, memorials, remonstrance's and other communications.
3. — Reports of officers.
4. — Reports of standing committees.
5. — Reports of special committees.
6. — Reading of bills.
7. — Reading and passage of ordinances.
8. — Unfinished business
9. — Motions, resolutions and miscellaneous business.
10. — In case of no quorum, the Clerk may adjourn the meeting from day to day until a
quorum is present.
Rule 4. — All questions relating to priority of business shall be settled by the Mayor without
debate by the members of the Council.
Rule 5. — All resolutions shall be reduced to writing and when read a motion for adoption of
the same may be made, whereupon, if such motion be seconded, such resolution shall be
open for consideration, and may be adopted in whole or in part. No resolution can be
withdrawn after a motion for its adoption has been made and seconded, except by the
consent of the party seconding the same.
Rule 6. — Every member shall be required to vote on all questions unless excused by the
Mayor, and any member may call for the yeas and nays.
Rule 7. — All elections to office authorized by law to be made by the Council, shall be by
ballot, and a majority of all the members elect shall be necessary to a choice.
Rule 8. — All committees shall be appointed by the Mayor.
Rule 9. — Standing committees shall be appointed at the first regular meeting following the
regular City election, for the following purposes to -wit:
1. —judiciary.
2. — Law, order and Sanitary Regulations.
3. — Finance and Printing.
4. — Irrigation.
5. — Streets, Public Grounds, Cemetery and Improvements.
6. — Waterworks and Fire Department.
Rule 10. — The Mayor shall preserve, order and decorum and decide questions of order
subject to an appeal to the Council.
Rule 11. — Every member previous to his speaking shall rise from his and respectfully
address the Mayor and remain standing in his place before proceeding to speak, until he is
recognized by the Chair.
Rule 12. — When two or more members rise at once, the mayor shall designate the member
who is first to speak.
Rule 13. — No motion shall be debated or put unless the same be seconded; it shall be stated
by the Mayor before the debate, and any motion shall be reduced in writing if the Mayor or
any member desire it.
Rule 14. — After a motion shall be stated by the Mayor, it shall be deemed the property of
the house, but may be withdrawn by unanimous consent.
Rule 15. — When a question is under debate, no motion shall be received but to adjourn, to
lay on the table the previous question, to postpone to a day certain, to commit, to amend, to
postpone indefinitely, which several motions shall have precedence in the order named.
Rule 16. — A motion to adjourn shall always be in order, except when a member is
addressing the Chair, or a vote is being taken.
Rule 17. — The following questions shall be decided without debate; to adjourn, to lay on the
table, to suspend the rules, any question in regards to the order of business, withdrawing a
motion, or taking any business out of its proper order.
SECTION II: All ordinances and parts of ordinances in conflict herewith are hereby
repealed.
