a request and application for a Conditional Use Permit to allow D^try Products in a Light industrial
zofle at229 & 241 South 56 West, Unit 400. There will be a small artisan cheese plant and attisan bakery
for manufacturing of the products for a growing wholesale business to high end iheese shops,
restaurants, and specialty food stores.
OnJanuary 74,2074, the City Cletk sent the Notice of Public Hearing to be published in the local
newspaper onJanaary 18 and February 1,2074. A notice was posted on the property and sent to all
property owners within 300 feet of the above mentioned property.
On February 6,2014,I(endall Russell presented to the Planning & ZonngCommission for the City of
Rexburg, the request fot a Conditional Use Permit to allow D^try Products in a Light Industrial zorre ^t229 &241' South 5ft West. There will be a small artisan cheese plant and artisan baf.ry fot manufactudng
of the products for a growing wholesale business to high end cheese shops, restaurants, and specialty
food stores.
Dan Hanna motioned to recommend approval to City Council of the Conditional Use permit for the
property at 229 and 247 South 5' $7est Unit 400, to allow Dalry Products in a Light Industrial zotte, to
include the Standatd CUP requfuements stated in the Development Code No.1026 - ("standards
Applicable to Conditional Use Permits" section 6.12B) - which includes addressing nuisances, safety
hazards, etc. Any additional expansion of the business at this location will be subiect to staff review
and approval. Melanie Davenpott seconded the motion.

Kendall Russell in Rexburg reviewed the proposal on the overhead screen. The milk bam is in Salem.T1T FDA is over regulation of the cheese industry. The future will require cheese making to be doneoff site from the dairy. Mr. Russell reviewed the location where the small artisan cheese fhnt and
attisan bakery will b9 located. They employ students from BYU-I in their cheese making operation.
They sell to high-end retail markets with 30-40h of their sales made in Farmer's Markel. Ii is a quiet,low key environment.

II. SITE DESCRIPTION
The project is located 229 and241 South 5th West, Unit 400.
III. ANALYSIS
The following are the criteria for granting a conditional use permit. Some of the criteria are followed
by staff s analysis. A conditional use will:
a. Constitute a conditional use us established in Table 1, Zoning Districts, Table 2, Land (Jse
Schedule.
A CUP is required for Dairy Products in a Light Industrial (LI) zone.
b. Be in accordance with a speciftc or general objective of the City's Comprehensive Plan and the
regulations of the City of Rexburg Development Code.
Comprehensive Plan
The Comprehensive Plan Map identifies the area as "Moderate to High Density Residential".
The use is not in accordance with the Comprehensive Plan. The existing Light Industrial zoning
allows the use.
Development Code (Ordinance 1026)
This use is allowed with a Conditional Use Permit as per the City of Rexburg Development Code
Section 3.20.020.
Be designed and constructed in a manner to be harmonious with the existing character of the
neighborhood und the zone in which the property is located
This is in an existing building.
Not create a nuisance or safety hazardfor neighboring properties in terms of excessive noise
or vibration, improperly directed glare or heat, electrical interference, odors, dust or air
pollutants, solid waste generation and storage, hazardous materials or waste, excessive traffic
generation, or interference with pedestrian traflic.
The potential for odors should be thoroughly investigated by the Commission. The applicant
insisted to staff that there would be no nuisance created by their process.
Be odequately served by essential public facilities and services such as access streets, police
andftre protection, drainage structures, refuse disposal, water and sewer semice, and schools.If existingfacilities are not adequate, the developer shall show that suchfacilities shall be
apgraded suffrciently to serve the proposed use.
The City Engineer has stated that the applicant will need to complete an 'Industrial Wastewater
Data Disclosure' Form with the City Wastewater Department.
