City Engineer.
2. There shall be a plan for sewer line and water connection per
City requirements.
3. The fire lane shall be approved by the Rexburg Fire Marshall.
4. There shall be a DevelopmentAgreementwith the City.
5, Lighting within the trailer park shallcomply with City
standards.
6. There shall be adequate fencing and/or landscape buffering
as per requirements of Title 14 for Mobile Homes of the Rexburg
MunicipalCode.
7. Alltrailers added to the mobile home park shatl be hooked up
to City services (sewer and water).
B. Elevations of mobile home trailers shallcomply with FEMA
standards.

Shane & Kircten Ruebush - f,'ollow Up On County Ordinrnce:
Commissioner Smith addressed the Ruibush family's questions they presented in a letter to the
Commissioners dated October 28, 2013, regarding Sec. I I 5-63(6), of the Madison County Code,
as it applies to lots and conditional use permits for additional living areas being allowed if certain
requirements are met. Commissioner Smith reviewed and answered each question presented in
their letter, and there was general discussion between the Ruebushs and Commissioners. The
Ruebushs asked the County to clarifi various portions of this ondinance, to include the
definitional sections and the land use table. The Commissioners agreed to relook at the
ordinance.

Mr. Christensen, from the City of Rexburg Planning and Zoning reviewed the Whoolerys'
request for expanding their traillr court on the boat house area and proper! indiscussion looated
by the golf course. fhis nailer park is in the impact area" so the City of Rexbury Planning and
Zoning-heard the request and unanimously recommended approval for the permit It is now up to
thc CJunty Commisiioners to consider the City's Planning and Zoning's findings. There was
discussion about the road in the trailer court. The Commissioners advised if the oounty is to look
at adopting the road at some point in tlre future, it will have to be built to its standards, length, etc.
The Cbmmissioners advised ilachel Whoolery to discuss the road with Dave Walrath at Road and
Bridge and Brent McFadden at Planning and Zoning prior to building it to see what the County
,rquirr-.nt are and whether or not this road would qualify. Otherwise, as it stands now, it is a
private road.
Based upon the findings from the Planning and Zoning Department at the City of Rexburg"
Commisiioner Weber -od" n motion to accept those frnding and approve the Conditional Use
permit for Rachel Whoolery. Commissioner Smith seconded, and voting was unanimous-

The project is located at340 &330North l2th West and is not in the city of Rexburg boundary' The lot
is in the city of Rexburg Impact Area. The lot requested for the cUP combined is approximately 5'87
acres.
ANALYSIS
The following are the criteria for granting a conditional use perrnit. some of the criteria are followed
by staff s analysis. A conditional use will:
a. Constitute a eonditional use as established in Table 1, Zoning Districts, Tuble 2, Land Use
Schedule.
A CUp is required for a mobile home court in the Medium Density Residential 1 (MDRI) zone'
b. Be in aceordance with a speciftc or general obiective of the city's comprehensive Plan and the
regulations of the City of Rexburg Development Code'
Comprehensive Plan
The Comprehensive plan Map identifies the area as "Low-Moderate Density Residential"' The
use is in accordance with the Comprehensive Plan'
Development Code (Ordinance 1026)
Mobile Home Courts are allowed *ith u Conditional Use Permit as per the City of Rexburg
Development Code Section 3.7 '020'
c. Be designed and constructed in a manner to be harmonious with the existing character of the
neighbirhood and the zone in which the property is located.

As you know I spoke to Rachel last week via phone and David Davis and I met with her in person quite some time ago on
this issue. | (we) have communicated with her during each meeting that the "P" concept would be allowable only if a
neighbor from the north or south granted her future permission to use their property for egress. lf the letter(s) could not
be provided, the project would need an emergency access road (Fire Lane) all along the north boundary running to 2000
West. Having two egresses on 2000 West does not fill the letter of the code, but does meet the intent of the code. The
property owner cannot meet the diagonal distance egress requirement in this configuration, however, with minimal risk
and no interface, I am willing to grant the exception.
