HomeMy WebLinkAboutORDINANCE NO. 593 UNIFORM NATIONAL FORMORDINANCE NO. 593 AN ORDINANCE TO REGULATE ELECTRICAL WIRING AND EQUIPMENT INSTALLED WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG, IDAHO, EXCEPT WIRING AND EQUIPMENT WHICH IS USED FOR THE GENERATION, CONTROL, DISTRIBUTION OR COMMUNICATION OF PUBLIC UTILITIES, AND TO BE KNOWN AS THE CITY OF REXBURG, IDAHO, ELECTRICAL CODE; OFFICE OF ELECTRICAL INSPECTOR AND SETTING FORTH THE QUALIFICATION AND DUTIES OF THE OFFICE; JURISDICTION OF ELECTRICAL INSPECTOR, AUTHORITY TO DISCONNECT; PROVIDING FOR THE ISSUANCE OF PERMITS TO INSTALL ELECTRICAL WIRING OR EQUIPMENT AND MAKING IT UNLAWFUL TO PERFORM WIRING PROCEDURES AND ELECTRICAL INSTALLATIONS, WITH SPECIFIED EXCEPTIONS, WITHOUT A PERMIT AND LICENSES, AND FIXING FEE SCHEDULES THEREFORE; ESTABLISHING STANDARDS FOR INSTALLATION OF ELECTRICAL EQUIPMENT AND WIRING: PROVIDING FOR ENFORCEMENT OF THE ORDINANCE AND FIXING PENALTIES FOR VIOLATIONS THEREOF; REQUIRING A CITY TRADE LICENSE: PROVIDING FOR MINIMUM SAFETY STANDARDS, SPECIAL REQUIREMENTS, ALTERATIONS TO CITY WIRING; ALSO PROVIDING THAT THE CITY SHALL NOT BE HELD AS ASSUMING LIABILITY BY REASON OF THE INSPECTION REQUIRED; PROVIDING FOR THE PENALTY FOR VIOLATIONS THEREOF: REPEALING ORDINANCE NO. 469 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCE IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG, IDAHO: Section 1. SCOPE OF CODE. The regulations of this code shall apply to all electrical wiring and equipment installed within the corporate limits of the City of Rexburg, except wiring and equipment which is used for the generation, control, distribution or communication system of a public utility and which is installed by or for, and owned and maintained by an electric or communication utility operating under due authority granted by the City. Electrical wiring in railway cars or automotive equipment is exempt from the requirements of this code. Section 2. MINIMUM SAFETY STANDARDS. Except as herein provided all installations of wires and equipment to convey electric current and apparatus to be operated by such current, made after the effective date of this code, shall be in substantial accord with the latest Edition of the National Electrical Code, as approved > I, ORDINANCE NO. 593 AN ORDINANCE TO REGULATE ELECTRICAL WIRING AND EQUIPMENT INSTALLED WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG, IDAHO, EXCEPT WIRING AND EQUIPMENT WHICH IS USED FOR THE GENERATION, CONTROL, DISTRIBUTION OR COMMUNICATION OF PUBLIC UTILITIES, AND TO BE KNOWN AS THE CITY OF REXBURG, IDAHO, ELECTRICAL CODE; OFFICE OF ELECTRICAL INSPECTOR AND SETTING FORTH THE QUALIFICATION AND DUTIES OF THE OFFICE; JURISDICTION OF ELECTRICAL INSPECTOR, AUTHORITY TO DISCONNECT; PROVIDING FOR THE ISSUANCE OF PERMITS TO INSTALL ELECTRICAL WIRING OR EQUIPMENT AND MAKING IT UNLAWFUL TO PERFORM WIRING PROCEDURES AND ELECTRICAL INSTALLATIONS, WITH SPECIFIED EXCEPTIONS, WITHOUT A PERMIT AND LICENSES, AND FIXING FEE SCHEDULES THEREFORE; ESTABLISHING STANDARDS FOR INSTALLATION OF ELECTRICAL EQUIPMENT AND WIRING: PROVIDING FOR ENFORCEMENT OF THE ORDINANCE AND FIXING PENALTIES FOR VIOLATIONS THEREOF; REQUIRING A CITY TRADE LICENSE: PROVIDING FOR MINIMUM SAFETY STANDARDS, SPECIAL REQUIREMENTS, ALTERATIONS TO CITY WIRING; ALSO PROVIDING THAT THE CITY SHALL NOT BE HELD AS ASSUMING LIABILITY BY REASON OF THE INSPECTION REQUIRED; PROVIDING FOR THE PENALTY FOR VIOLATIONS THEREOF: REPEALING ORDINANCE NO. 469 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCE IN CONFLICT HEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG, IDAHO: Section 1. SCOPE OF CODE. The regulations of this code shall apply to all electrical wiring and equipment installed within the corporate limits of the City of Rexburg, except wiring and equipment which is used for the generation, control, distribution or communication system of a public utility and which is installed by or for, and owned and maintained by an electric or communication utility operating under due authority granted by the City. Electrical wiring in railway cars or automotive equipment is exempt from the requirements of this code. Section 2. MINIMUM SAFETY STANDARDS. Except as herein provided all installations of wires and equipment to convey electric current and apparatus to be operated by such current, made after the effective date of this code, shall be in substantial accord with the latest Edition of the National Electrical Code, as approved by the American Standards Association, and as the National Electrical Code shall be amended, revised, compiled and published from time to time and as such amendments or revisions are adopted by the Council of the City of Rexburg. The City of Rexburg reserves the right to amend or change any part of the National Electrical Code when it is not in agreement with the provisions of this Ordinance as stated herein. Three (3) copies of the National Electrical Code as adopted shall be kept on file in the office of the City Clerk for use and examination of the public. Section 3. ELECTRICAL INSPECTOR. The Mayor is hereby authorized and directed to enter into an agreement with the Idaho State Electrical Board, Department of Law Enforcement, to furnish electrical inspection service to the City of Rexburg, as authorized by Sec. 54 -1001C of the Idaho Code. Electrical inspections made under such an agreement shall be made in accordance with this code by a duly appointed City Electrical Inspector acting as Electrical Inspector for the City of Rexburg. ELECTRICAL INSPECTOR - QUALIFICATIONS AND APPOINTMENTS: The person to fill this position shall be recommended for appointment by the Mayor and City Council. The person chosen to fill the position of Electrical Inspector shall be of good moral character, shall be possessed of such executive ability as is requisite for the performance of his duties and shall have a thorough knowledge of the standard materials and methods used in the installation of electrical equipment. He shall be well versed in approved methods of installation for maximum safety to persons and property and shall be familiar with all of the rules and requlations and statues of the State of Idaho, relating to electrical work, and with the National Electrical Code as approved by the American Standards Association, latest edition. He shall have had at least two years experience as an Electrical Inspector or two years experience as a licensed Journeyman Electrician. -2- Any Assistant Electrical Inspector shall be required to have had a minimum of at least two years experience as a licensed Journeyman Electrician. Section 4. ELECTRICAL INSPECTOR - DUTIES: The City of Rexburg Electrical Inspector is hereby authorized and directed to enforce all of the provisions of this Ordinance and to exercise his authority in a diligent manner to enforce complaince with the provisions of this Ordinance by all persons and installations which come within the scope of this Ordinance in the City of Rexburg. The Electrical Inspector or his duly appointed assistants, upon presentation of proper credentials, shall have the right, during reasonable hours, to enter any building or premises in the discharge of his official duties, or for the purpose of making any inspection, re- inspection, or test of electrical equipment contained therein or its installation in accordance with the provisions of this Ordinance. where any electrical equipment is found by the Electrical Inspector to be dangerous to persons or property because it is defective or is defectively installed, the firm, person or corporation responsible for the electrical equipment shall be notified in writing and shall be required to place such equipment in safe condition. In case of emergency, where in his judgment, it is necessary for the safety to persons or property, or where electrica equipment may interfere with the work of the Fire Department, the Electrical Inspector shall have the authority to immediately disconnect or cause disconnection of any electrical equipment. The electrical Inspector may delegate any of his authority to any of his assistants. The Electrical Inspector shall, upon receipt of appli- cation, make inspections of electrical installations and equipment as provided in this Ordinance. Complete records shall be maintain of all permits issued, all inspections made, and of all other official work or action in connection with the provisions of -3- this Ordinance. Section 5. PERMITS. (A) Any person, firm or corporation doing any wiring or making any electrical installations in any building, residence or otherwise, in the City of Rexburg, Idaho, shall make application for and secure a permit to do such work. No electrical wiring or electrical equipment shall be installed within or on any building, structure, or premises publicly or privately owned, nor shall any alteration or addition be made in any existing wiring system unless such work is done under the supervision of the holder of Electrical Contractor's licenses issued by the State of Idaho. EXCEPTION: OWNER'S WIRING PERMIT: The Electrical Inspector may issue an individual special owner's permit authorizing said in- dividual to install, alter, change or repair electrical wiring or equipment in, on, or about a single family dwelling of which said individual is the owner in which he resides or intends to reside, but not elsewhere, PROVIDED, that no electrical work authorized under such special owner's permit shall be done except personally by the owner to whom the permit is issued. Such owner shall not be required to have an electrical contractor's license, but shall be subject to all other provisions of this Ordinance. In any case, all work performed under a special owner's permit shall be subject to the same standards of safety and workmanship established by this Ordinance and shall be required to pass . inspection by the Electrical Inspector. Any violation of the provisions of this Ordinance by the holder of a special owner's permit or failure of such permit holder to install electrical wiring or equipment in accordance with this Ordinance shall be cause for cancellation of the special owner's permit and the holder thereof shall be liable for the penalty hereinafter provided for violations of this Ordinance. Q� On applying for permit, locations must be given by street and number (if available) and block and lot number. Electrical Inspector shall not plan or lay out any work, nor be held in any way liable for proper and safe installation of the work. The electrical Inspector may cancel said permit at any time if, in his judgment, the work is not being done in accordance with the provisions of this Chapter and the person doing such work refuses to correct same to so comply; and it shall be unlawful for said person to proceed further with such work until such time as he has complied with the provisions of this ordinance and the instructions of the electrical Inspector. Section 6. ELECTRICAL INSPECTION FEES. Fees for electrical permits are listed herein and such fees shall include the cost of at least two inspections by the Electrical Department. One inspection shall be made when the electrical work is "Roughed In ", and one when the work is completed. All electrical heating cable installations shall be inspected during construction process. All City electrical fees will follow the electrical fee schedule as prescribed by the State of Idaho as published in the pamphlet "Electrical Laws and Regulations - Idaho State Safety Bureau." The 1977 electrical fee schedule as set forth as follows: "ELECTRICAL LAWS AND REGULATIONS OF THE STATE OF IDAHO" "IDAHO STATE ELECTRICAL SAFETY BUREAU" published by Authority Department of Labor and Industrial Services Revised July 1, 1977 a. TEMPORARY SERVICES - $7.50 -- A Temporary Service is a service entrance which will be used for CONSTRUCTION PURPOSES ONLY and will be removed when the permanent service is installed. All other services are classified as permanent. b. RESIDENTIAL -- Service rated 100 ampere or less - $10.00 plus $2.00 for each room in which any wiring is installed. Service rated over 100 ampere to 200 ampere $15.00 plus $2.00 for each room in which any wiring is installed. Over 200 ampere $20.00 plus $2.00 for each room in which any wiring is installed. Included shall be all finished and unfinished rooms including -5- basements, residential garages and carports, etc. (Areas such as a combination kitchen- dining shall be counted as a room for each indicated use.) Apartment buildings, including 8 units or less each building come under this paragraph and each apartment shall be counted as an individual residence. WHEN THERE IS NO CHANGE IN SERVICE -- Extension or addition to an existing circuit $5.00. Installation of one new circuit $5.00. Installation of Sub -Feed panel or feeder and additional circuits same as residential for size and number of rooms wired. c. RESIDENTIAL ELECTRIC SPACE HEATING - 1 to 5 KW - $10.0.0 plus $3.00 for each 5 KW` or fraction thereof in excess of SKW. These fees are in addition to the fees for general wiring covered in Section (b). d. DOMESTIC PATER PUMPS $3.50 in addition to required residential fee. When separate from residential construction permit, $10.00. e. MOBILE HOMES - EACH CONNECTION OR RECONNECTION - Service rated 100 ampers, or less $10.00 plus $5.00 each additional feeder or branch circuit connected at same time as Mobile Home. Services over 100 ampere $15.00 plus $5.00 each additional feeder or branch circuit connected at same time as Mobile Home. f. OTHER INSTALLATIONS INCLUDING INDUSTRIAL AND COMMERCIAL - The Inspection fees listed in this paragraph shall apply to any and all electrical installations not specifically mentioned elsewhere in this schedule. The wiring cost shall be the cost to the owner of all labor charges and all wiring materials and equipment installed as part of the wiring system. When labor is performed by the owner for uniformity of fee such labor cost shall be based upon the market value of said labor and used or reused materials shall be based at 50% of new retail cost or actual cost whichever is greater. The value of factory installed wiring, switches, and controls on equipment shall be included in wiring costs and paid through the permittee by those furnishing such equipment. Motors, appliances, and utilization equipment (except light fixtures) need not be included. APARTMENT BUILDINGS with 4 or more dwelling units in a building come under this schedule for each building. MOBILE HOME PARKS Distribution wiring including pedestal or service is under this section. NOTE: This does not include or permit the connection of the mobile home. See Section (e). Recreation Vehicle parks, service conductors, distribution and lot supply to individual units come under this schedule plus $3.00 per lot. WIRING COST not exceeding $100 -- $10.00. WIRING COST over $100 not exceeding $1000 - $10.00 plus 2% of total wiring cost.. WIRING COST over $1000 not exceeding $10,000 -- $30.00 plus 1% of that portion of the wiring costs exceeding $1000. WIRING COST over $10,000 - $135.00 plus # of 1% of that portion of wiring costs exceeding $10,000. g. WATER PUMPS, EACH MOTOR -- to 5 HP - $10.00 5 to 10 HP - $15.00 11 to 25 HP - $18.00 26 to 50 HP - $19.00 51 to 75 HP - $20.00 76 to 100 HP- $21.00 101 to 125 HP- $22.00 126 to 150 HP- $23.00 151 to 175 HP- $24.00 176 to 200 HP- $25.00 201 to 300 HP- $29.00 Over 300 HP- $29.00 plus $5.00 per 100 HP over 300 h. ELECTRICALLY DRIVEN IRRIGATION MACHINE -- Center Pivot $15.00 plus $5.00 per tower or drive motor. Other types $15.00 plus $5.00 per motor. Note: The electric supply to the irrigation machine shall be in addition to above and according to Section (f). i. ELECTRIC SIGNS AND OUTLINE LIGHTING -- Electric Signs $7.50 plus $.15 per sq. ft. measured on one side. Outline lighting $7.50 plus $.03 per ft. of tubing. j. REQUESTED INSPECTIONS OF EXISTING WIRING -- $16.00 minimum for 1 hour or less. Over 1 hour $16.00 plus $8.00 for each 1/2 hour or portion thereof in excess of 1 hour including travel time. k. REINSPECTION -- When corrections have not been made in prescribed time and an extension has not be required and granted, $12.50. 1. REINSPECTION - Fee for permits not clearly giving location of installation either by directions or maps, $12.50. M. NO PERMIT - Failure to send permit and fee in prescribed time double fee. n. PLAN CHECKING FEE - $15.00 minimum for 1 hour or less. Over 1 hour $15.00 plus $7.50 for each 1/2 hour or portion thereof in excess of 1 hour. Section 7. SPECIAL WIRING METHODS REQUIRED: In order to safeguard life and property, the City of Rexburg shall have the authority, by resolution, to require that certain wiring methods such as enclosing wiring system, shall be installed in certain locations and that certain wiring methods, such as open wiring or other methods of wiring shall not be permitted in those locations. Electrical Inspector shall be required to enforce all such and regulations, which shall thereafter be considered as part this ordinance. -7- Enclosed wiring in approved metal raceways shall be required in any buildings open to the public, such as churches, schools, hospitals, hotels, motels, stores, theaters, commercial buildings, storage garages, industrial and manufacturing buildings or warehouses, and any buildings containing multiple dwelling occupancies of four or more units located any place within the City of Rexburg. Number 12 AWG wire shall be the minimum size conductor used in these installations. Number 12 AWG wire shall be the minimum wire size used in Residential Home Construction. All buildings, of any kind, located within the Fire District shall have installed metal raceway (enclosed wiring). Section 8. ALTERATIONS TO EXISTING WIRING. When extensions and /or alterations are made to any electrical circuit in or on any building or structure, coming under the provisions of this code, which said circuit was not originally installed in a manner complying with the provisions of this code, and /or the ordinances of the City of Rexburg, said electric circuit, in its entirety, shall be made to conform to such provisions of this code as are particularly applicable thereto. Section 9. STATE LICENSE REQUIRED. (a) Except as herein provided it shall be unlawful for any person to perform or supervise the actual physical work of installing electric wiring or equipment to convey electric current unless such person holds a valid State of Idaho Journeyman Electrician's License, issued by the Idaho State Electrical Board, Department of Law Enforcement. (b) Except as herein provided it shall be unlawful for any person, partnership, company, association or corporation to engage in the business of installing electrical wires or equipment to convey electric current or to enter into agreements to install such wires or equipment without a valid electrical contractor's license issued by The State of Idaho and a City Business License. I li •c EXEMPTIONS: The licensing provisions of this section shall not apply to persons making electrical installations on their own property, to apprentice electricians working the direct, on- the -job, supervision of licensed journeyman electricians. A person not the sole owner of the property may not do his own electrical installation. Section 10. LIABILITY OF CITY. This code is not to be construed to relieve from or lessen responsibility or liability of any party owning, operating, controlling, or installing any electrical wiring or equipment, for damages to person or property caused by any defects therein, nor shall the city be held as assuming any such liability by reason of the inspection required herein. Section 11. PENALTY FOR VIOLATIONS. Any person, firm or cor- poration who shall violate the provisions of this code, or neglect or refuse to comply with any order or notice made by the electrical inspector pursuant to the provisions of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine of not less than Twenty -Five Dollars and not more than Three Hundred Dollars. Section 12. All other ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 13. This code shall be in full force and effect from and after its passage, approval and full publication.
