HomeMy WebLinkAboutORDINANCE NO. 637 LICENSESORDINANCE NO. 637 AN ORDINANCE REPEALING ARTICLE II AND ARTICLE IV OF ORDINANCE NO. 283, AND ESTABLISHING AND FIXING LICENSE FEES FOR OCCUPATIONS, TRADES, BUSINESSES, PROFESSIONS AND VOCATIONS WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG, IDAHO; AND PROVIDING WHEN SAID LICENSE FEE SHALL BE PAID, ALSO REPEALING ARTICLE VII OF ORDINANCE NO. 283 AND ESTABLISHING AND FIXING THE PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND ORDINANCE NO. 283; PROVIDING THAT ALL OTHER ARTICLES AND SECTIONS OF SAID ORDINANCE REMAIN IN FULL FORCE AND EFFECT, AND PROVIDING WHEN THIS ORDINANCE SHALL BE COME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF REXBURG, IDAHO: SECTION I: Article II of Ordinance No. 283 is hereby amended as follows: "For the purpose of raising the funds necessary to pay the expense of enforcing the regulations prescribed in Ordinance No. 283, as well as other police and sanitary regulations of a general nature heretofore and hereafter provided by Ordinance, an annual license fee of $20.00 is hereby imposed upon each person, firm, and /or corporation engaged in ,exercising or carrying on directly or indirectly any occupation, trade, business, profession and vocation within the corporate limits of the city of Rexburg, Madison County, Idaho. Every transient tradesman shall pay a license fee of $15.00 a day and /or $75.00 a quarter. The words "transient tradesman" for the purpose of this ordinance shall be construed to mean and include all persons, both principals and agents, who engage in temporary or transient business in the City of Rexburg, Idaho, or in traveling from place to place therein, selling goods, wares and merchandise and services and who for the purpose of carrying on such business, hire, lease or occupy any building or structure, tent, truck and /or trailer for the exhibition or sale of such goods, wares, merchandise and services. -11 SECTION II: The license fee provided for in this Ordinance shall be paid to the City Treasurer of the City of Rexburg, Idaho, by the person, firm and /or corporation engaged in or intending to engage in said business, profession, occupation or trade, upon the effective date hereof or at or before the time of commencing or engaging in the same, and the Treasurer's receipt taken therefor, and from the Treasurer's receipt, the Clerk shall issue such license certificate as is authorized in said receipt and thereafter all license fees must be paid quarterly in advance at said Treasurer's office at the City Hall. SECTION III: Any violation of the provisions of this ordinance and /or of Ordinance No. 283 shall constitute a misdemeanor and on conviction thereof the person violating shall be fined not to exceed $300.00 or imprisoned in the City /County Jail not to exceed six (6) months or by both. Any violation, of any or all the provisions of this ordinance and /or Ordinance No. 283 for any one day, shall constitute a separate offense. SECTION IV: This ordinance shall become effective immediately upon its passage, approval and publication.
