1. On February 78,2}1,4,Richard Smith presented to the City of Rexbug Planning &Zonng
Coordinator a request and application for a zotte change for the property located at 529,549,
55g,579,589, and 609 South Millhollow Road in Rexburg, Madison County, Idaho to be
rezoned from Low Density Residential 1 to Low Density Residential2.
2. On February 19,201,4 the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on March 1 and Match15,2074. A notice was posted on the property
and sent to all property owners within 300 feet of the above mentioned property.
3. On March 20,2074,the Chair noted that applicant and property owner Richard Smith in an
email cornmunication dated yesterday, has requested that this Rezone application be Tabled
until the nextP&Z meeting on April 3'd, as he was unexpectedly called out of town and is
unable to attend tonight's meeting.
Chairman Dyet opened the hearing fot a Rezon e fot 529 , 549 , 559 ,579, 589, and 609 South
Millhollow Road, tL change the zoning from Low Density Residential 1 to Low Density Residential
2. Atthe request of the applicant, this rezone would be tabled'
Mary Ann Mounts motioned to Table the fuchard Smith Rezone application request until the April
3'd P&Z meeting. Dan Flanna seconded the motion.
None opposed. Motion caried.
4. On April 3,0274 Dan Hanna motioned to take the Richard Smith Rezone off the table. Gil
Shidey seconded the motion.

Applicanl Richard Smith teviewed the proposal on the overhead screen. He said there are
twin homes neatby in Eaglewood Subdivision. The proposed lots have a drop on the back ofthe lot allowing walkout basements. Public Works Director Millar said the lois setbacks will
be comply with city code.

The Rexburg Development Code allows for the Commission to make recommendations to the CityCouncil regarding whether or not the property should or should not be rezoned based on the criteriafound in section $6.13.

The total area involved in this re-zoning request is identified as approximately 3.2 acres, which ifapproved will result in changing Low Density Residential I (LDRI) to Low Density Residential 2(LDM).

If approved, this rezone will result in changing Low Density Residential I (LDRI) into a Low Density
Residential 2 (LDR2) Zone. The request would require the Commission and City Council to review

criteria listed by Ordinance 1026 (Development Code) that are required to be addressed, followed by
staff s analysis of each criterion.
Criteria Rezone Requests ($6.13):

The Cornprehensive Plan identihes this location as Single Family. LDR2 is allowed in the Single
Family use.
b. The capacity of existing public streets, water and sewerfacilities, storm druinagefacilities, solitl
waste collection and disposal, and other utilities.
The City Engineer did not express any concems about added traffic due to the addition of six
additional units.
The capocity of existtng public services, including but not limited to, public safety services,
public emergency services, schools, and parks and recreational services.
The City Engineer did not voice a concern. The appropriate Impact Fees will be collected prior to
the issuance of a Building Permit.
The potentialfor nuisances or health and safety hazards thot moy adversely affect adjoining
properties.
Staff has reviewed and does not feel the change will have a negative effect.
