1. Constitute a conditional use as established in Table l,,ZoningDistricts, and Table 2,Land
Use Schedule.
2. Be in accotdance with a specific or general objective of the City's Comprehensive plan and
the regulations of this Ordinance.
3- Be designed and constructed in a manner to be harmonious with the existing character of
the neighborhood and the zone in which the property is located.
4. Not create a nuisance ot safety hazatd for neighboring properties in terms of excessive
noise or vibtation, improperly dit661sd glare or heat, electrical interference, odors, dust of
ait pollutants, solid waste generation and storage, hazardous mateiials or waste, excessive
trafftc genetation, or interference vrith pedestrian 1raffic-
5. Be adequately served by essential public facilities and services such as access streets, police
and f,rre protection, drainage structures, refuse disposal, water and sewer service, and
schools- If existing facilities are not adequate, the developer shall show that such facilities
shall be upgraded sufficiendy to serve the proposed use.
6. Not generate traffic.in excess of the capacitJ of public streets or access points serving the
proposed use and vrill assure adequate visibility at taffic access points.
7. Be effectively buffered to screen adjoining propeties from ad.rerse impacts of noise,

On August 72,2014, Doug Brasier of ZyIun Insights presented to the City of Rexburg
Planning &Zontng Coordinator a request and application fot a Conditional Use Permit to
allow a Call Center in a Community Business Center (CBC) Zone. The property is located at
669 Pioneer Road, Suite #100.
On August 1.2,201.4, the City Cletk sent the Notice of Public Hearing to be published in the
local newspaper on August 76 and August 30,201,4. A. notice was posted on the propefty
and sent to all property owners within 300 feet of the above mentioned property.
On Septembet 4,2}14,DougBrasier presented to the Planning &ZonngCommission for
the City of Rexburg, the request for a Conditional Use Permit to allow a Call. Center in a
CBC Zone.
Dan Hanna motioned to recommend approval to City Council of a Conditional Use Permit to
allow a call center (marketing reseatch company) in the Community Business Center for the
property located at 669 Pioneer Road, Suite #100, to include the Standards Applicable to
Conditional Use Permits, Section 6.128 from Development Code Ordinance No.1115, and to
include one condition:

4. On Septemb et 77 ,2074 City Council considered a request for a Conditional Use Permit at
669 Pioneer Road Suite #100 to allow a Call. Center in a Community Business Center (CBC)
Zone
Council Membet Merill questioned the reason why the Call Center would need a conditional
use permit, if the zone is already a CBC Zone. City Attorney ZolJtnger said there is a list of
different business types required to obtain a conditional use permit, call centers fall under the
list. It gives Planning and Zonng the opportunity to review parking requirements.
Community Development Directot Chdstensen indicated Compliance Officer Natalie
Powell met with Call Centers in the downtown ^te ,to inquire how much parking was needed
for their employees. The downtown call centers indicated, they needed about 600/o for employee
parking.
When the parking requirements where instated in the development code for calf centets' The
number used was .6 in the technology area which is surrounded by multi-family housing and
downtown commercial atea.In the CBC areas on 2"d East past Wal-Mart and South of town on
University Blvd. by Burger I(ng the vast majority of employees would be driving.
The site map of the location was reviewed on the overhead screen.
Community Development Difector said after further review; the location of the call centet is
very close to residential housing.
Community Development Director Christensen said there is conundtum of having the CBC
Zone requir e 9; after discussing this with City Attorney Zolltnger. a chatge in the otdinance was
made to iequire .9 since this CUP. The development code required a conditional use permit,
however a section was inserted stating; if staff could identi$t it was a similar location to a
conditional use permit would not be required.
Council Member Wolfe asked if the .6 would work fot this atea. Community Development
Director said the .6 would work. He said there is now new direction for these ateas
Parkinq - Chapter 5 in the Development Code:
5.8 TABLE 3 - Required Number of Spaces
Call Centers qnd business with higher density cubicles, 0.9 space per employee or 0.6 per employee allowed in
Central Business District (CBD), Technologt and Office Zone (TOZ) and Mixed Use 2 (MU2). On a case by
case basis 0.6 spaces may be allowed in other zones if the Community Development Director determines thqt
the requested location is close in proximity to substantial higher density housing.

6.12 Conditional Use Permits
Sertion 6.1 28 The Commission or Council may require that the applicant conduct studies of the social, economic,
fiscal, and environmental fficts of the proposed use.
b. Standards Applicable to Conditional [Jse Permits. The approving body shall review the particular facts
and circumstances of each proposed conditional use qnd shall find adequate evidence to show thqt the
proposed use will:
i. Constitute a conditional use as established in Table l, Zoning Districts, and Table 2, Lqnd Use
Schedule.
ii. Be in accordance with a specific or general objective of the City's Comprehensive Plan and the
regulations of this Ordinance.
iii.Be designed and constructed in q mqnner to be hqrmonious with the existing character of the
neighborhood and the zone inwhich the property is located.
