Rexbutgwas duly convened upon notice ptoperly given and a quorufrr was duly noted; and
\VHEREAS, in a Rexburg Planning and Zoning Commission tneeting on the 1" day
of March, 2072, the Planning and Zoning Commission held a public headng, aking public

1. On February 6,201.2, Cory Sorensen representing Tnr Noth Development, presented to the
Rexburg City Planning & Zoning Coordinator a Request to amend the current Comprehensive Plan
Mup ( Ftle #12 00044) to change ftom Moderate-High Density Residential (52 North 3'd West) and
Light Indusmal Q50 \fest Main) to Neighborhood Commercial/Mixed Use.
2. On February 7,201.2 the City Clerk sent the Notice of Public Hearing to be published in the local
newspaper for February 17 and Febnrary 25,201,2. A notice was posted on the properfy.
3. On March 1',201'2, Cory Sorensen presented the Comprehensive Plan Map Amendment request to
the Rexburg Planning & Zonng Commission.
Dan Hanna motioned to tecommend to City Council approval of a Comprehensive Plan Map
Amendment land use designation change for the properties at 52 North 3'd S7est and 250 West Main,
ftom Moderate-High Density Residential (52 North 3'd \West) and Light Industrial (250 West Main) to
Neighborhood commercial/Mlred use. Jedd walker seconded the motion.

4. On March 07,2072 at Crty Council Council Member Sutherland moved to approve the proposal
to amend the Comprehensive Plan Map from Moderate-High Density Residential (52 North 3'd
West) and Light Industdal (250 West Main) to Neighborhood Commercial/Mixed Use; Council
Membet Merrill seconded the motion; Discussion: Council Member Smith was concerned with
changing the residential lot to multiple use. They can ask for a zone change at alater date. City
Attorney Zolltnget indicated this proposal reduces the density for residential; however, it does allow
for additional uses. It is designed to combine uses of space. Council President Mann was
concertred with the lettet ftom the railtoad. Council Member Merrill was also concerned about the
lz;l]troad letter; however, he did not understand how it could be used for Industrial. Council Member

Benfield said the letter mentions a concem for safety. City Attorn ey Zolbtnger said the :rrikoad, maywant to park train cars in the city. If this ptoposal is approved, to become iresidential area, theg;r]troad would have to park their train cars further down the track. Council president Mann askedfot a vote:

SUBJECT: City Council Meeting 07 March 20l2,ltem 7 A. Items for Consideration :
As a resident of the neighborhood at250 West Main & 52 North 3'd West, I have several items ofconcern regarding the Comprehensive Plan Map Amendment.
l. How would a formal traffic study, as required by the Planning and Zoning Commission for this rezoneapplication, affect the outcome of rezoning if the Comprehensive PIan Map 66endment was favorable?
2. North 3'd West has lighting only from the resident homes other than the intermittently lit street lighton the West side, middle of the block. Will the developer put in sufiicient lighting on the West side ofthe developed housing in order to protect both the pedestrians and rnotor traffic foi all residents?
3. If individual property values increaseo as indicated in the Public Hearing of the Planning and ZoningCommission, will tanes for the individual proporty owners increase even though the zoning for them w]llnot change?
4- What considerations have been given to street repair and upkeep due to the increased traffic thisdevelopment will create? Many of our city streets are a "patchwoik" problemo including North 3d West,notwithstanding the efforts taken by the street departnent.
5. Does the sewer system on this street have the capacity to carry the increased use? Is it the originalsystem? If so, I am concemed that the "prime tiilre" use when everyone is doing laundry, using iedishwasher and showers will cause a back-up situation in the basements of ourhomes.
6. If the development is intended partially for family use, was there any consideration given by thedeveloper to making a *play ar€a" for small children?
7. It was stated in the Planning and ZaningPublic Hearing that no one was interested in using the lot fora single family dwelling. I disagree. The price was set so high that any interested party lostlnterest andwent somewhere else where the property lot price was more in line with the proper{y values. Was this aresult of the current Comprehensive Plan of Moderate-High Density Residentiaf versus the Zoning plan
of I"ow Density Residential 2?

To the Mayor and City Council of Rexburg
We, as residents of Rexburg who reside at 27 N. 3'd West Street, would like to voice our
objection to changing the Comprehensive plan and of the subsequent possibility of rezoning
property at 52 N 3'o W and at 250 West Main Street as proposed by Tru North Development.
Our reasoning:
1. Increased traffic as a result of 60 apartment units with all ingoing and outgoing onNorth 3'd
West Street
a. Already present difficulty entering Main Street from the above street.
b. Road breakup because of increased traffic
2. Increased population noise
3. Old city sewer may not be adequate to accommodate all additional waste
4. Increased property taxes for affected property owners
5. Decrease of property values for properties near and around apartment complex
6. Propertymanagement?
7. Snow removal could be problematic
8. No play area designed for the children residing in the complex
9. Insufficient water supply
10. Quality of life change for residents in area near the complex
11. Railroad too close for High Density Residential area.
12. Possibility of a change to include government subsidized units
14. Height of proposed units could be problematic and out of character with present
surroundings
15. Need to preserve some older residences in original part of Rexburg rather than being
dominated by apartments

16. Additional stress caused by more blacktop and concrete associated with the proposed
apartment complex to already overloaded city storm drains at the intersection of ltt North and 3'o
West. We have seen water back-up many times that nearly flooded residences on those street
comers.
17. There has been word circulating that there has been no interest in the purchasing of the
property at 52 N 3'd West until the present time. We know, in fact, that there has been interest.
Several times during the last few years we have had persons knock at our door and inquire about
the lot at 52 N l't W. Nothing came of it and we assumed that after learning the exorbitant asking
price, of which we had heard, the interested persons would not consider the property.

I am writing to the Council to express my very deep concerns over the proposal to alter the
Comprehensive City Plan and allow the properties at 52 North 3rd West and250 West Main
Street to be rezoned so as to allow a three story, 60 unit apartment complex.
During the rezoning meeting last Thursday, others pointed out the negative impact such a
development will have on our quality of life. The Railroad expressed safety concems in having
such a large population living so close to the tracks, and the need to keep the proper percentage
of light industrial zoning in the city. Concerns regarding the ability of the existing water and
sewage lines to accommodate such a large rise in population in this neighborhood were raised,
The exponential increase in traffic, including heavy trucks, the rise in the crime rate and the loss
ofvalue to our individual properties are all considerations that I urge the Council to take
seriously. I would also like to mention the low rate of occupancy of so many of the currently
existing apartment buildings around the city, including those quite close to the university. There
is hardly an apartment building anywhere in town that doesn't have large banners proclaiming
'l.Iow Renting!" and doing anything they can to entice new residents to fill those vacant spaces.
I have serious doubts that yet another monstrosity of an apartment building is really in the best
interests ofanyone except the proposed developer.
I understand that one argument posed on Thursday night in favor of the rezoning was that no one
had shown any interest in the vacant lot at 52 North 3rd West. As the person residing directly
across the street from this properfy,I can personally vouch for the high interest this properly has
garnered. For years now,I've watched as, every few months, a new group would come, drive
through the lot, call on their cell phones, only to disappear and the "for sale" sign remain. The
current owners of the property have placed the asking price so far above current market values
that no one in their right minds would purchase it. The owners did this purposely in order to
prevent the exact situation that we are now facing. They wanted to maintain the quality of the
street as it currently exists, in the hopes that their children would settle in this neighborhood.
The properly owners now reside in Hyrum, Utah, and have for about a decade. They no longer
care what is best for our neighborhood or for the City of Rexburg as a whole. Now that neither
they nor their children have decided to reside here, their concern is to now make a profit on that
lot, at the expense of the qualrty of life and peace of mind of neighbors they had previously lived
amongst.
Rezoning decisions like these are made on economic grounds, which is right and proper. But
what is economic development for? Supposedly, its for the good of the people of the city. I
would like to point out to the Council that the neighbors of 3rd West comprise the backbone of
our community. We live here 12 months out of the year, and work, pay taxes, purchase our
goods and groceries, serve on committees and volunteer our time to do what we can to make our
city the vibrant community that it is. All of us are gainfully employed or retirees, and a number
of us work as civil servants and for the school district. Most of the residents on this street have
been here for decades, and some have lived here for generations.
In my own case, I am the third generation living at 57 North 3rd West. Additionally, my gteat-
grandparents lived just around the corner on lst North. My ancestors are some of the earliest
pioneers, and helped build Rexburg from the ground up. My father's parents were Mel and Jean
Hanson, owners of the Hanson Furniture store which started on Main Street and later moved out
to the Sugar City Highway. You can still see the sign for their first store when you park in the
city lot behind the Wells Fargo Bank. Hanson Furniture, "Idaho's Biggest Little Store,"
contributed to the economic stability of this town for decades.
My mother's parents contributed in a different way. Her father, Albert Pieper, served on the City
Council, the School Board and taught German at Rick College for most of his adult life. My
grandmother, Metta Pieper, taught in the Madison School District for 35 years. I'm guessing
several of the current Council members had her as an English teacher while students at Madison
High. My great-grandfather, Chris Piepeg was the caretaker of the Tabernacle for over 30 years.
He landscaped not only the area around the Tabernacle, planting trees, bushes, flowers and lawn,
but most of the large trees in our neighborhood and surrounding the fairgrounds and along the
canal are in existence thanks to him. He was a one-man beautification committee.
I tell my background to illustrate that my story is NOT unique amongst the residents of 3rd West!
Nearly every family on our street have similar stories to tell, and they and their families have
made equally important contributions to our community. Our parents, grandparents and great-
grandparents did, and we continue to do so today. I myself decided to live here, in part because
of my family connections, but also because of the close-knit family feeling shared among the
neighbors of 3rd West. Better people are not to be found anywhere in the city! We care about
each other, watch out for each other and take each other's best interests to heart.
I strongly object to the member of the Planning andZoning Commission who stated last
Thursday that our street is'Just a bunch of old houses." Most of our street are single family
homes. And while two have basement apartments which they've had since the early decades of
the 20th century, we have very little rental properly when compared to many other areas of the
city.
As far as being old and run-down, I would like to point out that our neighbor at 37 North 3rd
West won the City Beautification award just a year or two ago! Old we may be, historic we
certrainly are, run-down we are not! We love our steef are deeply committed to our
neighborhood and our city, and deserve to maintain the peaceful, quiet haven that our street
provides.
Yes, we would love to see the property at 52 North 3rd West developed, but in such a way as is in
keeping with the current neighborhood and existing zoning. Put in a single-family house, or a

duplex. Even a small communlty park similar to that at the end of Park Street so that our
children have a place to play without risking the dangers of crossing Main Street. But do not
allow development which is so thoroughly out of keeping with the nature and character of the
street. I sfrongly urge the Council to reject the plans which would allow the high-rise apartment
complex now proposed.
I would remind those members of the Council who promised in their election campaign pledges
that they would preserve the historic qualrty and character of our neighborhoods, and curb
inappropriate development. Please reject these current proposals which would so severely
negatively impact our peace and the quality of life we now enjoy.

We are writing this letter in reference to the proposed 3-story apartment complex
across the street from our house'
we have resided at 23 North 3d west for the past 15 years and lived at 77 North 3'd
west before that for several years. we have enjoyed this neighborhood and the
p.opt. in it for about 20 years now. we have become very close to our neighbors
and have formed friendsirips of trust and respect. Many of these neighbors have
lived here for many, many more years than we have. This is not a transient
neighborhood, people have raised their families here and wish to enjoy the rest of
their lives ,u.round.d by people they know and love'
Some of the concerns thatwe have, and in no particular order, are:
1. That this apartment complex will decrease the property value of our house' We
t ave easity put $50,000 into our property through the last 15 years in hopes of
making our PropertY value higher'
2. The increased traffic flow on Third West and the streets surrounding it are a
concern. We already frru. a great deal of traffic coming from Main Street' There is
already a certain degree of noise coming from Main Street and the railroad tracks'

music louder. It is also highly reasonable to realize that the amount of pedestrians
walking past our home is going to increase'
3. The safety of our family in this neighborhood is a concern for us' We recently

off for several hours in the evening by the police department because there was a
hostage situation. People were not ailowed to get into their own homes until the
matter was resolved because of the potential dinger. We feel like the more people
that are living in the neighborhood will inevitably increase problems'
4. We are private people who don't wish to have a large amount of strangers living'

close in proximity that they know when we are home, when we are not home, and
what our daily schedule is. We feel like our privacy would drop immensely and our
sense of security would be completely devastated.
We would hope thatyou would put yourselves in our shoes and think about how
you would feel if the zoning in your neighborhood was being changed and someone
was allowed to build a large 3-story apartment complex across the street from your
beloved home, causing you to feel like your dreams of a close-knit neighborhood
were being taken away from you.
We believe that this may just be the first stage of the reconstruction of our
neighborhood. Is this the beginning of more buildings to come?
Some may think that our neighborhood is not one of the most desirable locations in
Rexburg. In fact, when we describe where we live to others, we affectionately tell
them that we live in the "Historical Section" of Rexburg. That is because this
neighborhood does have history to it. It would be a shame to change the whole look,
feel, and dynamic of this wonderful place that so many of us have for years called
home.
We apologize for not being able to attend the meeting but we had previous plans
that we were not easily able to get out of. We hope that you know that we are taking
this matter seriously and have strong feelings about it.

SUBJECT: Public Hearing To Amend the Comprehensive Plan Map and the Zoning Map

l. I am a resident of Rexburg City concerned about the proposed subject changes. My concems are:
a. Has there been a formal traffic sfudy made?
Up to now this has been a reasonably safe neighborhood for young families and their
children. By the scope of this rezoning and the subsequent apartment complex, the motor traffic will
increase significant$. Not only will there be more traffic on 3rd West, but the accessibility to Main
street will cause more congestion and hazard, such as it has on Main Street with the Main Street Station
aparfments and the Cambridge apartrnents.
b. Has additional lighting been considered for 3rd West?
There is only one intermittently lit street light in the middle of this block. If no additional
lighting is put in, it will be hazardous to any and all residents along the street because of the increased
motor haffic. How is the City of Rexburg planning to eliminate this hazard? If the City of Rexburg seesthe need to put in additional street lighting, will there be an increase in the "safety lighting fees" on the
monthly utilities billing. The property owners will then be the ones being penalized by increased costs.
c. The Rezone Application shows an architect's drawing of the area the apartments will be built on;
there is also a noted area that shows an additional 63 units on the Southwest corner of Block 30. How is
this additional complex golng to effect the traffic and lighting conditions as mentioned above?
d. What will happen to the single resident taxes? Will they increase or decrease with the zoning
change?
Some of the residents are on a fixed retirement income and the cost to live in Rexburg has increased
considerably over the last ten years. It makes it extremely difficult to meet our living needs when costs
continue to go up. Has there been any consideration given to the to the plight of the elderly to stay in the
homes they have lived in for so many years?
e. Item 4 of the Development Information indicates there are existing land uses in the general area
similar to the proposed use. I disagree. How is commercial to the East and MDR1 to the West similar
to MU2? Further, I don't believe this would be a "great transition" for the current residents in this block.It will benefit only the developer.
f. Will a complex of this proposed magnitude, and with the additional63 units, be fully utilized?
My concern is that there is so many apartment complexes being built in the South and West part of the
city that there will be a glut of unutilized units. When this happens, the neighborhood usualty degrades.

As property Manager for Watco Companies, LLC West Region, I would like to express the concerns of
Eastern tdaho Railroad regarding the requests for rezoning property within the City of Rexburg'
When property that abuts or is in close proximity to the property of Eastern ldaho Railroad is
rezoned from Industrial to a use that includes Residential, we are concerned because of the negative
impact this could have on our ability to serve our customers in and along the railroad right-of-way.
As more residents move closer to the railroad, our industrial customers are more and more limited
or restricted from the areas they may wish to locate.
In addition, as the number of residents and citizens in close proximity expands, the possibility of
encroachment on to the railroad right-of-way by the public also increases which creates a safety
concern for Eastern ldaho Rallroad.
For these reasons, Eastern ldaho Railroad respectfully objects to the proposed zoning changes.
