AN ORDINANCE PROHIBITING THE PARKING OF ANY
VEHICLE IN A DESIGNATED FIRE LANE AND
AUTHORIZING THE POLICE TO ENTER UPON PRIVATE
PROPERTY WHEN NECESSARY TO ENFORCE THIS
PROHIBITION; PROHIBITING THE STOPPING, STANDING
OR PARKING IN NO -PARKING ZONES AND FIRE ZONES
IN PUBLIC OR PRIVATE PARKING LOTS AND
AUTHORIZING THE CITY POLICE TO ENTER UPON
PRIVATE PROPERTY TO ENFORCE THIS PROHIBITION;
PROVIDING FOR A PENALTY FOR THE VIOLATION OF
THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF REXBURG, IDAHO:
SECTION I. Standing or parking within access
roadways for fire apparatus.
A. No person shall stand or park a vehicle within
any designated fire apparatus access roadway (fire lane)
located near a building as required in Section 10.207(b) of the
Uniform Fire Code, as heretofore adopted.
B. City Police are specifically authorized to enter
upon private property, when necessary, for the sole purpose of
enforcing the prohibition set forth in Subsection A of this
section.
SECTION II. No stopping, standing or parking near
hazardous or congested places or within no -parking zones.
A. There shall be no stopping, standing or parking
of motor vehicles within the following areas:
(1) Areas designated by the City Police, by
proper signs, as being hazardous or congested, or likely to
become so if there is stopping, standing or parking of
vehicles;
(2) No -parking zones in public or private
parking lots, where such zones are clearly designated by
painted lines and prominent signs placed by property owners or
occupants.
B. City Police are specifically authorized to enter
upon private property, when necessary, for the sole purpose of
enforcing this prohibition.
SECTION III. Any violation of any provision of this
ordinance by any person, firm or corporation shall constitute a
non-moving infraction, and shall be punishable by a fine of not
less than Ten Dollars ($10.00) and not more than Three Hundred
Dollars ($300.00), exclusive of court costs, for any single
violation.
SECTION IV. This ordinance shall become effective
upon its passage, approval and publication.
