HomeMy WebLinkAboutORDINANCE NO. 514 PARKING METER VIOLATIONSORDINANCE NO. 514 AN ORDINANCE AMENDING AND CHANGING ORDINANCE NO. 355, SECTION 9, CHANGING THE PENALTY FOR PARKING METER VIOLATIONS TO $.50 FOR EACH HOUR AND PROVID- ING THAT UPON FAILURE TO REPORT AND MARE SUCH PAYMENTS WITHIN TWENTY -FOUR HOURS, THE OWNER OR OPERATOR SHALL BE SUBJECT TO FINE AS PROVIDED BY SECTION 1 ORDINANCE NO. 512; AND AMENDING SECTION 11 OF ORDINANCE NO. 355 TO PROVIDE THAT EACH PERSON WHO VIOLATES OR FAILS TO COMPLY WITH THE PRO- VISIONS OF ORDINANCE NO. 355 AS AMENDED, SHALL BE PUNISHED BY FINE AS PROVIDED IN SECTION 1 ORDINANCE NO. 512, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO: SECTION I. That Section 9, Ordinance No. 355, of the City of Rexburg, Idaho, be amended to read as follows, to -wit: "Section 9. It shall be the duty of each police officer observing a violation - of the provisions of Section 4, or Section 5, or Section 6.of this ordinance to leave at or upon such vehicle a notice that the vehicle has been parked in violation of the provisions report to the police department, or to the Magistrates Court of the City in regard to such violation. It shall be the duty of such police officer to leave at or upon such vehicle a separate notice for each hour, or fraction thereof, that such vehicle remains parked in violation of the provisions of Section 4 or Section 5, or Section 6. Each such owner or operator, may within twenty -four hours of the time of such notice, pay to the police department as a penalty for, and in full satisfaction of, such violation, the amount of $.50 for each hour, or fraction therof, that such vehicle was parked in violation of the provisions of Section 4, or Section 5, or Section 6. The failure of such owner or operator to report and make such payment to the police department within said twenty -four hours shall render such owner or operator subject to the fine provided for in Section 1, Ordinance No. 512. "The notice above mentioned, shall be made and numbered in triplicate, and it shall be the duty of each police officer to file one copy of such notice with the police department, and to file one copy of such notice with the City Clerk of the City of Rexburg. It shall be the duty of the Chief of Police to file a complaint before the Magistrate against all persons who do not report and make payment to the police department within the above mentioned twenty -four hours. All money collected by the police department, for a violation of this ordinance, shall be paid over to the City Clerk of the City of Rexburg." SECTION II. That Section II, Ordinance No. 355 of the City of Rexburg, Idaho, be amended to read as follows, to -wit: "Section II. Every person who violates, or who fails to comply with any of the provisions of this ordinance, except as otherwise in this ordinance provided, shall be punished by fine as provided in Section 1, Ordinance No. 512." SECTION III. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION IV. This ordinance shall be in full force and effect on and after April 1, 1971.
