ORDINANCE NO. 215
AN ORDINANCE CONFIRMING THE CREATION AND
ESTABLISHMENT OF RURAL IMPROVEMENT DISTRICT NO. 9 IN
THE CITY OF REXBURG, IDAHO, APPROVING THE ASSEMENT
ROLL FOR SAID DIST. AS FILED IN THE OFFICE OF THE CITY
CLERK ON THE 25TH DAY OF OCT. A.D., 1917 AND ACCEPTED,
APPROVED AND CONFIRMED BY THE COUNCIL ON THE 23PD DAY
OF NOV. A.D., 1917, PROVIDING FOR THE PAYMENT BY
INSTALLMENTS OF THE COSTS AND EXPENSES OF THE
IMPROVEMENTS MADE IN SAID DIST., PROVIDING FOR THE
ISSUANCE OF IMPROVEMENT BONDS OF THE DIST. ASSESSING A
SUM OF THE COST OF SAID IMPROVEMENTS AGAINST THE LOTS
AND PARTS OF LOTS, BLOCKS, AND PARCELS OF LEVIED IN SAID
DIST. FRONTING OR ABUTTING ON CONTIGUOUS OR TRIBUTARY
TO SAID IMPROVEMENTS IN PROPORTION TO THE BENIFITS
AND DESCRIBING THE MANNER FOR THE COLLECTION AND
PAYMENT OF SAID ASSESSMENTS.
WHEREAS, The City Council of the City of Rexburg, County of Madison, State of Idaho,
has heretofore, pursuant to the requisite preliminary proceedings and Ordinance No. 206 adapted
on the 21' day of April, 1917, A.D. and approved the same day, establishing Local Improvement
District No. 9, in said city for the purpose of grading, curbing, paving and for the construction of
sidewalks, crosswalks and street crossings and surface draining certain streets and parts of streets in
said city and district; and
WHEREAS, The Committee on streets, together with the City Engineers, have heretofore in
street conformity with the law and the ordinances of said city, made out an assessment roll in and
for said Local Improvement Dist. No. 9, and certified the same to the City Council, fixing the total
cost of the improvements therein at the sutra of Eighty-one Thousand Nine Hundred Thirty Five
and 28/100 Dollars ($81,935.28) of which said sutra One Thousand Four Hundred Eighty-five and
64/100 ($1,485.64) is apportioned to and to be paid by the City of Rexburg, and assessing the
balance of said sum amounting to Eight Thousand Four Hundred Forty Nine and 67/100 Dollars
($80,449.67) against the lots and parts of lots, blocks and parcels of lands fronting or abutting upon,
contiguous or tributary to said improvements in said district in proportion to the number of feet of
such lands and lots fronting thereon or abutting, contiguous or tributary thereto, and included in
said improvement district and in proportion to the benefits derived by said improvement which
assessment roll has been heretofore duly ratified, approved and confirmed by order of the City
Council made and entered on the 23d day of November, A.D. 1917, and
WHEREAS, upon receiving the said assessment roll, the clerk of said city gave notice by
three successive publications in the official newspaper of said city that such assessment roll was on
file in his office and date of filing same, and stating the time at which the council would hear and
consider objections to said assessment roll by the parties aggrieved by such assessments; and
WHEREAS, neither prior to nor at the time appointed for hearing objections to such
assessments, have objections made to the assessments so levied and no one approved to protest
against said assessments not to the regulating of the proceedings in making the same, or the
correctness thereof, or the amount levied on any particular lot or parcel of land, or as to any other
matter in relation thereto or at all, and
WHEREAS, it is the opinion of the Mayor and City Council of said city that the cost and
expense of the improvements made in said Local Improvement District No. 9, which is chargeable
to the abutting, adjoining, contiguous or approximate property, should be provided for and paid for
by installments instead of levying the entire tax or special assessments for such costs at one time;
and
WHEREAS, the Mayor and City Council of said city desire to issue in the name of the city,
improvement bonds of the Dist. To bear date the First day of January, A.D. 1918, payable in ten
installments of equal amounts each year, each installment of bonds maturing in the respective years
annually from 1919 to 1928 inclusive
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE CITY OF REXBURG, IDAHO;
SECTION I — That all proceedings, matters and things heretofore taken had and done in
connection with the establishment of Local Improvement Dist. No. 9, in the City of Rexburg, Idaho
the construction therein of improvements, consisting of a grading, curbing, paving and construction
of sidewalks, crosswalks and street crossings and surface draining of certain streets and parts of
streets in said city, and apportionment of the cost of said improvements against the lots, parts of
lots, blocks and parcels of land in said district by and the same are hereby in all respects fully
approved ratified and confirmed.
SECTION II — That the cost and expense of said improvements consisting of grading,
curbing, paving and construction of sidewalks, crosswalks, and street crossings and surface draining
certain streets and parts of streets in said city of Rexburg, within the boundaries of Local
Improvement Dist. No. 9 which is chargeable to the abutting, adjoining, contiguous or approximate
property _ paid for by installments consisting of the equal installment payable as provided by in
each of the years 1919 to 1928 inclusive.
SECTION III — That there be issued in the name of the City of Rexburg, improvement
bonds of said Local Improvement Dist. No. 9 in the aggregate principal amount of Eighty
Thousand Four Hundred Forty Nine and 64/100 Dollars ($80,449.64) less the aggregate amount
paid in by property owners by way of redemption on or before the le day of January A.D. 1918,
and shall bear interest at the rate of seven per cent per annum, payable semi - annually on the First
days of January and July in each year said interest to be evidenced by coupons attached to said
bonds, said bonds shall be numbered from one (1) upwards, consecutively shall be denominations of
Five Hundred Dollars each, except the last bond of each series which may be in such suitable
amount as may be required to make the total issue confine to the amount hereby authorized, and the
total issue hereby authorized shall be divided into ten series, each series consisting of one -tenth of
the total issue, and each series maturing in the respective years annually from 1919 to 1928 inclusive,
said bonds and the coupons thereto attached shall be payable at the office of the City Treasurer of
the City of Rexburg or at the Federal Reserve Bank in the City of New York, USA at the office of
the holder, said bonds shall be signed by the mayor and attested by the city clerk and countersigned
by the city treasurer of the City of Rexburg, Idaho, and shall have affixed thereto the corporate seal
of said city, all coupons shall bear the engraved facsimile signatures of the mayor, city clerk and city
treasurer of said city, and when so executed shall constitute the binding obligation of said district for
said interest.
SECTION IV — That said bonds and the coupons thereto attached, as authorized by this
ordinance, shall be in substantially the following form.

The City of Rexburg, in the County of Madison, State of Idaho, for value received, hereby
promises to pay to the bearer the sutra of dollars in lawful money of the
United State of America, on the preservation and surrender of this obligation, on or before the First
day of January A.D., Nineteen Hundred and with interest thereon from the date thereof
until paid at the rate of seven per centum per annum, payable semi - annually in like medium on the
First day of January and the First day of July in each year on the presentation and surrender of the
proper coupons hereto attached, both principal and interest payable at the office of the City
Treasurer of Rexburg, or at the Federal Reserve Bank in the City of New York, USA, at the option
of the holder.
This bond is one of a series for the payment of the cost and expense for Local street
improvements in said Local Improvement Dist. No. 9, as authorized by Section 2238 of the Revised
Codes of the State of Idaho, passed at the 13`s session of the State Legislature and as amended by
Chapter 22 of the General law of the state of Idaho, passes at the 14'h session of the State
Legislature and all other amendments and laws thereunto enabling, and in conformity with said law
it is hereby recited that the holder of any bond issued makes the authority of this section shall have
no claim therefor against the city of village by which the same is issued, in any event except from
collections of the special assessment made for the improvement for which said bond has issued, but
this remedy in case of non - payment, shall be confined to the enforcement of such assessments
powers.
In testimony whereof the City Council of the City of Rexburg has caused this bond to be
signed by the mayor of said city, attested by the clerk thereof, under the seal of the city and
countersigned by the City Treasurer as of the First day of January, A.D., 1918.

option of the holder, beating six months interest on Local Improvement District No. 9,

SECTION V — That said bonds, when executed, shall be issued to the contractor
constructing the improvements in said Local Improvement District No. 9, in payment thereof, and
when so issued shall transfer to the contractor or any owner or holder thereof all the right and
interest of the City of Rexburg, in and with respect to every assessment against the property in said
District liable to assessment for such local improvement and the lien thereby created against the
property of such owner assessed as shall have not availed themselves of the provisions of law in
regard to the redemption of their property, from the lien of such assessment and shall authorize said
contractor and his assign and the owners and holders of said bond to receive, send for and collect or
have collected such assessment embraced in any such bond, or through any of the methods
provided by law for the collection of assessments for local improvements; and the City of Rexburg,
hereby pledges to such bond holders the exercise of all lawful corporate powers in the collection of
the assessments levied for the payment of such bonds,
SECTION VI — That the whole cost of the improvements made in said Local
Improvement District No. 9, and the apportionment of the same as set forth in the assessment roll
made out according to the provisions of said Ordinance No. 206, adopted April 21, 1917, as filed in
the office of the City Clerk October 25`s, 1917, is hereby assessed against all the real estate in said
district and to and upon each lot or tract of land in said district against such persons and in the
proportions and amounts severally set forth in said assessment roll and as follows, to -wit;

SECTION VII — That said assessments together with the interest thereon at the rate of
seven per cent per annurn from the first day of January A.D., 1918, being the date of the district
bonds authorized by this ordinance until the maturity of the installments of said bonds are hereby
declared to be a lien in the several amounts assessed against each lot or tract of land levied before
described from and after the final publication of this ordinance and shall have priority over all other
liens except general taxes.
SECTION VIII — The owner of piece of property liable for any special assessment herein
made and provided for, may redeem his property from such liability by paying the entire assessment
chargeable against his property in the manner now provided by law.
SECTION IX — Whereas, The City Clerk has heretofore published and caused to be
printed in the official weekly newspaper of said City of Rexburg a notice stating in substance that the
bonds of Local Improvement Dist. No. 9 authorized and provided for in this ordinance are about to
be issued and which said notice also stated that the owner of any piece of property liable for any
special assessment as in said assessment roll made and herein rectified, might redeem his property
from such liability by paying the entire assessment chargeable against this property at any time
between the 14' day of December A.D., 1917 and the 14" day of January A.D., 1918, the date first
mentioned being the first day on which such assessment could be paid; and the last date mentioned

if payment should be made before the issuance of the bond, no penalty interest or costs would be
collected and further stated that all payments should be made to the City Clerk who
should receipt therefor on all sums so paid in said Local Improvement Dist. No. 9, should be
applied to the redemption of the bonds issued therefor. Now, therefore, the publication of said
printed notice heretofore made by the City Clerk as evidences by the affidavit of publication thereto
on file in said City Clerk's office is wholly approved ratified and confirmed.
SECITON X -The City Council or other lawfully authorized taxing officers of the City of
Rexburg, shall, for the purpose of ratifying and confining the assessment hereby made, levy special
assessments each year hereafter sufficient to redeem the installments of bonds with interest next
thereafter maturing as issued pursuant to the provisions of the ordinance and in computing the
assessment of special assessments to be thus levied against each piece of property liable therefor,
interest at the rate of seven per cent per annum from the date of the issuance of said bond until the
maturity of the installments of said bonds next thereafter maturing shall be included in such levies.
SECTION XI — This ordinance shall be in force and take effect upon its passage and
approval and upon publication in the Rexburg Standard, the official newspaper of said city.
