On Apdl 2, 2074, Johnny Watson presented to the Rexburg City Plannin g & Zonng Coordinator a Request to amend the current Comprehensive Plan Map (File #1,4 00133) to change fiom Open Space to Neighbothood Commetcial/Mixed Use fot the property located at approximately 99 Valley Rivet Drive. 2. On Apdl 3,201,4 the City Clerk sent the Notice of Public Hearing to be published in the local nev/spaper for April 72 and Apnl26,201,4. A notice was posted on the property. 3. On May 7,201,4,Johnny STatson presented the Comprehensive Plan Map Amendment request to the Rexburg Planning & ZonngCommission. Cory Sotensen said as the iand use designation of the subject property may be a mistake as was mentioned, maybe there can be reimbursement of the fee or pafi of the fee to the property owner. This could be addressed at the City Council meeting. Steve Oakey motioned to recommend approval to the City Council of the Comprehensive Plan Map Amendment request to change the land use designation for the propefty at approximately 99 Valley River Drive, ftom Open Space to Neighborhood Commercial/Mixed Use. Gil Shitley seconded the motion. None opposed. Motion canied. 4. On June 04,2014 n a City Council meeting Compliance Officer Natalie Powel said that the property is 2.75 actes. She agreed that it is more of a clean-up and that the water and sewer are already there so if there was ever a need for futther development it would be accessible. She referred to the staff fepofl. STAFF RECOMME,NDATION The applicant wants to change the subject property from Open Space to Neighborhood Commercial/Mixed Use on the Comprehensive Plan Map. The applicant feels that the use is consistent with the use bordedng the property on the south. The property to the east is currendy identified as Commercial. There is curently in place a request for a Conditional Use Permit for the land direcdy to the south. The Planning andZontng Commission should take testimony in the public hearing to determine if this use will be in the best interest of the community. I (- Applicant: Johnny Watson of Rexburg, representing C.K Chan, reviewed the proposal behind I(-Mart to change the Comprehensive Plan as ptoposed. It is part of the original I(-Mart development; however, it was separated in error as open space behind the store. It is a clean-up proposal to corect the open space designation and give Mr. Chan flexibility for the future. The owner wanted to have a mixed use designation on the Comprehensive Plan. Mayor Woodland opened the public hearing.
