AN ORDINANCE AMENDING ORDINANCE NO. 469 OF THE CITY OF REXBURG, IDAHO, REGULATING
ELECTRICAL SdIRING AND EQUIPMENT BY.T,.E ADDITION THERETO OF SECTIONS 14 AND 15 PROVIDING
FOR THE CREATION OF A BOARD OF REGISTRATION AND REVIEW AND PROVIDING FOR THE DUTIES AND
AUTHORITY OF THE BOARD OF REGISTRATION AND REVIEW, AND REPEALING ALL ORDINANCE OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THE ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO:
SECTION I: That Ordinance No. 469 regulating electrical wiring and equipment
be amended by adding the following sections:
Section 14: BOARD OF REGISTRATION AND REVIEW.
A. There is hereby created a "Board of Registration and Review," which shall
consist of six members appointed by the Mayor and City Council as followss Two representatives
of firms or corporations engaged in the business of electrical contracting aid licensed
by the State of Idaho and the City of Rexburg; two Journeymen Electricians licensed
by the State of Idaho and the City of Rexburg; the City of Rexburg Electricial inspector
and one from an electric utility servicing the City. 1he Electrical Inspector shall
serve as ex- officio, with voice, but without vote. Of the members first appointed,
one shall be appointed for a term of two (2) years, one shall be appointed for aterm
of three (3) years, two shall be appointed for a terra of four (4) years. Thereafter,
appointments shall be made for a three year terra, as the term expires. The Electrical
Inspector and the member from the electric utility shall be considered-as members of
this Board at all times. All members shall serve until their successors are appointed
and confirmed.
B. Any loard member may, for cause and after hearing, be removed from the
membership on the Board by the Mayor and Council.
Section 15: DUTIES, AUTHORITY OF BOARD OF REGISTRATION AND REVIEW:
A. The Board shall annually elect a Chairman and Vice - Chairman. -(he Bloard
shall adopt reasonable rules and regulations for conducting its meetings, hearings,
and examinations. The Electrical Inspector shall act as Secretary of the Board and all
minutes and records of the Board shall be filed in the office of the Electrical Inspector.
Such records may be destroyed by the Board after they have become seven (7) years old.
Meetings of the Board shall be held at least once annually or at the call of the
Chairman and at such times as the Board may determine.
B. Three (3) voting members of the Board present at any meeting shall constitute
a quorum for the conducting of any business that may come before the Board. Meetings of
the Board shall be open to the public.
C. The Board shall have the authority to modify its rules of procedure within
the scope of this Ordinance, and shall recommend to the Mayor and Council, such changes
in this Ordinance as it shall deem necessary or desirable.
D. Upon complaint of the Electrical Inspector, by affidavit by any other persons
and after hearing thereon, the Board shall have the authority and they are hereby empowered
to suspend for a period of not more than sixty (60) days or to revoke any license at any
time for violations of this Ordinance or any regulations issued in connection herewith,
or for any other good and sufficient cause by the affirmative vote of three (3) members
of the Board. Any Suspended or revoked license shall be immediately surrendered to the
Board.
E. Any person, firm, or corporation may register an arguement with the Board of
Registration and Review ofr the review of any decision of the Electrical Inspector or
his assistants when such review of decision is requested in writing and accompanied by
a certified check in the amount of ten dollars ($10.00) in favor of the City of Rexburg
Treasurer. Any such request for review of a decision of the Electrical Inspector must
be made in writing to the Board within ten (10) days after receipt of of such decision.
F. The Board shall immediately, after every meeting of the Board, or within
five (5) days, submit to the City Electrical Inspector, its findings as to the qualifications
of each applicant for license or its decision regarding the review of any decision requested unde
the provision of this Section.
G. Any person, firm, or corporation or applicant dissatisfied with the findings
or decision of the Board of Registration and Review, amy within ten (10) days after
receipt of notice of such findings or decision, appeal in writing to the City Council
of the City of Rexburg, The decision of the City Council in the matter of such appeals
shall be final.
SECTION II: All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION III: This ordinance shall be in full force and effect after its
passage and publication as provided by law.
PASSED by the City Council of the City of Rexburg, Idaho, this 5th day of
December, 1973.
