1 . To encourage alternative travel options, i.e bicycling, bike racks and hard surface must be provided at l0%;o of beds.
Location of racks needs to be on hard surface and shown on revised site plan.
2. Lighting shall be low (under lS-feet in height) and not create glare, and as a minimum shall adhere to the City's
lighting ordinance.
3. Sidewalk and pathway maintenance to be performed as per the PEZOrdinance.
4- Parking Contracts to be approved by the City Attorney.

curbing. It should have trees and bushes to provide a buffer.

On June 06, 2012 Mayor Woodland reviewed the proposal for a Conditional Use
Permit at 51 South 1" East.
Ryan Lerwill at 721,6 Stocks Avenue, tepresenting Run Hard, T T .C reviewed the
proposal. They reviewed the 20 points of detail in the PHZ overlay. They believe the
city staff calr answef any questions on the proposal. It was unanimously
tecornmended for approval by the Planning andZontng Commission. They are
willing to comply with all conditions recommended by Planning and Zorlng. Council
Member Merill reviewed the concerns of neighbots about the fagade on a portion of
the exterior of the building. Mr. Lerwill said the wall will be completely taken cate of
by their development.
Council Member Merrill asked about parking for the tenafits. AII of those
questions were addressed in the PlanningandZontngmeeting. The City Attorney
will review all of their parking contracts. He reviewed the patking locations for the
development on the overhead screen. All parking will be in the tear of the stnrcture.
They hope the University -ili provide oversight of the facility to comply with
Univetsity standards.
Council Membet Mann asked why they are asking for zero commercial' Mt'
Lerwill said there is a conflict with a Mixed Use Zone and the University's policy to
disallow single student housing ovef commercial space. Thetefore, they were unable
to seek commercial use in the building. Community Development Director
Christensen explained the reasoning for the CUP to allow zero cornmetcial' The plan
was to look at a development on a case by case basis to see if commercial would fit.
Council Member Sutherland moved to approve the Conditional Use Permit at 51
South 1" East to allow zero percent commercial in Mixed Use 2(1\4U2), and to take
advantageof a loweted number of patking spaces ftom 100 pelcent required patking

As you may know, ldaho Department of Lands' (lDL) mission is to manage State Endowment Trust
Lands (State Trust Lands) in a manner that will maximize long-term financial returns to the Beneficiary
Institutions. The IDL mission is a constitutional mandate and is overseen by the State Board of Land
Commissioners. State Trust Lands are not managed for the public at large and should not be referred
to as "public lands" or "open space," either specifically or in a generic sense. These are working lands
producing revenue for the Beneficiary lnstitutions.
IDL has reviewed the public hearing agenda received on May 10, 2012, provided by the City ofRexburg for the requests as listed above. Based on the documentation provided to lDL, the requests
will not impact State Trust Lands at this time. Should the proposed applications be modified during
