On November 1, 2012,R^y McDougal presented to the City of Rexburg Planning & ZoningCoordinator a request and application for a Conditionai Use Permit to allow a bJding -itil
more than four (4) units: one 6-plex. The property is located at approximately 40 North 5th!7est.
On November 2,2072, the City Clerk sent the Notice of Public Hearing to be published in thelocal newspaper on November 77 and December 1,2012. A notice was:posted on th. propertyand sent to all property owners within 300 feet of the above mentioned prop"tty.
On December 6, 201'2Ray McDougal presented to the Planning &ZontngCommission for theCity of Rexbutg, the request for a Conditional Use Permit to a building *iL -or. than four 4)
units: one 6-plex.
Dan Hanna motioned to recommend to City Council to grant approval of a Conditional UsePetmit to allow a building with more than four (4) units - o." 6-pie" - to include three
proposed conditions:
l) BuddinS herght shall be limited to two stories above grade.
2) Thete shall be a six-foot fence on the notth and south of subject property unless propeny
owners c n agrce on another kind of buffer.
3) There shall be a Design Review committee meeting for the project.
The "SJandatds APPlicable to Conditional Use Permits" Section 6.l2Bin the Development
code ordinance No. 1026, will apply to this conditional Use permit.
Jedd Walker seconded the motion.

Blake Walket presented the proposal on the overhead screen. By right, they are allowed to have
six units. The CUP is to request joining the duplex and the four-plex into a six-plex. It will allowfor alarger lawn. It is a good infiil project for Rexburg.
Council Member Busby asked if thete is already is a four-plex. Currently, there is no building
on the property.
Council Member Smith asked for more infotmation. She was concerned the number of units
would increase.

The subject property is a lot that surrounds an existing home.

The project is located at approximately 40 North 5th West. The site has been created by subdividing
a large single family house lot. The lot surrounds an existing home and is in the shape of a U.
ANALYSIS
The following are the criteria for granting a conditional use permit. Some of the criteria are followed
by staff s analysis. A conditional use will:
