LOTS: The proposed Twin Home will sit on two lots. Each lot is 33 feet by
L37.5 feet or 4s37.s square feet each for a total area of g,oTssquare
feet.
ZONING: The lots are zoned LDR3 which allows two family dwellings
with a conditional use permit. A Twin Home in this zone requires two
4,OOA square foot fots.
Lor WIDTH: A twin home in this zone requires a width of g0 feet
(combined for both lots). sixty-six {6G} foot lots were created in this
block long before the zoning was in place. Therefore it would be
impossibfe to build without a 'grandfather,, exception. Also, a
permanent right of way is granted frorn the neighber te the fuuth (15g
Harvard) to add 6 to L2 feet of width making a total of Tzto 7g feet.
Lor DEPTH: Each parcel in an LDR3 zone requires a depth not less than
60 feet. The depth of this parcel is 137.5 feet.

On July 30, 2073 Ralph I(etn presented (electronically) to the City of Rexburg planning &Zonng Coordinator a request and application for a ionditional Use permit to allow a TwinHome in a Low Density Residential3 (LDR3) zone. The property location is approximately
146 & 148 Hawatd Ave.
On July 30, 2073, the City Clerk sent the Notice of Public Hearing to be published in thelocal newspaper on August 77 andAugust 31,2013.4 notice was postedtn th. propertyand sent to all property owners within 300 feet of the above mentitned prop"rty.
On September 5, 2013, Ralph kem ptesented to the Plannin g & ZonngCommission for theCity of Rexbug, the request for a Conditional Use Permit tJalow a T'-in Home in a LowDensity Residential 3 (LDR3) zotte ^t the property location of approxim ately 146 & 14gHarvard Ave.
Dan Hanna motioned to approve the Conditional Use Permit (CUp) to allow a Twin Home inan LDR3 zone ^t apptoximately 746 & 148 HarvardAve., to incluie a condition to have parking inthe rear, and that staff review the elevations at the time of the building permit. Richie Webbseconded the motion.
There was discussion on whether to state the CUP would be for either a twin home or a duplex.
Dan Hanna withdrew his motion.
City Attomey Stephen Zolltnget, consulted by phone, clarified that the law is the same on both thetwin home and the duplex.
Dan Flanna motioned to approve the Conditional Use Permit (CUp) to allow either a twin home ora duplex at the property location of approxim ately 146 and, 148 HawardAve, with 2 conditions;

I. BACKGROUND
A few years ago, the applicant went through the process of a zone change from Low Density Residential2 (LDR2) to Low Density Residential 3 (LDru)for the subject propertf.
N. SITE DESCRIPTION
The project is located at approximately 146 & 148 Harvard Ave. The lots requested for the CUpcombinedare approximately 4537.5 sq. ft. each.

III. ANALYSIS
The following are the criteria for granting a conditional use permit. Some of the criteria are followed
by staff s analysis. A conditional use will:
a. Constitute a conditional use as established in Table I, Zoning Districts, Table 2, Land (Ise
Schedule.
A CUP is required for a twin home in the Low Density Residential 3 (LDR3) zone.
Be in accordance with a speciJic or general objective of the City's Comprehensive Plan and the
regalations of the City of Rexburg Development Code.
Comprehensive PIan
The Comprehensive Plan Map identifies the area as "single Family Residential'- The use is not
in accordance with the Comprehensive Plan. Existing LDR 3 zoning allows the use.
Development Code (Ordinance 1026)
Duplexes are allowed with a Conditional Use Permit as per the City of Rexburg Development
Code Section 3.5.020. Section 3.6.040 requires a minimum (combined) lot width of 80 feet for a
twin home. The existing lots are 33 feet wide (66 feet combined). The existing 66 foot wide lot
was created prior to the ordinance. Staff considers the lots as being "grandfathered".
Be designed and constructed in a munner to be harmonious with the existing character of the
neighborhood and the zone in which the property is locuted
A twin home should be in harmony with the existing neighborhood.
Not create a nuisance or safety hazardfor neighboring properties in terms of excessive noise
or vibration, improperly directed glare or heat, electricol interference, odors, dust or air
pollutants, solid waste generation and storage, hszardous materials or waste, scessive traffic
generation, or interference with pedestrion traffic.
Regarding glare, heat, electrical interference, dust, air pollutants, noise, vibration" odors:
Adherence to City standards should prevent these impacts from becoming a nuisance.
Be adequately served by essential puhlicfacilities and services such as access streets, police
andftre prutection, drainage structures, refuse disposal, water and sewer semice, and schools.
If existingfacilities ure not adequate, the developer shall show that suchfacilities shalt be
upgraded safficiently to serve the proposed use.

be a problem if he does not move forward fora yearortwo afterthe CUP is
granted for a Twin Home. She told him per Val that if more than a year goes
by and he has not started the project, he would need to write a letterto the
Community Development Director stating he is still intending to move
forward, etc. The letter would become part of the official file.
