AN ORDINANCE PROHIBITING THE SALE, INGESTION OR INHALATION OF CHEMICAL SUBSTANCES FOR
THE PURPOSE OF CAUSING A CONDITION OF INTOXICATION, INEBRIATION, EXCITEMENT, STUPEFACTION
OR DULLING OF THE BRAIN OR NERVOUS SYSTEM.
WHEREAS, the Constitution of the State of Idaho, empowers cities and municipalities
to make and enforce all such local police regulations as are not in conflict with the
general laws; and
WHEREAS, the Rexburg City Council desires to prevent the sale, ingestion or
inhalation of chemical substances having the property of releasing toxic vapors or
fumes in order to promote the health, safety and welfare of the residents of the City
of Rexburg, State of Idaho.
NOW, THEREOFRE, BE IT ORDAINED BY THE CITY COUNCIL IN AND FOR THE CITY OF
REXBURG, STATE OF IDAHO:
Section 1. CHEMICAL SUBSTANCES
It shall be unlawful for any person for the purpose of causing a condition
of intoxication, inebriation, excitement, stupefaction or dulling of brain or nervous
system to intentionally sell, ingest or inhale the fumes of any chemical substance containing
a solvent_ or chemical compound having the property of releasing toxic vapors of fumes.
Section 2. RESPONSIBILITY OF OTHER PERSONS
It shall be unlawful for any person by any act or neglect to encourage, aid or
cause any person .under the age of eighteen (1$) years to come within the preview of
this ordinance.
Section 3. PENALTY
Violation of this ordinance shall be punishable by imprisonment in the Madison
County Jail for a period not to exceed six 06) months or by a fine not to exceed $300.00,
or by both such imprisonment and fine.
PASSED by the City Council of the City of Rexburg, Idaho, this 4th day of
October, 1972.
APPROVED by the Mayor this 4th day of October, 1972.
