Conditional Use Permit Procedures
The City of Rexburg ZonngOrdinance designates certain land uses in each ZontngDistrict which ate allowed.
These are listed in the Zoning Ordinance for each zone. The Planning &ZonngDepartment should be consulted
if you have questions regarding whether your proposal v/itl need a Conditional Use Permit (C.U.P.).
If a C.U.P. is needed, please complete an application and submit it to the Planning &ZonngDepattment, along
with any other requited documents at least 18 days prior to a meeting. All applications that ate complete will be
processed with due diligence and will be scheduled, dependent upon availability for an upcoming agenda.
Application and public headng fees are required to be paid up ftont. Prior to granting a conditional use, at least one
Public Hearing shall be held to give persons an opportunity to be heatd. The Planning&Zonngmeetings are held
on the 1" and 3'o Thursday of every month at 7:00 pm.
The Planning &ZonngCoordinator will put the notice for the hearing in the newspaper at least 15 days prior to
the hearing date, mail a copy to all the property owners within 300 feet, and post a notice on the property. After the
Planning &ZonngCommission holds their hearing they will make a recommendation to the City Council. The City
Council will take the Planning & Zonrng Commission recommendation into consideratio n. If a hearing is required
before the City Council they will then take into considemtion oral and written testimony as well as the
recommendation from the Planning &ZonngCommission. A decision will be made by the City Council within the
time frame allowed by Section 67-651,1,,Idaho Code.

6.128. - Standards Applicable to Conditional Use Permits. The approving body shal
review the particular facts and citcumstances of each proposed conditional use and shall find
adequate evidence to show that the proposed use will:
1'. Constitute a conditional use as established in Table L, ZoringDistricts, and Table 2,Land,
Use Schedule.
2. Be in accordance with a specific or general objective of the City's Comprehensive Plan and
the regulations of this Ordinance.
3. Be designed and consttucted in a manner to be harmonious uzith the existing character of
the neighborhood and the zone in which the property is located.
4. Not create a nuisance or safety hazard for neighboring properties in terms of excessive
noise ot vibration, impropedy ditected glare or heat, electrical interference, odors, dust or
air pollutants, solid waste geneiation and storage, hazardous mater-ials or waste, excessive
tafftc generation, or interference with pedestrian traffic.
5. Be adequately served by essential public facilities and services such as access streets, police
and lre protection, drainage strucnues, refuse disposal, waier and server service, and
schools. If existing facilities are not adequate, the deveioper shall show that such facilities
shall be upgraded sufficiendy to serve the proposed use.
6. Not generate traffic in excess of the capaciry of public streets or access points serving the
proposed use and will assure adequate visibility at taffic access points.
7. Be effectively buffered to screen adjoining properties from adverse impacts of noise,
building size and resulting shadow, traffirc, and parking.
8. Be compatible with the slope of the site and the capacity of the soils and will not be in an
area ofnahrralhzzards unless suitably designed to protect lives and property.
9. Not result in the destruction, loss or damage of a historic feature of significance to the
community of Rexburg.

OnJune 6,2074, Kathleen Cook presented to the City of Rexbutg Planning &Zonng
Coordinator a request and application for a Conditional Use Permit to allow a duplex in an
existing home at 477 West 1" Noth.
OnJune 6,2074, the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper onJune 28 andJuly 1.2,2074. A notice was posted on the property and sent
to all ptoperty ownets within 300 feet of the above mentioned property.
OnJuly 1.7,2074, Spencer Cook presented to the Planning&ZonngCommission for the
City of Rexburg, the request for a Conditional Use Permit to allow a duplex in an existing
home at 471, West 1" North.
It was reiterated that the P&Z Commission has the authority to make the final decision on this
Conditional Use Permit request fot a duplex, pet the Development Code Ordinance No. 1115,
Section 6.72f. The request does not have to go on to City Council.
Bruce Suthedand motioned to approve a Conditional Use Permit to allow a duplex in an
existing home, for the property located at 47'1, West 1" Notth, to include the Standards
Applicable to Conditional Use Permits, Section 6.128 ftom Development Code Ordinance
No.1115, and to include two conditions:
1. The two subject parcels shall be combined.
2. The applicant shall pull a city building permit to change the use of the existing home to a
duplex.
