A. 7:30 P.M. Surplus Real Property located mid-block east of 278 North 2"d West to determine
the method of sale, transfet, exchange, or conveyance of this real property totaling 4.27 acres
with a minimum value of $70,000 per acre.
Mayot Woodland introduced the ptoposal. City Attorney ZolJinger said the purpose of the public
hearing is to disclose the nature of how the propety will be sold by auction, sealed bid, etc. The
minimum value has been set at $70,000 per ^cre. The land is being sold as a single pnrcelat
$70,000 per acre; the patcel is not to be sold in chunks. Proceeds will go into the parks fund (as
stipulated in theJune 5 City Council meeting).

Council regarding whether or not the property should or should not be rezoned based on the criteria
found in section $6.13.
SITE DESCRIPTION
The total area involved in this re-zoning request is approximately 4.27 acres, which if approved will
result in changing a Light Industrial (LI) into a Medium Density Residential 2 (MDR2) Zone.

If approved, this rezone would remove Light Industrial (LI) zoning from the property and replace itwith Medium Density Residential2 (MDR2) zoning. Recently the zoning ott ttr" parcel directly to thewest was changed from Light Industrial to Medium Density Residential2. StaJf feels that with thatzone change, the best use for this land is to follow suit. Medium density residential is a better fit thanlight industrial. This request will allow up to eighty-five units (by righg to be constructed.
The request would require the Commission and Council to review the proposal against one set ofcriteria, for the request to rezone. Below, staff has provided all the crileria listedly Ordinance 1026(Development Code) that are required'to be addressed, followed by staffs analysis of each criterion.
Criteria Rezone Requests ($6.13):
L Be in conformonce with the City's Comprehensive PIan and the City Development Code.
The Preferred Land Use Map identifies the properfy as Moderate to High Density Residential. Theapplicant has requested Medium Density nesidlntial2 (MDR2) Zomng. This zone is allowed.The property directly to the west is zoned,Medium Density ResiOentiat 2 (MDR2).
b. The capacity of existing pablic streets, water and sewerfacilities, storm drainage facilities, solidwaste collection and disposal, and other utilities.
The City Engineer did not voice a concem.
c. The copacity of existing public services, including but not limited to, pubtic sdety services,public emergency services, schools, and parks and recreational services.
The City Engineer did not voice a concern. The appropriate Impact Fees will be collected prior tothe issuance of a Building Permit.
The potentialfor nuisances or health and safety hazards thar may adversely affect adjoiningproperties.
Staffhas reviewed and does not feel the change will have a negative effect. The Commissionshould review the potential impact of medium density residential zoning.
Recent changes in land use on adioining properties or in the neighborhood of the map revision.
The property directly to the west has recently been rezoned to Medium Densiw Residential2(MDR2).
Meets the requirements of the Comprehensive plan.

As Property Manager for Watco Companies, LLC West Region, I would like to express the concerns
on behalf of Eastern ldaho Railroad, LLC and Watco Companies regarding the rezoning proposal
referenced above.
When property that abuts or is close in proximity to the right-of-way of Eastern ldaho Railroad gets
rezoned from Industrial to a use that includes Residential, this creates a negative impact on our
ability to serve our current and potential customers in and along that right-of-way. Especially in this
particular area that already has a spur in place. As residents continue to move closer to the railroad,
our industrial customers are more and more limited or restricted from the areas they may wish to
locate.
In addition, if this becomes a residential area, there is the risk of encroachment onto the railroad
right-of-way by pedestrians on their way to the water park which creates a major safety concern.
The number one priority of Watco Companies and Eastern ldaho Railroad is safety - for our Team
Members, our customert and most certainly for the public.
For these reasons, Eastern ldaho Railroad, LLC adamantly objects to the proposed zoning change.
