ORDINANCE NO. 218
AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING THE
ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT
NUMBER TEN OF THE CITY OF REXBURG, MADISON COUNTY,
STATE OF IDAHO.
WHEREAS, at an adjourned meeting of a regular meeting of the City Council of the City of
Rexburg, Madison County, Idaho, held on the 11`h day of July, 1917, there was presented to the
council a petition in writing signed by seventy per cent of the resident owners of property within the
proposed limits of a proposed local improvement district, said signers of said petition being owners
of property subject to assessment for the improvements petitioned for, requesting the grading,
cubing, paving, parking, surface drainage and other improvements of Main Street and part of Third
East Street in said city; and,
WHEREAS, said petition requested the organization of a local improvement district for the
purpose of constructing and carrying to completion the said improvements; and in which said
petition the expense of all improvements in the space formed by the junction of two or more streets
or wherein one main street terminates in or crosses another main street, (except the street crossings
or cross - walks), to be assessed upon the abutting, contiguous and tributary lots and lands and lots
and lands included in said proposed improvement district, each lot and parcel of land to be
separately assess for the full debt thereof in proportion to the number of feet of such land and lots
fronting thereon or included in said proposed improvement district, and in proportion to the
benefits derived to such property by said improvement, sufficient to cover the total cost and
expense of the work to the center of the street and,
WHEREAS, said petition was referred to the committee of said council called the
committee on roads and bridges and the city's engineers, for the purpose of ascertaining if the
required number of resident owners of property subject to assessment, in accordance with the
prayer of the petition on the organization of said proposed district, had signed the same; and
WHEREAS, the said committee and said engineers reported to the council that said petition
contained more than the required number of property owners to authorize the council to proceed
and, which said petition was thereupon approved by the said council; and
WHEREAS, upon the hearing upon the resolution of intention to create said local
improvement district, the said petition was again examined, checked and found to contain more than
the required number of signers to authorize the said council to proceed to the organization of said
local improvement district for the purposes prayed for in said petition; and
WHEREAS, thereafter proceedings were had to organize the said improvement district and
construct the work therein as prayed for in the said petition and as described in the resolution of
intention and ordinance organizing the said improvement district; and,
WHEREAS, an assessment roll has been prepared fixing the amounts, respectively, which
each lot and parcel of land abutting, contiguous and tributary and included in the said improvement
district shall pay, and has been presented to and filed with the said clerk, a hearing had thereon and
said council is now called upon to approve and confirm the said assessment roll; and,
WHEREAS, upon receiving said assessment roll the city clerk gave paper of said city, and
that the council would hear and consider protests against and objections to said assessment roll on
the 26`' day of August, 1918, at a meeting to be held on said day; and proof of publication of said
notice has been filed; and, whereas, neither prior to, nor at the time appointed for said hearing were
objections made to said assessments or any part of said assessment roll;
THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF REXBURG, IDAHO:
SECTION I — The assessment roll heretofore prepared assessing the cost and expense of
improvements constructed in Local Improvement District No. 10 of the City of Rexburg, Idaho, is
hereby wholly approved, ratified and confirmed.
PASSES BY THE CITY COUNCIL THIS 26TH DAY OF AUGUST, 1918, AND
REFERRED TO THE MAYOR FOR HIS APPROVEL.

of the City of Rexburg, Madison County, State of Idaho", passed by the City Council of the City of
Rexburg, Idaho, on the 26h day of August, 1918, and approved by the Mayor of the City of
Rexburg, Idaho, on the 26" day of August, 1918.
