On February 26,201,3 the City Clerk sent the Notice of Public Hearing to be published in the local newspaper on March 2 andMarch 1,6,201,3. A notice -ut poit.d on the properry and sent to all property owners within 300 feet of the above mentioned property. On March 21,2013 Dan Hanna presented to the Planning &ZonngCommission fot the City of Rexbug, the Request for a Rezone for the property located at 737 North 3'd West, in Rexburg, Madison County, Idaho to be rezoned fiom Low Density Residential2 to Medium Densiw Residential2. Scott Ferguson motioned to recommend to City Council to deny the request to rezone 137 North 3'd west from LDR2 to MDR2. Thaine Robinson seconded the motion. The Chair said that it is moved and seconded to not grant the zone change, the reasons lying in the deliberation the Commission has had. Cory Sorensen said it comes down to a spot zofle versus the impact to the community of a duplex or a 4-plex. He understands the precedent of a spot zoning. This neighborhood is in the beginning stage of ftansition. The subiect property is the perfect scenario to transition with very minimal neighborhood effect. It would decrease asphalt from what is currently there. It is beauti$ring the City and creating more green space. Jedd Walker said why would we on alanduse decision, condition a property to have a more restrictive height than the immediately adlacent zoning requires? Chairman Dyer said the applicant has offered it, and it protects the neighborhood. Cory Sorensen thought the condition of a fence around the property is more important fhan a height restriction. Scott Fetguson was willing to withdraw his motion if someone wants to make a different motion. Matk Rudd seconded the motion. The Chair asked if thete is a need to do more with the fence than just the subject property. The Commissioners asked if more can be done. Cory Sorensen asked how they can condition any other parcels besides the subject one? The Chair said the same u/ay there have been conditions for sidewalks to the end of a block on other developments for the public good. Mike Sexton said it may be safet to condition only the parcel for the zone change. Gil Shirley said he would like to try for it. Chaitman Dyet thought the neighborhood might very much appreciate the effort to try and do what is right in their eyes. Discussion of arca to be fenced. North fence is akeady required as a buffer. It was BECAUSE of the apartrnents that we wete able to rr;iake a lower offet. We used the then Dean Ricks apatrnents as a reason to put a lowet offer in. Secondly, perhaps if a group of 4,5 ot 6 homes were to get togethet and sell all at once, find a buyer to buy all at once, then pethaps there might be a slight inctease in propety value, but I still doubt that. For example, if the 3 homes and myself got together and gtouped out homes, got a te-zofle and sold our homes all at once fot a very conservative avetage of $100,000 each, then the suggestion is that ^rt ^cre of property in this neighbothood is woth at least $400,000. But that is beside the point, because eithet way, we as a neighborhood are voicing our opinion that we would like this to stay as a residential neighborhood. A Neighborhood of Rentets - Somehow the idea has been porftayed that we ate a community that is about status and separation. This could not be futthet from the truth. I enjoy my neighbors very much, including those that either rent a home or Lfl zPattrrr;ent. His tenderings for that latest proposal look nothing like the existing buildings. While we believe that not all homes in a neighbothood need to be identical, we do believe there should be cohesiveness within a complex. We are concerned that if this zone change is approved that plans will again change. What Mr. Hanna has spoken to us petsonally at our door was to get a duplex approved, stating nothing about ^ zone change. However in the letter that accompanied him and was rcad after he left it did state his desire to change the zoning. Mr. Flanna keeps saying he is willing to speak with us neighbors, but based on his conduct at Planning and Zontng e&4 we do believe he isn't interested in our concerns. In the last P&Z meeting he stated, he would keep paying the 5780.00 and coming back to P&Z until he got what he wanted. Another home owner on the block who prefers to remain unidentified is willing to share the following statement, which again brings us to a trust issue with Mf. Hanna. While living in this complex, and after an exhausting search of homes from the Rexburg area to the outskirts of Rigby and Menan, we finally settled on a home that fit not only our budget, but our desire for community - we had found a home directly across the street from our apartment. A favorite tool used by developers is to pull out the Comprehensive Plan. Now we are back here again wasting everyone's time for another request for a zone change. When does "No!" not mean "No"? We brought over 60 signatures to this committee opposing this change. We are asking you to deny this zone change once again and stop wasting everyone's time. The structure that is being built does not fit in with the existing structures or the neighborhood. We sat in a planning and zoning meeting just two weeks ago where they spent over 5 % hours discussing this project and as usual they passed it, but this time it was only by one vote. This one vote was by a person who changed his vote after an hour of persuasion by another member. He finally broke well after midnight. We do not feel that this is where this will end, Dan has already approached several home owners about buying their homes too. In the last city council meeting Dan Hannah accused the neighbors of not considering his tenants as families. On Saturday, March 30s, the families in his complex held an Easter egg hunt on the patch of grass in the precise location where this structure is proposed to be built. There was a comment made that Dan Hannah had said, 'There are a lot of apartments in this town with play areas, if you want a play area you can move to one of them."
