PROVTDINGTI{AT THE ZONED DESIGNATION OF THAT
CERTAIN PROPERTY HEREINAFTER DESCRIBED,
SITUATED IN RE)BURG, MADISON COUNTY, IDAHO, BE
CHANGED AS HEREINAFTER DESIGNATED; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY the City of Rexbr.tg, Idaho:
SEC"TION I: That the zoning map of the City of Rexburg, Idaho, which is filed
with the city clerk thereof, be, and the same is herebv amended and changed to ptovide
that the hereinafter described property situated in the City of Rexburg, I\'Iadison County,
State of Idaho, be rezone from lvledium Density Residential Two (2) to High Density
Residential One (1).
The said ptoperty is located at approximately 577 South 56 rJ?est, in Rexburg lVadison
County, Idaho, and mote particularly described as follows:
Leeal Descriotion:
Commencing at a point which is the Southwest comet of Lot 3, Block 6 of the Klinglet
Addition to the City of Rexburg, as per the recorded plat thereof, Madison County, Idaho,
and thence North 102 feet; thence East 297 feet; thence South 102 feeg thence West 297
feet to the point of beginning.
SECTION II: That a new zoning map shorving these amendments shall be
certified to and declared to be the offrcial zoning map of the City of Rexburg by passage of
this Ordinance by the City Council of the City of Rexbwg.

On February 77,2073,Jonafhan McMullin presented to the City of Rexburg Planning &
Zonng Cootdinator a tequest and application for a zorte change for the property located at
577 South 5'h S7est, in Rexburg, Madison County, Idaho to be rezoned frornMedium
Density Residential 2 toHtgh Density Residential 1.
On February 71,2013 the City Clerk sent the Notice of Public Hearing to be published in
the local newspaper on Febtuary 16 andMarch 2,201,3. A notice was posted on the property
and sent to all property owners within 300 feet of the above mentioned property.
On March 7 ,2}13,Jonathan McMullin presented to the Planning & ZonngCommission fot
the City of Rexburg, the Request fot a Rezone for the property located 577 South 5'h $7est in
Rexbutg, Madison County, Idaho to be rezoned from Medium Density Residential2 to High
Density Residential 1.
Dan Hanna motioned to tecommend to City Council approval of a zone change fiom
Medium Density Residential2 (AIDR2) to High Density Residential 1 (HDR1) for the
property located at 577 South 5'h West. M"ty Ann Mounts seconded the motion.
None opposed. Motion caried.
On March 20'h,2073 atCity Council the Rezone proposal for 577 South 5th West to be
rezoned ftom Medium Density Residential2 (I{DR2) to High Density Residential 1 (I{DRl)
was presented: Presentation by Applicant:
Jonathan McMullen at 577 South 5th \X/est explained the property up fot consideration. The
zone change is for the entire parcel of land. They will be building on the vac nt side of the
parcel. The zone change was unanimously apptoved by Planning and Zonng. This area is
Moderate to High Density Residential in the comprehensive plan.
