ZONING MAP OF THE CITY OF REXBURG,IDAHO, AND
PROVIDING THAT THE ZONED DESIGNATION OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED,
SITUATED IN REXBURG, MADISON COUNTY,IDAHO, BE
CHANGED AS HEREINAFTER DESIGNATED; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY the City of Rexburg, Idaho:
SECTION I: That the zoning map of the City of Rexburg, Idaho, which is filed
with the city clerk theteof, be, and the same is hereby amended and changed to provide that
the hereinafter described property situated in the City of Rexburg, Madison County, State of
Idaho, regarding (#140021,0) rezoning a property from Medium Density Residential One
(1VIDR1) to Hemmin g P ro-Zone
The said property is located at 1.36 South 1" lfest, in Rexburg, Madison County, Idaho, and
more particularly described as follows:

Legal Descdption:
Commencing at the Southeast corner of Lot 1, Block 47 of the City of Rexburg, Idaho, as
per the recotded plat thereof, and running thence West 10 rods; thence North 5 rods; thence
East 10 rods; thence South 5 rods to the place of beginning.
SECTION II: That a new zontngmap showing these amendments shall be certified
to and declared to be the official zonng map of the City of Rexburg by passage of this
Otdinance by the City Council of the City of Rexburg.
SECTION III: This ordinance shall become effective upon its passage, approval
and publication.

This Shared Use Agreement is entered into to be effective as of June 1, 2014 (the
"Effective Date") by and between Jesse D. and Ann Hancock, (Hancock) and Hemming Village
Holdings, LLC, (Hemming) an Idaho limited liability company, located at 160 West 2nd South,
Suite 200, Rexburg, Idaho 83440.
Recitals
A. Hancock owns the property located at 124 South l't West, Rexburg, Idaho 83440
B. Hemming owns the property located at 136 South l't West, Rexburg, Idaho 83440
C. Hemming purchased referenced property and inherited a previously negotiated
arrangement by which the two referenced properties shared a common driveway and garage.
D. The parties desire to set forth their own terms and conditions in writing by way of
this Shared Use Agreement.
NOW, THEREFORE, the parties agree as follows:
1. The shared driveway will be enlarged to 20 - 24 feet, depending upon City
requirements, with the dividing line to be in the middle of the drive leaving 10 - 12 feet of drive
to be used by Hancock and l0 - 12 feet of drive to be used by Hemming or its tenants. If 24 feet
is required by City, Hancock agrees to allow driveway to be extended two feet to the north,
toward Hancock home. All costs, including the cost for asphalt, moving of sprinklers and any
other costs associated with the expansion of the driveway will be paid for by Hemming.
Hemming shall be responsible for the upkeep and maintenance of the shared driveway.
2. Both parties will do all within their power to prevent parking or extended stopping
by owners, employees, clients or visitors along the driveway extending approximately 80 feet
from the entrance point from the street.
3. Parking of all vehicles on both properties will be confined to designated areas
located to the rear of their respective buildings.
4. Hemming agrees to allow Hancock use of the entire garage which is currently
shared, but Hemming will retain ownership of the south half of the garage and retain the right to
restrict access to Hancock for the south half of the garage upon 30 days written notice. If no
such notice is given, Hancock will be entitled to use the garage as long as they own the home at
124 South ltt West. Further, as long as Hancock uses the entire garage, Hancock will be
responsible for the entire upkeep and maintenance on the garage. Further, any required major

repairs or replacement of the shared garage will require joint consent by the two parties. Payment
for said agreed upon repairs and or replacement would be shared 50/50.
5. Hemming acknowledges their intent to seek a rezone of the property at 136 South
I't West from low density residential to the Hemming PRO Zone. Hemming acknowledges that
the Hemming Project Redevelopment Option (PRO) Zone allows for a number of permitted uses
under Section 3.30.020, Permitted Uses. Hemming also recognizes the need to lease the
property to uses that are compatible with the neighborhood and acceptable to Hancock.
Hemming agrees to lease property for use as professional office space and for no other use until
such time that Hancock or a member of their immediate family no longer owns the property at
124 South l" West. At that point in time, and only after that point in time, will Hemming be
entitled to lease the property for other permitted uses within the Hemming PRO Zone.
6. If Hancock determines to market and or sell their home at 124 South I't West,
Hemming retains first right of refusal to purchase home at list price, unless it is sold to an
immediate member of their family. If it is sold to an immediate family member, Hemming
retains the frrst right of refusal until such time the property is finally marketed to the general
public.
IN WITNESS WHEREOF, the parties have executed this Shared Use Agreement to be
effective as of the Effective Date.

1,. On May 1.3,201.4, Lane Hemming presented to the City of Rexburg Planning &Zontng
Coordinator a request and application for ^ zofle change for the Property located at 136
South 1" \fest in Rexburg, Madison County, Idaho to be rezoned from Medium Density
Residential 1 (I\{DR1) to Hemrning Project Redevelopment Option (Hemming PRO-Zone).
2. On May 73,201.4 the City Clerk sent the Notice of Public Hearing to be published in the
local newspaper on May 77 and May 31,201,4. A notice was posted on the property and sent
to all property owners within 300 feet of the above mentioned property.
3. OnJune 5,201,4, Richie Webb presented to the Planning &ZonngCommission for the City
of Rexburg, the Request for a Rezone for the property located ^t 1,36 South 1" West, in' Rexburg, Madison Count|, Idaho to be rezoned fiom Medium Density Residential 1(A{DR1)
to Hemming Project Redevelopment Option zone (I{emming PRO-Zone).
Melanie Davenport motioned to recommend to City Council the approval of a zon.e change
for the propeffy located at 1.36 South 1"'West, to change the zoning fiom Medium Density
Residential 1(4,{DR1) to Hemming Project Redevelopment Option (Hemming PRO-Zone), and
to include two conditions:
1. The S hared (Jse Agreementbetsveen the Hancocks and the Hemming Colporation shall be
maintained by both parties.
2. Vehicular access ftom the west shall be restricted.
Steve Oakey seconded the motion.

On June 25,2014 at7:20 P.M. in a Public Headng for (BILL 1117) Job (#14 00210) for
a rezone from Medium Density Residential One (1\{DR1) to Hemming Project Redevelopment
Option (Hemming PRO-Zone). The property is located at 1.36 South 1st West Richie Webb
from Rexburg reviewed the proposai for the Darell Ard home. They want to convert the home
into commercial use. The purpose is to restore and presewe some of the homes on the block.
They want to restore the home and use if fot office space. They have added parking to the
development for a new tenant in the basement. They share a garage with the Hancock's on this
property. They have signed ^n ^greement with the Hancock's to develop the property. A buffer
fence will be installed to divide the property that will take out a small storage building. The
Hancock's were concerned with allowed uses in thePrc-Zone. Seventeen uses were agteed to be
allowed without further discussion. Hemming's have a ftst dght of refusal to purchase the
Hancock home. The Hancock agteement will be recorded with the deed. It is a reasonable plan
fot the Pro-Zone Development. This will bring a new business to town.
Council Member Busby thanked Mt. Sfebb for being a good developer in the city. Council
Member lfolfe concured with the accolade.

If approved, this rezone will result in changing Medium Density Residential I (MDRI) to Hemming project
Redevelopment Option (PRO Zone). The request would require the Commission and City Council to review
the proposal against one set of criteria, for the request to rezone. Below, staff has provided all the criteria
listed by Ordinance 1026 (Development Code) that are required to be addressed, followed by stafPs analysis
of each criterion.
Criteria Rezone Requests ($6.13):
h Be in conformance with the City's Comprehensive PIan and the City Development Code.
The Comprehensive Plan identifies this location as Neighborhood Commercial/Mixed-Use. The
PRo Zone is allowed in Neighborhood commercial/rVlixed-use.
b. The capacity of existing public streets, water and sewerfacilities, storm drainage facilities, solid
waste collection and disposol, and other utilities.
The City Engineer did not express any concerns.
c. The capocity of existing public services, including but not limited to, public safety services,
public emergency services, schools, and parlts and recreutionsl services.
The City Engineer did not voice a concern. The appropriate Impact Fees will be collected prior to
the issuance of a Building Permit.
d. The potentialfor naisances or health and safety hazards that may adversely afrect adjoining
properties.
Staff has reviewed and does not feel the change will have a negative effect.
e. Recent changes in land ase on adjoining properties or in the neighborhood of the map revision.
None
f. Meets the requirements of the Comprehensive plan.

IV. STAFF RECOMMENDATION
If the Planning and ZoningCommission determines that all of the criteria are met, Staff requests that the
