Property Lines
Each site plan that is submitted to the City of Rexburg for the Building Permit process requires that property lines
are shown accurately. It is the Developer's responsibility to correcdy identi$ on the site plan the location of these
lines in reference to the public right-of-way, other adjoining properry lines, the street, other structures and all utiJity
lines. The Developer should find property pins that are still available at the lot in question. If these pins do not
exist or have become unrecognizable then a new survey should be performed.
Accurate property line information is a must for a timely review. In addition to finding existing property pins, legal
descriptions should be checked. The best way to identift property line location is with a land survey. The City of
Rexburg has aerial photos and a parcel line layer that can be checked, but they are only a tool and are not
guaranteed for accuracy. If you want to request a copy of your lot, see the front counter at the Community
Development Department.

6.128. - Standards Applicable to Conditional Use Permits. The approving body shall
review the particular facts and circumstances of each proposed conditional use and shall find
adequate evidence to show that the proposed use vzill:
'1,. Constitute a conditional use as established in Table l,,ZonngDistricts, and Table 2,Land
Use Schedule.
2. Be in accordance with a specific or general objective of the City's Comprehensive Plan and
the regulations of this Ordinance.
3. Be designed and constructed in a marrner to be hatmonious 'urith the existing character of
the neighborhood and the zone in which the property is located.
4. Not create a nuisance or safety hazatd for neighboring properties in terms of excessive
noise or vibration, imptopedy directed glare or heat, electrical interference, odors, dust or
air pollutants, solid waste genetation and sto{age, hazardous materials or waste, excessive
traffic generadon, ot interference with pedestrian ftafftc.
5. Be adequately served by essential public facilities and services such as access streets, police
and fte ptotection, drainage structures, refuse disposal, water and sewet service, and
schools. If existing facilities are not adequate, the developet shall show t}at such facilities
sha1l be upgaded sufficiently to serve the proposed use.
6. Not generate traffic in excess of the capairty of public streets or access points serving the
proposed use and vrill assure adequate visibiliry at aaffic access points.
7. Be effectively buffered to screen adjoining properties from adverse impacts of noise,
building size and tesulting shadow, ttaffuc, and parking.
8. Be compatible with the slope of the site and the capacity of the soils and will not be in an
