The Planning & Zoning D-epartment should be consultedif you have questions regatding whether your proposal will need a Conditional Us. p.r-it (C.U.p.).
If a C.U'P. is needed, please complete an application and submit it to the Planning &ZonngDepartment, along
with any other requited documents at least 18 days prior to a meeting. All applicalons that Jre complete will be-processed with due diligence and will be scheduled, dependent upon availabiity for anupcoming agenda.Application and public !ea,4ng fees ate requfued to be paid up front. Modulat Building locations - 6 Schools
1. At the May 2120TiPlanning & Zoning meeting, Var Snedaker representing the Madison
School District, presented the proposed locations to establish pemanent locations for
temporalT modulat buildings.
Each site was viewed on the aenalmap on the ovethead screen.
The planned modular classroom sites viewed were at Adams Elementary, Kennedy Elementary,
LincoLn Elementary, MadisonJunior High, Madison High School, and Madison Middle School.
Stephen Zollinget clarified these are generallocations; staff will ensure that there are the
appropriate setbacks.
Adams. Kennedy. and Lincoln - locations satisfactory to the Commission.
Madison Middle School - locations satisfactory to the Commission, with no additionai sites
approved there.
MadisonJuniot High - the Commission asked the School District to consider another location.
Madison High School -the Commission asked the School District to consider putting the
modular classroom to the notth of the gteenhouse.
Regarding the new sites, the Madison School District would eventuah go through the CUP
process.

Mayor Woodland closed the public hearing for deliberations:
Council Member Medll was agreeable if the School District does not use the temporary
structures as permanent solutions. He discussed using private enterprise in these buildings and, that
the rent should be in the competitive price range for the same square footage.
City Attorney Zoltnget stated that Council Member Merrill can have that opinion, but not in these
meeting because the only issue at hand is the Ordinance. A member asked if he should recuse
himself because this would affecthis school and City Attomey Zolltngetasked if he feels he would
lose his job if he voted.
Discussion: Private non-school uses of the building are not allowed in the land use zone.Itis not a
function of the school disttict to provide space for private users. It is incidental use verses the
principal use of the space. The law ot zorTe would have to be changed to accommodate private use.
The use of the facilities aftet houts is incidental use while the use of them during the tegular school
time is continual use.

BACKGROUND
At the May 2ndP&Zmeeting, the Commission instructed the School District to create a plan for thefuture on where they would locate modular classrooms. Rather than having to take out a ConditionalUse Permit (CUP) each time a modular classroom was brought in, it was decided that one (CUp)
would be filed for the identified approved areas. Rexburg Planning Staff would then administer
Temporary Occupancy Permits on a case by case basis. Exhibit'oA" was provided by the Madison
School District showing the location of the modular classrooms. It has beln reviewed and meets thesatisfaction of the P&Z Commission.

ANALYSIS
The following are the criteria for granting a conditional use permit. Some of the criteria are followedby staff s analysis. A conditional use will:

for a given period by Rexburg Planning Staff.
2. Be in accordance with a speciJic or general objective of the City's Comprehensive plan and theregulations of the City of Rexburg Development Code.

Comprehensive Plan policy (page 40): Encourage inter-agency cooperation to provide a link
between planning efforts and community and educational needs.
Development Code (Ordinance 1026)
A CUP is required as per Section 6.12 of the Development Code.
3. Be designed and constructed in a manner to be harmonious with the existing chsracter of theneighborhood und the zone in which the property is located.
All of the areas identified are zoned in a manner to allow schools. Buffering will be considered
on a case by case basis.
4. Not creute a nuisance or safety hazardfor neighboring properties in terms of excessive noiseor vibration, improperly directed glare or heat, electrical interference, odors, dust or airpollutants, solid wuste generation and storage, hazardous materials or waste, excessive trafficgeneration, or intederence with pedestrian traffic.

The School District has had to get a CUp every time they havewanted to have a modular classroom because it is a temporalT structure. It was thought that therehad to be a better way to handle this issue.

The School District is here tonight to start the process of determining whether these are locations
that would be consistent with those goals. It is a matter of logistics ofd"t"r-irring where the student
demand is in any given year.
Dr. Geoffrey Thomas, Supedntendent of Madison School District, said the school board anddisttict administtation would prefer to not have to use portables. They are quality structures, but
they are used in emergencies here and there. They have added otr p"t-rrr".tly io Adams
E-lementary, Lincoln Elementary, Hibbatd Elementary, and Burton^Elementary. There are currentlyplans to add another five classrooms and a gymnasium onto I(ennedy Elemeniary.
The district's goal is to add pemanent structutes. They do have aplan in place for a future bondand a long range plan to build a new elementary school west of Burton El^emen t^ry, to be called
Washington Elementary.
The Madison School Disttict is trying very hard to recognize growth and address it on a more
pemalrent basis, and. they arc also trying very diligently to be mindful of taxpayer dollars. The
district -ill try to utilize their curent property with the existing utilities. ilhe district has worked
hatd to keep the elementary schools zt 400 students or fewer, For better leaming conditions.Neighborhood schools are vefy important. Using potables is not the district's itst or most desirable
choice.
Chairman Dyet said a Commission concern was that at first these modular classrooms were goingto be temporarily used, until school building additions were built. After the building additions"werJ
completed, there was still the need for the modulars.
Stephen Zolltnget cladfied that the Commission would start the process by determining if theselocations that the school district has identified are acceptable sites for the modular classrooms. If

Chaitman Dyer clarifred that the Commission should focus on u/ays to get the modular classtooms
accommodated so it is not always a concefn and an administrative headache.
Thaine Robinson said thete was also a concem that a modular classroom at Adams Elementary
was subleased out to a daycare center.
Stephen Zollinget said that issue has been addressed. Mr. Christensen's office would
administtatively work with the School District to ensure that the modular classrooms are used as
classroom space.
Yal Chdstensen said a concem to be aware of is that the School District has a sizeable investment

Stephen Zollinget clarified that legally they are not considering these modular classrooms asanything but temporary. The sites would be permanently approved sites for the modular classroomsto come and go. From the Building Code perspective, -odolrt classrooms will always beadministered as temporary structures.

M"ry Ann Mounts said as a former resident in one of these modular classrooms at the MiddleSchool, she is gtateful that it was as nice as it was. She went into it with a lot of trepidation but thengrew to love it in many ways. The University uses her old room now (in conjunction with theplacement of student teachets). She does not think the situation will go away. Atfust she thoughtthis cannot be allowed because then the voters would never vote for a bond. She views it verydifferendy now. There is no way to predict the number of children in a given year. She does notwant any teacher to be faced with anymote students in their classroom than they already have.Accept that it is a foregone conclusion that Rexburg will have these modulrr .lrrrroo-s. TheCommission would determine whete the best places ^re to put the modular classrooms that wouldhave the least impact on the neighbors.

Jedd Walker stated that he gtew up in Sandy, Utah and then Provo, Utah. At the time, these werethe fastest growing communities in the nation. He grew up with portable classrooms and sees themas a permanent feature, a patt of life.

classtooms - if these modular classrooms are allowed to bectme what would be considered apemanent placement, they would be in violation of multiple sections of the Ordinance. We do notallow this type of structute to be on anything but a full foundation except in trailer parks. We haveto continue to designate them as temporafy. The best legal way to manage the structures astemporary is to have the school district give periodic updates explaining the next expansion, themodular classtoom need, etc.
Chairman Dyer stated that there was a high degree of passion on the Commission in the hope that
lvtth proper planning, there would not have to be temponry facihaes. Permanent facilities would bebuilt, these temporary facilities would go away,and the issue would not have to be dealt with at all.Now we are ficedwith the teahty of life.
Chairman Dyer said there is Commission consensus that these modular structures will be used.The time fiame issue is moot, to be worked out by staff. The Commission will focus on positionsand locations whete these structutes would be least impactful on the general public and ctmmunity.

Dr.Thomas clarified that the School District has made application to turn the vocational
building into a ptofessional technical school, a school within a school. It would become aregional school. Students would be brought in from Sugar City and Rfuie, etc. The modular
classroom would an office for administration because there is not ^fl are within the vocational
building. This year is a planning year.
Regatding Burton Elementary, Dr. Thomas cladfied he does not see a need there. The plan wouldbe to_renew the plant facitgr lerry so the School District can continue with pemanent additions ontothe elementary schools, and then in two to three years the district would go fo. a bond.
Chaitman Dyet stated the Envision Madison process would be an indispensable tool for theschool District to start talking about expansion and the need for a bond.
Regarding the new sites, the Madison School District would eventually go through the CUp process.
The Chairman said the Commission appreciates the School District's thought and,preparation onthis matter tonight.
Varr Snedaker asked for claification on what information would be necessary to present for thefuture CUP.
Chairman Dyer said it should be made clear to the public that there is a legitimate need for themodular classrooms and that there is iustification for what they are attemtting to do.

Val Chtistensen explained that he asked Ed Morin to come before the Commission because next
to the Morins'RR1 propetty there are Rural Residential2 (R.R2) lots, which are allowed to have a
setback of 25 feet from the property lot. Also, City Ordinance says a property owner can do an
aver^ge of the front yard setbacks of the houses on the same side of the streei as their property.
Howevef, there are not houses on the same side of the stfeet as the Modn property. '$7h.t" there is a
diffetent zone on the same street, that is an unusual circumstance. Is the ".qo".t something the
Commission would consider?
Ed Modn stated that he is not interested in going through ^ zorLe change.

He also suggested that Mt.Morin find out if it is possible to hook up to the sewer easement to the

Chairman Dyet clarified that the issue before the Commission is an allowable setback. The
commission is being asked if it would allow a 50 foot fiont yard setback.
There were no commissioners who were for a 50 foot front yatd setback.
There was Commission consensus that the Morins' could go with a fiont yard setback of 60 feet
from the property line.

P&Z Commissionet Scott Ferguson had tequested that a comment about overnight street parking
sent to him by Blake \Tillis be shared with the Commission.
Mr. Willis had commented that "... there should not be any overnight parking in the pEZ zone.
Daytime parking would be by permit. The city zoning required or" to otr. p"tt ing before thepqZ
zone was created. The city in effect is penalizing those facilities that provid- p"rkittg."
Stephen Zolhnget said this is a policy decision. The City Council has addressed the issue.
